waiver/accessory apartment/bed and breakfast requests as Type II Actions and not subject
to environmental review pursuant to State Environmental Quality Review (SEQR) 6

an application for building permit for additions and alterations to an existing dwelling at: (1) a
nonconforming building containing a conforming use shall not be enlarged, reconstmcted or
stmcturally altered or moved, provided such action does not create any new nonconformance or
increase the degree of nonconformance, Pursuant to the interpretation of Walz (5039) such
alterations will thus constitute an increase in the degree of nonconformance: (a) less than the
minimum side yard setback of 10 feet, (b) less than the minimum combined side yard setbacks of
