A Board of Trustees permit (7179) has been issued on September 23, 2009 and has since EXPIRED. The
plans that the Board of Trustees approved and that this Board is reviewing are different; however, the
changes do not affect the proposed setback of 75.7 feet from the wood deck to Peconic Bay. A site
inspection was conducted on October 5, 2012.
MICHAEL and DEBRA THOMPSON #6600 - Request for Variance from Article XXIII Section 280-122A and
the Building inspector's September 20, 2012 Notice of Disapproval based on an application for building
permit for partial demolition and second story re-construction to an existing single family dwelling at: 1 ) less
than the code required minimum side yard setback of 15 feet, 2) less than the code required combined side
yard setbacks of 35 feet, located at: 9280 Nassau Point Road (adj. to Peconic Bay) Cutchogue, NY.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based
upon the information provided on the LWRP Consistency Assessment Form submitted to this department,
as well as the records available to me, it is my determination that the proposed action is CONSISTENT with
the policy standards and therefore CONSISTENT with the LWRP.
Note that the Board of Trustees permit requires that "the existing buffer on the property is to be
maintained". Since the Board of Trustees permit has expired, it is recommended that the buffer be
re-established and defined in composition, width and length. A landscaped buffer is recommended
incorporating the existinq veqetation.
Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its whiten
determination regarding the consistency of the proposed action.

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
