second part,
WITNESSETH, that the party of the first part, in consideration of TEN and 00/100 ................

bounded and described as follows:
BEGINNING at a point on the westerly side of Bay Avenue which point is North 18 degrees
56 minutes 30 seconds West 114.45 feet measured along the westerly side of Bay Avenue
from a concrete monument set on the northeast corner of land now or formerly of Joseph
Boesch, and running thence South 71 degrees 00 minutes West 0.20 feet to a concrete
monument; thence continuing the same course South 71 degrees 00 minutes West 494.7
feet along land now or formerly of Gertrude E. Koop to a concrete monument and land now or
formerly of Robert Diesenberg and wife; thence running along said land North 21 degrees 03
minutes West 75.04 feet to a concrete monument and land now or formerly of Juds0n and
Mary Lincoln; thence running along said land North 71 degrees 00 minutes East 497.40 feet
to the westerly side of Bay Avenue; thence running southeasterly along Bay Avenue 75 feet
to the point of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated 5/12/94, recorded in Liber 11677, page 065 in the office of the Suffolk County
Clerk on 5/17/94.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances and all the estate and rights of the party of the first part
in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, the heirs or successors and assigns of the party of the second part
forever.
AND the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever,
except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying
the cost of the improvement and will apply the same first to the payment of the cost of the
~mprovement before using any part of the total of the same for any other purpose. The word
"party" shall be construed as if it read "padies" whenever the sense of this indenture so
requires.
