WITNESSETH, that the party of the first pan, in consideration of Ten Dollars and other valuable consideration
paid by the party of the second pan, does hereby grant and release unto the party of the second part, the heirs or

bounded and &scribed as follows:
BEGINNING at i point on the Westerly side of Midway Road, where the same is intersected by the
Southerly en of the carve connecting the Westerly side of Midway Road with the Southerly side of
Cedar Point ad West;
RUNNING THEN from said point of beginning, Southerly along the Westerly side of Midway Road alon-
the arc of a zurve bearing to the left having a radius of 300 feet, a distance of 60.39 feet to the
division line between lots 139 and 140;
THENCE along 3aid division line, North 70 degrees 47 minutes 30 seconds West, 232.05 feet to the m:

THENCE along the mean high water line of West Lake on a tie line North 5 degrees 00 minutes 00
seconds East, 56 feet to the division line between lots 138 and 139;
THENCE along said division line, North 89 degrees 00 minutes 40 seconds East, 162 feet to the
Westerly side of Cedar Point Road West;
THENCE along the Westerly side of Cedar Point Road West, South 28 degrees 00 minutes 40 seconds We:
18 feet to tle Southerly side of Cedar Point Road West;
THENCE along the Southerly side of Cedar Point Road West, South 61 degrees 59 minutes 20 seconds
East, 96.79 eet to the Westerly end of the curve first above mentioned;
THENCE South ly along the arc of said curve bearing to the right having a radius of 14.18 feet, a
distance of 4.83 feet to the Westerly side of Midway Road at the point or place of BEGINNING.
Being the sa e premises described in the deed to the parties of the first part herein by deed from
Paul Ferdenz and Corinne A. Ferdenzi, husband and wife, dated June 1,1990, recorded June 12, 1990
in Liber 110 4 Page 31. Said premises are known and disignated as District 1000, Section 090.00,
Block 01.00 nd Lot 007.000.
TOGETHER with all right, title and interest, if any, of the parry of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and
all the estate and rights of the party of the first pan in and to said premises; TO HAVE AND TO HOLD the
premises herein granted onto the party of the second part, the heirs or successors and assigns of the party of the
second pan forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law,covenants that the party of the first
put will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to
the payment of the cost of the improvement before using any part of the total of the some for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
