SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
LWRP DETERMINATION.' The relief, permit, or interpretation requested in this application is listed under the
Minor Actions exempt list and is not subject to review under Chapter 268.
PROPERTY FACTS/DESCRIPTION: The Applicants' property is a +/-31,627 sq. ft. parcel in the R-40 Zone.
The northerly lot line measures +/-164.27 ft. along Miriam Road. The easterly lot line measures +/-238.88 ft. along
adjacent properties, the southerly lot line measures +/-123.15 ft. along other adjacent property, and the westerly lot
line measures +/-196 ft. along Inlet Drive. This corner lot is adjacent to two streets, and has two front yards. The
property is improved with a one story single family dwelling, as shown, with the proposed new construction, on the
plot plan drawn by Michael Macrina, Architect dated 9-24-12.
BASIS OF APPLICATION: Request for Variance from Article XXIII Section 280-124 and the Building
Inspector's October 2, 2012 Notice of Disapproval based on an application for building permit for additions and
alterations to an existing dwelling at: 1) less than the code required front yard setback of 40 feet, both streets on
this corner lot.
RELIEF REQUESTED: The Applicant requests front yard variances in order to construct a proposed second story
addition, including second story decks, and a proposed covered porch. The Applicant proposes to maintain the
existing front yard setback of 25' 1" from lnlet Drive for the single story dwelling, and proposes a new setback of
38' 11" from Inlet Drive for a new second story addition, where Town Code requires a 40 ft setback. The Applicant
proposes to maintain the existing 22' 10" front yard setback from Miriam Road for the new second story addition,
which will include two new second story decks with a 25'5" and 21' setbacks from Miriam Road, and also
proposes to establish a new front yard setback of 11'11" from Miriam Road for a new covered porch, where Town
Code requires a 40 ft. setback. The existing front yard setbacks are 25'1" from Inlet Drive, and 22'10' from
Miriam Road for the single story dwelling on this parcel.
ADDITIONAL INFORMATION: The ZBA received a letter dated Oct. 25, 2012, from the Mattituck Park
District's attorney, requesting that three conditions be placed on any relief granted by the Board of Appeals to the
applicant, whose property is adjacent to property maintained by the Park District. At the public hearing On
December 6, 2012, the Park District attorney verbally amended that request by removing item #3, and, at the

request of the Board, submitted a letter dated December 14, 2012 clarifying the Park District's recommendation
for the re-vegetation of an area owned by the Park District that was cleared by the applicant. The ZBA also
received verbal testimony at the public hearing from persons affiliated with the Mattituck Park District. The ZBA
requested and received on December 12, 2012 supplemental information from the Applicant's architect relating to
non-conforming front yard setbacks within the neighborhood. In prior Appeal 2828, dated Aug. 21, 1981, a
previous owner of this property was denied a variance to subdivide the property into two parcels, both with
insufficient lot areas, and one with insufficient road frontage
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on November 1,2012, then adjourned upon
Applicants' request until December 6, 2012, at which time written and oral evidence were presented. Based upon
all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other
evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings:
1. Town Law §267-b(3)(b)(1). Grant of the variances requested for the 38'11" setback from Inlet drive, and
the 22' 10" setback from Miriam Road for a second story addition will not produce an undesirable change in the
character of the neighborhood or a detriment to nearby properties The existing front yard setbacks are 25' 1" from
Inlet Drive, and 22'10" from Miriam Road for the single story dwelling on this parcel, and second story additions
are customary in this residential neighborhood. Grant of a variance for the 25'5" and 21' front yard setbacks for
the second story decks will not produce an undesirable change in the character of the neighborhood or a detriment
to nearby properties, considering the established 22'10" setback from Miriam Road for the existing single family
dwelling. Grant of a variance for the 11'11" front yard setback for a proposed new 1 story covered porch will
produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because it
would create a new nonconforming front yard setback that would be a 50% increase in the existing degree of non-
conformance and in the average front yard setbacks for properties in this neighborhood. The Applicant did not
clearly establish that this degree of variance relief was essential and necessary to the proposed additions and
alterations, that the propose~t 11'11" porch setback was characteristic of other properties within the neighborhood,
or that the granting of such relief would not be a detriment to the character of this residential neighborhood.
2. Town Law §267-b(3}(b}(2). The benefit sought by the Applicant for a second story addition with second story
decks can not be achieved by some method, feasible for the applicant to pursue, other than an area variance because
the dwelling on this comer lot has two existing nonconforming front yard setbacks and second story additions can
not be built without the granting of variances. The benefit sought by the Applicant for a covered porch can be
achieved by some method, feasible for the applicant to pursue, other than an area variance because an attached
porch could conceivably be built in a more Code conforming location on this property.
3. Town Law l~267-bt3}tb}(3}. The variance granted herein for construction of a second story addition with a
38' 11" front yard setback from Inlet Drive is not mathematically substantial, representing +/-2.5% relief from the
code. The variances granted herein for a 22'10' front yard setback front yard from Miriam Road for the proposed
second story, with 25'5"and 21' setbacks for the proposed second story decks are mathematically substantial,
representing +/-43% relief from the code for the second story addition, and +/-37% and +/-47% relief for the two
second story decks. However, this degree of relief is mitigated by the fact that the existing front yard setback is
already established at 22' 10" from Miriam Road.
4. Town Law §267-b{3)(b}{4} No evidence has been submitted to suggest that the granting of variances in this
residential community will have an adverse impact on the physical or environmental conditions in the
neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code.

5. Town Law §267-b{3)(b}{5). The difficulty has been self-created. The applicant purchased the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of additions and alterations, while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Homing, seconded by Member Weisman
(Chairperson), and duly carried, to
GRANT, the variances as applied for, for the construction of a second story addition with two second story decks.
DENY, the variance as applied for, for the construction of a covered porch facing Miriam Road Extension with a
front yard setback of 11' 11".
Subject to the following conditions:
1. Applicant shall relocate and maintain any/all portions of their existing chain link fence that are outside of their
property lines to their own property. Additionally, applicant shall remove any gate providing access to Mattituck
Park District property, and show same on an updated survey.
2. Applicant shall re-vegetate the Mattituck Park District property which was cleared by the applicant up to 20 feet
on the Park District's property with plants listed in the Cornell Cooperative Extension Seashore plantings Guide,
as revised September 1998 and pursuant to the recommendations for Belt I-A.
3. Before applying for a building permit, the applicant or agent must submit to the Board of Appeals for approval
and filing, two sets of the final site plan/survey, and amhitectural elevations and floor plans conforming to the relief
granted heroin. The ZBA will forward one set of approved, stamped drawings to the Building Department. Failure
to follow this procedure may result in the delay or denial of a building permit, and may require a new application
and public hearing before the Zoning Board of Appeals.
That the above conditions be written into the BuiMing Inspector's Certificate of Occupancy, when issued.
Any deviation from the variance(si granted herein such as alterations, extensions, or demolitions, are not authorized under this application
when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or
other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly
addressed in this action.
The Board reserves the rightto substitute a similar design that is de minimis in nature for an alteration that does not increase thc degree of nonconformity.

Dear Mr. Macrina:
I am in receipt of your letter dated May 7, 2013 and the revised plot plan with the architectural
drawings, requesting approval of the revisions per ZBA decision #6606 dated December 20,
2012.
As stated in the decision under condition number one, all of the applicant's fence must be
relocated onto to their own property, and under condition number two, the Mattituck Park District
property that was cleared by the owner/applicant must be re-vegetated. The plot plan dated last
revised 5-7-13, that you submitted with your request for approval, does not show the fence on the
applicant/owner's property or the proposed re-vegetation plan.
In order to approve your project, I will need to receive a plot plan showing how both of those
conditions are being met. Once I receive the required information I will review the documents
again and make a determination. Once approved, a copy will be forwarded to the Building
Department so you may obtain a building permit. Please note the office only requires two sets of
the revised plot plan and re-vegetation plan. If you need further assistance please call the office.

Dear Members of the Board,
I would like to thank you very much for allowing me to provide you with
additional information regarding my application for a front yard variance. Please find
enclosed (5) sets of the following information as you have requested:
1) Pre-existinl[ certificate of occupancy: this document states that the home and
detached garage was constructed prior to April 9th, 1957.
2) Prior Front Yard Setback Variances in the surroundinn area:
a. 1455 Inlet Drive: a front yard variance was granted to construct a new
home on 8/30/1962 to allow for a 7.5 ft. front yard setback on Inlet Drive
b. 735 Sound Beach Drive: a front yard variance was granted to construct a
new home on 6/18/t970 to allow for a 20 fL front yard setback on Sound
Beach Drive.
c. 1700 Inlet Drive: a front yard variance was granted to construct an
addition to a home on 7/24/1975 to allow for a reduced setback on Inlet
Drive. No exact dimension was noted in the file.
d. 455 Sound Beach Drive: a front yard variance was granted to construct an
addition to a home on 9/15/2011 to allow for a 31 ft. front yard setback on
Sound Beach Drive.
e. 250 Sound Beach Drive: a front yard variance was granted to construct an
addition to a home on 3/13/1997 to allow for a reduced front yard setback
on Inlet Drive. No exact dimension was noted in the file.
I calculated the average front yard setback on Miriam Road, east of Inlet Drive to
be approx. 23.5 ft. which consists of 3 homes and the average front yard setback for the
full length of Miriam Road to be approx. 52 ft. which consists of 14 homes. If you have

Ladies and Gentlemen:
I am counsel to the Mattituck Park District (the "Park
District"). The Park District is an adjoining property owner to
the parcel owned by the Applicant at 1240 Inlet Drive, Mattituck,
New York (the ,,Parcel"). We hereby respectfully submit to the
Southold Zoning Board of Appeals that the application not be
approved without the following conditions:
(i)
Applicant remove the chain link fence which encroaches up
to a distance of approximately twenty (20) feet onto Park
District property which is contiguous with the easterly
boundary of the Parcel;
(2)
Applicant revegetate in compliance with applicable law the
Park District property that was cleared by the Applicant
between the encroaching chain link fence referred to in
Item 1 above and the easterly boundary of the Parcel; and
(3)
Applicant remove any barrier, fencing or other obstruction
they have erected at the end of Miriam Road which area
needs to remain unobstructed in order to permit emergency
vehicles to access the Park District property from the end
of Miriam Road.

Dear Chairperson Weisman:
I am counsel for the Mattituck Park District and appeared before
the board on December 6, 2012 with respect to the above matter.
The board requested a planting recommendation for the area
cleared by the applicant and we propose the following:
That the applicant revegetate the Mattituck
Park District property cleared by applicant between
the chain link fence encroaching up to 20 feet on
to the Park District's property (fence to be moved by
applicant to property line) and the easterly boundary
of the applicant's parcel utilizing plants listed in
the Cornell Cooperative Extension Seashore Plantings
Guide, as revised September 1998, and pursuant to the
recommendations for Belt I-A. Seashore Conditions.
The applicant may obtain a copy of the guide in the Town
Trustees' Office.
