SCTM#1000~36-1-1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed action is CONSISTENT with the below listed LWRP polices and therefore CONSISTENT with the LWRP: lO. 1 (b) Improve the economic viability of water-dependent uses by allowing for non-water dependent accessory and multiple uses, particularly water enhanced and maritime support services where sufficient upland exists. The term water-enhanced use means a use or activity which does not require a location adjacent to coastal waters, but whose location on the waterfront adds to the public use and enjoyment of the water's edge. Water-enhanced uses are primarily recreational, cultural, retail, or entertainment in nature. These uses may be necessary for the successful financial operation and viability of water-dependent uses. The improvement of the boat storage building and 2 story office/storage (water enhanced use) supports the above policy. Note: That the Board of Trustees issued a permit (TR-7834) for the action on June 20, 2012. The control of stormwater will be addressed during the site plan review process. Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. The proposal, as designed, will not result in adverse effects to the surrounding environment in that the project will not increase the structural coverage of the property, and will not encroach any further towards the surface waters of Sterling Creek along the western shoreline. In addition, this commercial marina has existed harmoniously within this location for decades which has not resulted in any form of adverse impact to the surrounding environment. Accordingly, we believe that this project is consistent with this policy. With respect to the proposed reconstruction of the proposed bulkhead and dockage: Subiect proposal is consistent with the policy in that the siting/utilization of the reconstructed dock assembly and siting/utilization of the proposed reconstructed/reconfigured bulkhead will maintain the character of the surrounding area, which currently consists of other commercial marinas as well as many residential lots with similar structures (i.e. dock assemblies and bulkheading along Sterling Creek). In addition, subject proposal will be in harmony with the "... beneficial use ora coastal location..." in that this lawfully created & operated Commercial Marina will be enhanced by the reconstructed dock assembly and bulkheading.
