A site inspection was performed on Friday September 21, 2012.
The Board of Trustees approved the action in September 2012. The permit has not been wdtten,
therefore it is not enclosed.
RICHARD DOWNING #6593 - Request for Variances from Article XXlil Section 280-124 and the
Building Inspector's June 26, 2012 Notice of Disapproval based on an application for building permit for
demolition and re-construction of a new single family dwelling at: 1 ) less than the code-required
minimum side yard setback of 15 feet; 2) less than the code required combined side yard setbacks of
35 feet, located at: 1280 Bayberry Road (adj. to a Lagoon) Cutchogue, NY. SCTM#1000-118-2-10
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
CONSISTENT with the denoted following Policy Standards and therefore is CONSISTENT with the
LWRP provided the following is addressed:
1. It is recommended that the Board note that the area seaward of the 20' contour line is a "bank"
