1. Conformance With Plans All activities authorized by this p~mfit must be in strict conformance
with the approved plans submitted bythe applicant or applicant's agent as part of the p~nnit application.
Such approved plans were prepared by Diana DeLucia and ~ Leutwyier and are dated January 2008.
2. Notice of Commencement At least 48 hours prior to commencement of the project, the permittee
and contractor shall sign and return the top portion of the enclosed notification form certifying that they
are fully aware of and understand ali terms and conditions of this permit. Within 30 days of completion
of project, the bottom portion of the form must also be signed and ~*turned, along with photographs of

3. Notice Covenant The pe~'~fit holder shall incorporate a restrictive covenant to the deed for the ~.'
property where the project will be conducted and file it with the Clerk of Suffolk County within~0?lays
of the effective date of this l~mfit. This covenant shall restrict any further development to the property
on the seaward side of the existing house. This deed covenant shall run with the land in perpetuity. A
copy of this covenanted deed or other acceptable proof of record, along with the number assigned to this
l~xmit, shall be submitted within 90 days and prior to the commencement of any regulated activity at the
site to: NYSDEC, Marine Habitat Protection, 50 Circle Road, Stony Brook NY 11790-2356, Arm:
Compliance.
4. No Construction Debris in Wethmd or Adjacent Area Any debris or excess material from
construction of this project shall be completely removed i~om the adjacent area (upland) and ~movad to
an approved upland area for disposal. No debris is l~xiiiitted in wetlands and/or protected buffer areas.
$. No Disturbance to Vegetated Tidal Wetlands There shall be no disturbance to vegetated tidal
wetlands or protected buffer areas as a result of the pcanfitted activities.
6. Seeding Disturbed Areas All areas of soil disturbance resulting from the approved project shall be
stabilized with appropriate vegetation (grasses, etc.) immediately following project completion or prior
to p~mit expiration, whichever comes first. If the project site remain~ inactive for more than 48 hours
or plantiaS is imlYta~tieul duo to th~ ~on, then the ar~ shall b~ atabiliz~t with st~w or hay mulch or
jute matting until weather conditions favor g~sxxfination.
7. Storage of Equipment, Materials The storage of construction equipment and materials shall be
confined within the project work area and/or upland areas greater than 50 linear feet from the tidal
wetland boundary.

~. Install~ Maintain Erosion Controls Necessa~ erosion control measures; i,c., straw baic~, silt
fencing, etc., are to be placed on the downslopc edge of any disturbed area. This sediment barrier is to
be put in place before any disturbance of the ground occurs and is to be maintained in good and
functional condition until thick vegetative cover is established.
9. Runoff Directed to Uphnd Drywelb Roofrunoffshall be directed to drywells a minimum of 60
linear fe~t landward of the tidal wetland boundary for immediate on-site recharge.
10. State Not Liable for Damage The State of New York shall in no case be liable for any damage or
injury to the structure or work herein authorized which may be caused by or result fi-om future operations
undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no
claim or fight to compensation shall accrue from any such damage.
11. State May Order Removal or Alteration of Work ff future operations by the State of New York
require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the
Depar~nent of Enviroumental Conservation it shall cause unreasonable obstruction to the free navigation
of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause
loss or destruction of the natural resources of the State, the owner may be ordered by the Depa~'haent to
remove or alter the structmul work, obstructions, or hazards caused thereby without expense to the State,
and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other
modification of the watercourse hereby authorized shall not be completed, the owners, shall, without
expense to the State, and to such extent and in such time and manner as the Department of
Environmental Conservation may require, remove all or any portion of the uncompleted struetur~ or fill
and re~wre to its former condition the navigable and flood capacity of the watercourse. No claim shall
be made against the State of New York on account of any such removal or alteration.
12. Precautions Against Contamination of Waters AIl necessary precautions shall be taken to
preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents,
lubricants, epoxy coatings, paints, concrete, lcachate or any other environmentally deleterious materials
associated with the project.
13. State May Require Site Restoration ffupon the expiration or revocation of this pemdt, the
project hereby authorized has not been completed, the applicant shall, without expense to the State, and
to such extent and in such time and manner as the Depamnent of Environmental Conservation may
require, rc~nove all or any portion of the uncompleted structure or fill and restore the site to its former
condition. No claim shall be made agaln~ the State of New York on account of any such removal or
alteration.
GENERAL CONDITIONS - Apply to ALL Authorized Permits:
1. Facility Inspection by The Deparlment The pv. uitted site or facility, including relevant records, is
subject to inspection at rcasonablc hours and intervals by an authorized reprasentativc of thc Depmlment

Thc permittee shah provide a person to accompany the Department's representative during an inspection
to the p~vrnit area when requested by the Depm hnent.
A copy of this permit, including all referenoxl maps, drawings and special conditions, must be available
for inspection by the Department at all times at the project site or facility. Failure to produce a copy of
the permit upon request by a Depmtment represeatative is a violation of this permit.
2. Relationship of this Permit to Other Department Orders and Determinations Unless expressly
provided for by the Department, issuance of this permit does not modify, supersede or rescind any order
or determination previously issued by the Department or any of the te~ias, conditions or requirements
contained in such order or det~'mination.
3. Applications For Permit Renewals, Modifications or Transfers The permittee must submit a
separate written application to the Department for p~nnit renewal, modification or transfer of this
permit. Such application must include any forms or supplemental information the Department requires.
Any renewal, modification or transfer granted by the Depa~hnent must be in writing. Submission of

S. Permit Modifications, Suspensions and Revocations by the Department The Department
reserves the right to modify, suspend or revoke this p~xmit. The grounds for modification, suspension or
revocation include:
a. materially false or inaccurate statements in the permit application or supporting papers;
b. failure by the peamittee to comply with any terms or conditions of the permit;
c. exceeding thc scope of thc project as described in thc permit application;
d. newly discovered material information or a material change in environmental conditions, relevant
technology or applicable law or regulations since the issuance of the existing permit;

provisions of the Environmental Conservation Law or regulations of the Depastment related to

Article 78 of thc New York Civil Practice Laws and Rules or any citizen suit or civil rights provision
under federal or state laws.
Item B: Permittee's Contractors to Comply with Permit
The permittee is responsible for informing its independent contractors, employees, agents and assigns of
their responsibility to comply with this permit, including all special conditions while acting as the
permittce's agent with respect to the permitted activities, and such persons shall be subject to the same
sanctions for violations of the Environmental Conservation Law as those prescribed for the p~xmittee.
Item C: Permittee Responsible for Obtaining Other Required Permits
The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-
way that may be required to carry out the activities that are authorized by this permit.
Item D: No Right to Trespass or Interfere with Riparian RiOts

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODF: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated 4/21/09 stating that this application is considered a matter for local determination as there appears
to be no significant county-wide or inter-community impact.
PROPERTY FACTS/DESCRIPTION: The subject property is a 12,900 square foot, not including 1500 square
feet of wetlands, parcel as indicated on a site plan prepared by Diana DeLucia and Albert Leutwyler, and July
31, 2006 survey pre,red by Smith, Jung and Gillis, L.S. The property is improved with a single-story 852
square foot frame dwelling. The parcel measures 153.0 feet along the Southern property line to the high water
line, 108.81 feet alor/~j a tie line adjacent to Long Creek on the Western property line, 146.5 feet along the
Northern property linel and 106.42 feet along the Eastern property line to the private right-of-way. The property
has a tidal wetland boundary a ong the western edge of the property at Long Creek.
BASIS OF APPLICA]~iON: Requests for Variances under Section 280-124, based on the Building Inspector's
February 10, 2009 NOtice of Disapproval concerning a proposed deck addition to the dwelling, which new
construction will have ,setbacks from the front property line at less than the code-required minimum of 35 feet
and from the rear pro~rty line at less than 35 feet.
LWRP: TOWN CODE?~HAPTER 268' A letter dated July 17, 2009 from Mark Terry, Town LWRP Coordinator,
addressing the variances requested, made the recommendation that the proposed action is CONSISTENT with
the Policy Standards and therefore is CONSISTENT with the LWRP provided that the following
recommendations to fr]!rther the below listed policies are implemented.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem.

E. Maintain buffers to,ensure that adverse effects of adjacent or nearby development are avoided:
1. Maintain buffers to ~chieve a high filtration efficiency of surface runoff·
2. Avoid permanent o( unnecessary disturbance within buffer areas.
3. Maintain existing indigenous vegetation within buffer areas.
The LWRP Coordinator also recommends that a perpetual, natural buffer be required to protect Long Creek.
The Board agrees with these recommendations.
FINDINGS OF FACT
The Zoning Board of ~ppeals held a public headng on this application on July 30, 2009 at which time written and
oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property,
and other evidence, thee Zoning Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicant proposes to construct a new deck addition to an
existing dwelling as s.~own on the site plan prepared by Diana DeLucia and Albert Leutwyler dated January
2008. The proposed new deck addition will require a Front Yard setback variance and a Rear Yard setback
variance. ~
ADDITIONAL INFORMATION The applicant has acquired a NYSDEC permit for the proposed new deck
addition. The NYSDE¢ permit is requiring multiple conditions and obligations, one of which is the installation of
dry wells and french drains. The NYSDEC permit is also requiring the incorporation of a restrictive covenant to
the property deed whi~;h shall restdct any fudher development to the property on the seaward side (Long Creek)
of the existing dwelling.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal
inspections, the Boar~makes the following findings:
1. Town Law .~267-b(3)lb)(3),~1). Grant of the variance will not produce an undesirable change in the character
of the neighborhood ~i: a detr ment to nearby properties. This lot has 153 feet of frontage along a private right-
of-way. The home ~ centered on the property, and based on the code definition, the Building InspectOr
etermmed the front y?rd is the yard adjacent to the right-of-way, and the rear yard at the opposite or northerly
side of the home. HoWever on this property, the waterside is the applicant's usable back yard, and the technical
rear yard by code definition appears to be a side yard. The styte of the proposed deck is similar to what exists
in the neighborhood. ~he area is heavily treed and the existing dwelling would shield most of the view of the
proposed new deck a~ition from adjoining property owners.

· Town Law .~267-b13)lb),~2). The benefit sought by the applicant cannot be achieved by some method,
feasible for the applicant to Pursue, other than an area variance. The existing dwelling with its existing two
entry/exit locations make the location of the proposed new deck addition the most functional and practical. With
respect to the Front ,Yard setback variance, the applicant could redesign the proposed deck to eliminate the
location which is re~idng a Front Yard setback variance. With regard to the rear yard setback vadance
requested, the existin{] dwelling is already within a rear yard setback limit, and any protrusion from the existing
dwelling at this location.:: such as a deck addition or any structure will require an area variance.

3. Town Law .~267-b13)(b)(3). The Front Yard setback variance requested is 10% which is not substantial. The
rear yard setback variance requested is 54% which is substantial.
4. Town Law .6267-bi3)(b)(5). The difficulty has been self-created with respect to the requirement of a Front
Yard variance, because the applicant could redesign the proposed deck to not require a Front Yard variance.
The difficulty has not:been self- created with respect to the requirement of a Rear Yard vadance because the
dwelling exists in its p~esent location.
5. Town Law .~267-bi3)(b)(4). No evidence has been submitted to suggest that a vadance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood.
6. Town Law §267-b. Grant of the relief requested is the minimum action necessary and adequate to enable the
applicant to enjoy the!benefit of his property, while preserving and protecting the character of the neighborhood
and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law ~67-B, motion was offered by Member Schneider, seconded by Member Goehringer, and
duly carried, to ~'
GRANT the v~idances as applied for, as shown on the site plan prepared by Diana DeLucia and Albert
Leutwyler dat~d January 2008 (date stamped Mar 27 2009 by ZBA) and elevation drawing dated
3/24/09.
Any deviation from the;variance given such as extensions, or demolitions which are not shown on the applicant's
diagrams or survey si~ maps, are not authorized under this application when involving nonconformities under
the zoning code. Thi~'~ act on does not authorize or condone any current or future use, setback or other feature
of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as
are expressly addressed in this action.
The Board reserves th'~ dght to substitute a similar design that is de minimis in nature for an alteration that does
not increase the degre~e of nonconformity.
