Board and Office Policies, Practices, and Activities: Condition Added to Waiver of Lot Merger determinations To better inform property owners about the procedures required to legally codi~ the granting by the ZBA ora waiver of lot merger, and to avoid the possibility of two lots re-merging in future, the Board decided to add the fbllowing condition to our favorable decisions, as suggested by our Assistant Town Attorney: "Proof that waiver of merger is effected by way ora deed from the applicant to a separate individual or entity conveying title to that portion of the property known as be provided to the ZBA within 2 years of the date of this decision. Failure to comply with this condition will result in nullification of the waiver of lot merger granted herein." Addition/update to Special Exception applications and permits The Board updated its Special Exception permit findings and determinatiou to include Section 280-142 (G) which refers to Chapter 263 stormwater management, as part of the General Standards, which will henceforth also be provided to all applicants prior to a public hearing.
