The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed action is INCONSISTENT with the below listed LWRP polices and therefore INCONSISTENT with the LWRP: The bluff is vegetated and currently stable however the likelihood that the bluff will erode over time during storm events capable of causing tidal surge is moderate to high. Policy 4.1. Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are recommended: specifically A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 5. Manage development in floodplains outside of coastal hazard areas so as to reduce adverse environmental effects, minimize the need for future structural flood protection measures, or expansion of existing protection measures and to meet federal flood insurance program standards. The pool and related structures are proposed to be located within 50' from the top of bluff which does not comply with Chapter 275 Wetlands and Shorelines of the Southold Town Code. Note, that Chapter 275 was amended in 2012 to reduce the pool and related structure setbacks from a minimum if 100' to a minimum of 50'. Related structures are undefined in the code section. In a December 4, 2012 meeting with the Office of the Town Attorney and Jim King, President of the Board of Trustees, it was clarified that the intent of the terms "related structures" was to include but not be limited to; all pool houses, decks, patios, retaining walls and drywells related to a pool. The pool patio is seaward of the minimum 50' setback and therefore does not comply with Chapter 275 of the Southold Town Code. It is recommended that the Board relocate the pool patio landward of the 50' setback from the top of bluff to meet this policy and reduce the risk of property loss from potential erosion in the future. Policy 5.4 Limit the potential for adverse impacts of watershed development on water qualify and quantity. A. Protect water quality by ensuring that proposed expansion or intensification of existing watershed development results in: 3. protection of areas that are particularly susceptible to erosion and sediment loss A pool de-watering well is not proposed. Pool de-watering wells are recommended to contain treated pool water in the event that the pool must be drained. If the Board requires a pool de-watering well then it is recommended that the well be located landward of the pool. Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
