BARGAIN AND SALE DEED with Covenant against Grantor's Acts

party of the first part and"
CHRISTIAN TULLY and JEANETTE TULLY, as husband and wife, residing
at 3663 Smith Street, Wantagh, NY 11793, party of the second part
WlTNESSETH, that the party of the first part in consideration of ten dollars and
other valuable consideration paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party
of the second part, forever,
ALL that certain plot, piece or parcel of land, with the buildings and
improvements thereon erected, situate, lying and being in the
(see attached schedule "A").
Grantors being the same persons as the Grantees by a certain deed dated April 30,
2002 and recorded on July 24, 2002 in Liber 12199 page 130 and being and intended to
be the same premises conveyed therein.
TOGETHER with all right, title and interest, if any, of the party of the first part
of, in and to any streets and roads abutting the above described premises to the cehter
lines thereof; TOGETHER with the appurtenances and all the estate and rights of the
party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the
party of the second part forever.
AND the party of the first part covenants that the party of the first part has not
done or suffered anything whereby the said premises have been encumbered in any way
whatsoever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law,
covenants that the party of the first part will receive the consideration for this conveyance
and will hold the right to receive such consideration as a trust fund to be applied first for
the purpose of paying the cost of the improvement and will apply same first to the
payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of
this indenture so requires.

being near the Village of Greenport, Town of Southold, County of
Suffolk, and State of New York, known and designated as Lot Number
145 on a certain map entitled, "Map of Eastern Shore, Section 5",
filed in the Office of the Clerk of the County of Suffolk on
December 31, 1968, as Map No. 5234; said lot being more
particularly bounded and described as follows:
BEGINNING at a point on the Easterly side of Green Hill Lane
distant 345 feet Northerly. from the corner formed by the
intersection of the Easterly side of Green Hill Lane and the
Northerly side of Homestead Way; said point also being where the
Easterly side of Green Hill Lane is intersected by the division
line between Lots 145 and 146 on the above mentioned map;
RUNNING THENCE along the Easterly side of Green Hill Lane North 20
degrees 57 minutes 50 seconds West, a distance of 109.40 feet to
the division line between Lots 144 and 145 on the above mentioned
map;
THENCE Easterly along said division line between Lots 144 and 145
on the above mentioned map the following two (2) courses and
distances:
(1) North 69 degrees 02 minutes 10 seconds East, a distance of
127.94 feet;
(2) North 69 degrees 06 minutes 00 seconds East, a distance of
125.70 feet;
THENCE South 14 degrees 43 minutes 20 seconds East, a distance of

above mentioned map;
