A message was left with our office yesterday-that you have-indicated
you may-wish to continue with.a proposal for a subdivision based
upon the new zoning designation for your property at the northerly
end of Water'view. Drive; Southold~
Since the ~preparation of the sketch revised in November 1986. the
zoning and subdivision regulations have been modified substantially.
It is suggested that you m&et at the Planning Board Office with Bob
Kassner. Site Plan Reviewer. or Melissa Spiro. Planner. in order to
obtain suggestions .as to the number of lots permitted on. the entire
6.8 acres and whether or not they would,consider a cluster
division. It may be possible that a new layout would be preferable.

The filing fee paid by you in 1986 for a variance would be refunded

Dear Mrs. Mooney:
As you may be aware, the premises which is the subject of
the above application before the Board of Appeals has been
redesignated on the newly adopted Master Plan Zoning Update.
When your application was filed with this office, the
previous Zoning Code was in effect. Since all files will be
required to be updated based on the new Zoning Plan, the new
provisions of the Code must be used. The same provision under
the new Zoning Plan for this new zone district according to our
records is shown to be:
R-40 Zone District
Minimum Lot Area Requirement: 40,000 sq. ft. per lot
Minimum Lot Width Requirement: 150 feet
Minimum Lot Depth Requirement: 175 feet
all as per Bulk Schedule, Article IIIA, Section
100-32A.
Please check one of the following two choices, sign and
return a copy of this letter as early as possible:

Dear Mr. Goehringer:
I hope I am addressing this letter to the correct individual. I
am writing re - Appeal # 3589 dated 12/1/86 (copy enclosed). As a
taxpayer of the lovely town of Southold, I would like to let you
know that my husband and I are writing to ask that you please continue
to reject application of owner of property at 1475 Waterview Drive,
Southold. We concur with the Building Inspector's "Notice of
Disapproval" issued on November 28, 1986.
I would like to mention that property owner's statement about Goose
Bay Estates (underlined) does not apply, as houses in Goose Bay
were built before the new law went into effect and many of those
homes are just that - summer bungalows.
As I was driving home today, I heard on the radio that the "red tide"
is again prevalent in the East End waters this year. Whatever the
reason - pollution or ?? it is a very sad fact. When we first went
exploring the North Fork, my "close-to-the-city" family was thrilled
at seeing scallops bubbling up and down in the Bay. For the past few
years, not only have the fishermen had a terrible time of it, but
we've been so disappointed at not seeing this beauty of nature.
Please don't let progress, or whatever it is called, let anything
happen to change Southold. Passing of the building law was
such an intelligent thing to do. I'm sure the property owner in
question will have no trouble selling her property -- "according to
law", at a very lucrative price.

Re: Petition of Mary J. Mooney-Getoff of 1475 Waterview Drive,
Southold for a variance to the zoning ordinance to sub-
divide a 2.4 acre parcel on Cedar Avenue (part of th~6.75
acre parcel for which 1475 Waterview Drive is the address)
into 4 lots of approximately 26,500 sq. ft. each.
We oppose the reqm~est for the following reasons2
1. After thorough study by appropriate town authorities
and consultants, this area of Southold has been desig-
nated as 2 acre zoning. This decision was no,made
capriciously but after proper investigation o~land use,
density, water requirements, and many other factors.
It would be improper to over-ride the judgement of this
body.
2. Down-zoning the property will lead to similar demands
from adjacent and nearby property owners who have land
to develop and will result in dense housing on 1/2 acre
plots6this ecologically sensitive area. In fact, the
applicant owns 4.4 additional acres extending to and
including much waterfront on Goose Bay which ~ould, of
course, be similarly sub-divided, once precedence has been
set.

3. The property in question lies adjacent to and up-
hill from mine. Since one could expect 4 houses
to be erected on 4 lots, the result would be 4
more wellst 4 more septic tankst 4 more paved areas,
all of which may have deleterious drainage effects
on my property, and one could also expect increased
use of fertilizers and pesticides on lawns and gar-
dens- which would also drain toward my property.
Moreover~ one could expect four two-story houses
to be built uphill in ascending fashion, resulting
in visual pollution and obstruction to sky and land-
scape.
4. Although "hardship" is the grounds on which the
variance is sought, I do not believe "hardship"
exists. The explanation for"hardship" is the diff-
erence between the sum of money which could be
acquired for four 0.6 plots as compared to that for
2.4 acres. Since the value of the latter alone
is substantial (probably in excess of $100,000)
this cannot be considered hardship. Moreover the
value of the remainin~ 4.4 acres could be conserve-
vatively estimated at ~00,000. This does not con-
stitute hardship.
I hope that you will not grant this variance.

I haVe received your letter of December 15 requesting
clarification es to the number and ~ize od the lots proposed
in the variance I am requesting.
As indicated on the survey which accompanied my application,
the 2.4 acre parcel to be set off would be divided into 4
lots of approximately 26~500 square feet each.
There would be ~ 50 foot right of way running north from
Cedar Avenue. Two of the lots border on Cedar Avenue; the
other two are north of those.
Each lot varies slightly in size and shape as there ia °nly
one absolutely square corner on the parcel but the # lots are
carved out of the 2.4 acres as equitably as possible.
If any further clarification is needed, kindly let'me know.
Thank you for your assistance.
P.S. In regard to (c), I do not have input or comments from
the planning Board to forward to you. I explained to Linda
Kowalski that I was financially unable to pay the fee for 4
lots required to submit an application simultaneously to the
Planning Board. As the fees are not refundable if the request
is denied, it is too much money to gamble if the ZBA denies
my request. Mrs. Kowalski was going to explain my problem to
the ZBA in this regard.

Dear Sir:
Although I can understand Mrs. Mooney-Getoff's hardship, I cannot
see how the Board of Appeals can grant a variance to permit the construction
of four homes in lieu of one.
Over the past few years, town consultants made a complete study of
the area and decided to up-zone to two acre plots. One of the reasons
they picked in their study to up-zone was I am sure our water problems.
There is no cormmunity water that services our homes. We all have private
wells that now provide good clean water. With four new homes, and the
possibility of another seven homes that could be built to the south of Mrs.
Mooney-Getoff's vacant land if the variance is granted will our water be
as clean?
What do they plan to do with the sewerage - pump it into the ground
which may cause all sorts of problems to our wells? Think about the additional
traffic that these four new homes and then a possible seven additional homes
would generate. You must realize that if this variance is granted you cannot
stop the subdivision of the rest of Mrs. Mooney-Getoff's land in the same way.
I ask you to think of the precedent you will set if this application
is granted and the money spent over the years for the zoning study. I see
no unusual and peculiar conditions that permit you to grant this appliction
and I believe it will be detrimental and will alter the essential character
of the neighborhood.

Southold Town Board of Appeals -9- November 29, 1973
After investigation and inspection the Board finds
that applicant requests permission to erect a bus shelter
in front yard area of property on the northeast side of
Waterview Drive, Southold. The findings of the Board
are that applicant resides in a wooded area and his children
have a few hundred feet to get to the school bus. The
applicant wishes to have the children sheltered from
bad weather while waiting for the bus.
The Board finds that strict application of the
Ordinance would produce practical difficulties or
unnecessary hardship; the hardship created is unique
and would not be shared by all properties alike in the
immediate vicinity of this property and in the same use
district; and the variance will not change the character
of the neighborhood, and will observe the spirit of the
Ordinance.
On motion by Mr. Grigonis, seconded by Mr. Hulse, it was
RESOLVED, Louis Getoff, Waterview Drive, Southold, be
GRANTED permission to erect a bus shelter in front yard
area of property located on the northeast side of Waterview
Drive, Southold, as applied for, subject to the following
conditions:
That the shelter be placed at least 5 feet from
any property line on the north side of Waterview
Drive.
It is further understood that this is a temporary
permission subject to being rescinded at any time
in the future.
Vote of the Board: Ayes:- Messrs: Gillispie, Bergen
Grigonis, Hulse.
PUBLIC HEARING: Appeal No. 1855 - 8:45 P.M. (E.S.T.),
upon application of Stanley Garren, Nakomis Road, Southold,
