WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being
at or near Peconic, in the Town of Southold, County of Suffolk and
State of New York, known and designated as part of Lot "E" as laid out on a certain
map entitlel "Map of Indian Neck Park, George W. Smith, owner, Scale 1 inch to 80
feet, Franklin F. Overton, M.E. , surveyor, 1912" and filed in the Suffolk County
Clerk' s office on 27, May 1913, as Map No. 551, which said part of lot is more
particularly bounded and described as follows:
BEGINNING at a point on the easterly side of a 33 foot Private Road on said
filed map distant 1672 .11 feet, more or less, from the southerly side of Indian Neck
Road, which said beginning point is also where the southerly line of land conveyed
or about to be conveyed to Linda B. _Gemmill intersects the easterly side of the
33 foot Private Road;
RUNNING THENCE north 491 31' 16" east along the southerly line of said land
conveyed or about to be conveyed to Linda B. Gemmill 68 .60 feet to the westerly line
of Lot "D" according to said map;
RUNNING THENCE south 401 28' 44" east along said lot line 352 .0 feet to the
present ordinary high water mark of Peconic Bay;
RUNNING; THENCE south 291 50' west along the present ordiaary high water mark
of Peconic Bay, 81.45 feet to the easterly side of the aforementioned 33 foot
Private Road or the prolongation southerly of its easterly. line;
RUNNING THENCE north 39' 28' 12" west along said Private Road, 377. 0 feet;
RUNNING THENCE north 101 23' west along said Private Road 2. 89 feet to the
point or place of BEGINNING.
TOGETHER with a Right of Way in common with others of the one-rod road laid
out on said map adjoining said Lot "E" to and from the Private Road two rods wide
laid out on said map which extends from Indian Neck Road to Peconic Bay, also
together with a Right of Way over said Private Road two rods wide from Indian Neck
Road to Peconic Bay.
BEING the same premises conveyed to Donald Sonnenborn and Vivian Sonnenborn,
his wife, by Eben T. Walker, by Bargain and Sale Deed dated November 12, 1987, and
recorded in the Suffolk County Clerk's Office November 19, 1987 in Liber 10474, Page
249.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part,the heirs or successors and assigns of the party of the second part
foreARJ the party of the first part covenants that the
party of the first part has not
done or suffered anything whereby the said premises have been incumbered in any way
whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration as
a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first
to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
