Most of the planned exterior work on the building is already completed. The Commission approves what has been done and grants its approval for the completion of the project as outlined by the owner. However, the Commission is distressed that a project of the magnitude undertaken by Rona Smith on an historic building is Southold could have gone on for so long before it was noticed and reviewed by the proper authorities. Some renovation was undertaken over the yeazs, but most maintenance was piecemeal, at best. By the time the house was purchased by the Smiths in 2001 fitom a member of the original Dorman family, it had suffered serious neglect for yeazs. In fact, at the time, several prospective buyers sought to have it demolished. The Smiths wanted to preserve this beautiful house from another era. To do so the primary concerns were health, safety and comfort. To that end, all previous plumbing pipes and equipment as well as all electrical wiring had to be 100% replaced. Doing so resulted in improved safety and longevity. A fizlly insulated house with an efficient heating system was cleazly necessary for comfort in this house, located on a hill above Long Island Sound with its potent northeast winds. The Need for the Variance Southold Town inspected the house subsequent to the updating of the house. At that time, it was noted that the attic level had been plumbed, wired, insulated and sheet rocked. This `fmishing work' was stated to cause a violation in the number of stories by New York State law. That issue is the subject of this variance request. However, note that neither the number of floors nor the overall height of the house has changed by even one inch. As the enclosed photos and drawings attest, (see exhibits# 4-14) most significant changes to the house occurred around 1921, when a wing was added to the house and dormers appear at the attic level. The two certificates of occupancy, from the eazly 1990s, (see exhibits 2 and 3}that we were given by the previous owner indicate no major changes at that time. They do, however, show that the Building Inspector did not view the third floor on either visit. Note, on exhibit #2 that the number of rooms, counted on the first and second floors is left blank at the third floor space on the form. Exhibit#1 S is an affidavit from our attorney in the purchase of the house, Richazd Lark. Mr. Lark, speaking with the Building Inspector, noted that the inspector remembers nothing of the third floor. Further, in exhibit #15, Mr. Lazk also discusses what he, along with our engineer John Condon, remember seeing in the attic on their first visit: bedrooms and a bathroom, indicating living quarters. Exhibit #16 is an affidavit from a member of the Dorman family currently residing elsewhere in Orient. She details her recollection of the attic as a sleeping azea complete with bathroom in previous yeazs. The following description of our improvements to the house includes a description of what has been done and why. We believe that the house, in essentially the same functional usage as it has had for 100 yeazs should be able to remain as is. In fact, I looking at exhibit #4, a photo taken in 1909 is striking in how much it resembles the house as it Looks today. Looking at exhibit#5, a photo from circa 1925, the house looks much as it looks in exhibit#13, a photo taken in 2008. The Renovation process The challenge in improving analmost-] 00 year old house was in maintaining its visual authenticity while updating for safety and comfort. Wherever possible, interior walls were left intact and wires and pipes were snaked through walls and insulation was blown in. In the process of adding insulation and heating, new sheetrock was applied to walls too damaged by age, water penetration or termites to remain. Many of the original walls and ceilings were retained. The full weatherization was undertaken throughout the house as both attic and basement, open to the rest of the house, had to be weather proofed to prevent wasteful heat loss from primazy living azeas. However, the house was functionally zoned into seven separate azeas so that minimally used azeas, such as the attic, could be kept at minimal temperature settings. All areas of the house were also fitted with heat and cold sensors as well as CO detectors. Again, this was primarily for environmental safety and to protect the house from fire anywhere under the roof. These wired-in temperature sensors, monitored at a remote location aze known to be more effective at fire detection than battery operated smoke detectors. The outside monitoring service also guarantees protection even when no one is at home. At the attic level, used primarily by household servants filly to a hundred yeazs ago, there was little light and air from narrow windows and small dormers. There were originally 4 tiny bedrooms and one bathroom in the attic (See Exhibits #IS and #16). All the spaces had tiny windows. No change at all was made to the existing roof height. The non- functioning bathroom fixtures were replaced in the pre-existing space, the four tiny bedrooms became two lazge rooms and both the windows and the dormers on that floor were enlazged to bring more natural light and air to the attic. In addition, one new dormer was added directly above the stairwell to the attic to avoid head bumping and allow storage at the attic level. These three dormers can be seen on exhibit#9, showing the current South elevation of the house. Exhibit# 10 shows the two replacement dormers on the north side of the house. Since the original house remains, as built in 1908 w7th a 1921 addition, we think it must stay as it is. The only possible `increase' of internal space involves the replacement of the original dormers with enlazged dormers, housing lazger windows. While the enlazged dormers bring more light and air to the attic space, they do not enlazge the floor area of the space. The preponderance of the changes made in 2001 to the original 1908-1921 house were made with either environmental or safety concerns. By insulating the entire house, including the attic, a more energy efficient house results. Insulation and energy efficiency were not important originally as this was previous exclusively used as a 2 summer residence. By re-wiring the house, the danger of fire, the scourge of old houses, is greatly reduced. By re-plumbing the house, the danger of illness resulting from the content of older plumbing lines is likewise reduced. Insulating and creating heating zones achieved more energy efficiency. One would assume that these goals would be supported as a conscientious way to preserve an old house for fixture generations. The house remains as built with replacement of rotting elements and obsolete systems. " We have changed neither the house's footprint nor its height and therefore, as a pre- existing structure, our house should be left as is to continue to age gracefully. There were windows in all of the rooms and the windows themselves contained storm windows and screens. It was clear to both myself and Mr. Condon that this third floor had been used as habitable space in conjunction with the rest of the residence. Mrs. Smith indicated to me II that she had been making on going repairs to the house pursuant to the recommendations of Mr. Condon. After telephoning the Building Department and talking to a Mr. Bruno Seaman, I was able to determine the majority of the problem revolved around the third floor and whether it was habitable space or not. I ~ arranged a meeting with the Building Department and Mr. Condon ~~at the site on October 10, 2001. At the site, four Building Inspectors attended, one of which was Gary Fish, who had issued the previous Certificates of Occupancy. When Mr. Fish and I went to the third floor, Mr. Fish claimed a bathroom had been installed and there wasn't one there before. I informed him, yes indeed the fixtures in the bathroom had been changed and modernized in the same general locations as existed before. I also informed him I personally knew the bathroom was previously 2 ~r ~ ..r i~ there as I had seen it on August 24, 2000 when I was with I don during his building inspection. Mr. Condon also Mr. Con confirmed it and confirmed there had been no structural changes to the rooms and the third floor was pretty much as he remembered it with the exception it had been cleaned up, sheet rock and insulation had been installed, plumbing and fixtures modernized. I also informed Mr. Fish the Dorman Family had indicated to me that this had been used for living quarters in the early days for servants and subsequently for guests of the Dorman Family. y, Mr. Fish and I entered into a discussion and he said he couldn't remember the third floor at all, and in particular the bathroom. When I pointed out that he had done a housing inspection in 1993 and he had mentioned that the premises had 4 bathrooms, he indicated he just did not recall anything at all ~i on the third floor, and he probably did not inspect the thin ~I' floor, and that is why he hadn't mentioned anything in the housing report. The building that is the subject of this petition is properly classified as a Group Al (one-family dwelling) occupancy, three stories in height, of Type 58 (wood frame -unprotected) construction. 2. The third story contains one finished room, a bathroom, and a finished storage room. According to the petitioner, the finished room is not being used as a bedroom. 3. The subject building has undergone additions and alterations without the benefit of building permits. As part of the construction, two small eyebrow-type dormers located on the front, or south side, of the building, on the room area above the second story, were removed and replaced with larger doghouse-type dormers, each containing two double-hung windows. A third dormer, of the same type, was added to the same side, centered between the other two dormers. In addition, two new dormers, similar to those on the front, were constructed on the rear, or north side, of the building. 4. Architectural drawing were submitted with the petition that depicted the new dormers. However, it should be noted that the dormers constructed are much wider than those shown on the drawings. 5. Because of the increased size of the dormers, and the addition of the three other dormers, the floor area of the third story was increased and made more usable. It should be noted that the finished attic meets all requirements for a story, and is regulated as such. 6. The petitioner stated that the third story has existed for a number of years, and at the time of purchase, there were four small bedrooms and a bathroom on that story. 7. At the present time, two large rooms have been constructed at each end of the third story, and the bathroom has been totally reconstructed. 8. The stairway from the second story to the third story appears to be original. Because the stairway is located at the front of the building, the landing area and some of the steps are under the sloping roof. In these areas, the headroom is severely limited at the wall. The height is as low as approximately 2 feet 6 inches, and at the highest point, is only 4 feet 6 inches. A person must duck down when using the stairs in this area. The new dormer that was constructed over this only alleviates the deficiency for about one-half the width of the stairway and landing. 9. Section 705.2(c), a 1.999 amendment to the Title 9 NYCRR Uniform Fire Prevention and Building Code (Uniform Code), permitted buildings of type 5A (wood frame -protected) construction to have a maximum height of three stories above a basement or cellar, or above finished grade ~ Petition tJp. 2002-0988 Page 3 where there is no basement or cellar, when equipped throughout with an automatic sprinkler system installed in accordance with NFPA 13D - Installation of Sprinkler Systems in One-and Two-Family Dwellings and Mobile Homes (Reference Standard RS-57-7). 10. The Town of Southold permits atwo-and-a half story single family dwelling, but not a three story dwelling. The owners may be required to apply to the Southold Board of Zoning Appeals to allow the third story. 11. Before the Uniform Code was amended in to allow three story Gtoup Al dwellings of Type 5A construction with the installation of an automatic sprinkler system, Boards of Review often granted variances for Group Al dwellings of Type SB construction three stories in height with the conditions that interconnected smoke detecting alarm devices be installed throughout the dwelling, that a limited area automatic sprinkler system be installed on the third story and in the path of exit travel from the third story to the front exit door, and with a noncombustible exterior ladder from an opening for emergency use provided from the third story. 12. Because the third and second stories are finished, the petitioner argues that it would be economically and physically impractical to install a sprinkler system throughout the house. 13. The house has a private water supply (well). It does not have a public water supply, and the well may not provide adequate pressure to support a sprinkler system. 14. Since the adjournment of the June 10, 2009, hearing at the Board's request, an estimate for the cost to install a limited area automatic sprinkler system has been submitted as part of the variance petition. The estimate alone is $26,000. The estimate for the repairs and restoration necessary after installing the system is between $8,000 to $15,000. 15. Appendix J Section AJ604.3 of the 2007 Residential Code of New York State allows that a third story above grade to be created in an existing attic without requiring the installation of a sprinkler system throughout the entire dwelling, provided all of the following conditions are met: 1. The building was legally occupied before January 1, 1984. 2. The finished space and its means of egress to the exterior are equipped with a limited area sprinkler system installed in accordance with NFPA 13D. 3. The finished space is provided with: 3.1 A second exit stair meeting the requirements of Section R311.5, or 3.2 An emergency escape and rescue opening, meeting the requirements of Section R310, located directly above a roof or other structural appurtenance from 1 w Petition No. 2002-0988 Page 4 which access to grade does not exceed a vertical distance of 14 feet. 4. The entire dwelling is equipped with smoke alarms in compliance with Section R313 and monitored by an approved supervising station in accordance with NFPA 72. 16. The petitioners have stated that they believe that the third story is preexisting and nonconforming, and not subject to any further Code requirements. However, by the addition of the dormers, additional square footage was added, therefore triggering Code requirements. 17. It is unclear whether the dormer windows are large enough to meet the minimum clear opening dimensions for openings for emergency use as required by 9 NYCRR 714.1(c) of the Uniform Code. Furthermore, the windows located on the gable ends of the building, which are larger, appear to be more that 14 feet above grade. 18. The Residential Code of New York State, effective January 1, 2003, allows the construction of buildings having a height of three stories when equipped throughout with an automatic sprinkler system installed in accordance with NFPA 13D. 19. It is unclear if the building has interconnected smoke alarms. 20. The petitioners are not wiling to install either a full or a limited area automatic sprinkler system. 21. At this time there is no certificate of occupancy for the building. 22. It should be noted that Section 1205.4 of Title 19 (NYCRR) Chapter XXXII -Division of Code Enforcement and Administration Part 1205 -Uniform Code: Variance Procedures, stipulates, in part, that each regional board of review shall have the power to vary or modify, in whole or in part. any provision or requirement of the Uniform Code in cases where strict compliance with such provision or requirement would entail practical difficulties or unnecessary hardship or would otherwise be unwarranted; provided, however, that any such variance or modification shall not substantially adversely affect provisions for health, safety. and security and that equally safe and proper alternatives may 6e prescribed." CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would create an excessive and unreasonable economic burden. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 705.2(c), ~ ! ~ Petition No. 2002-0988 Page 5 and 9 NYCRR 713.1(e), be and are hereby GRANTED with the following condition: 1. That the third story may not be used for sleeping purposes.
