THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION WAS ADOPTED BY THE
SOUTHOLD TOWN BOARD AT A REGULAR MEETING HELD ON NOVEMBER 27. 1990:
RESOLVED that the Town Board of the Town of Southold hereby authorizes
a refund of $150.00 to Henry B. Faucon, which sum represents the filing
fee for a variance application to the Board of Appeals which was filed on
October 15, 1990, and was determined to be unnecessary following actual
measurements of the property line and adjacent property, all in accordance
with the recommendation of the Board of Appeals.

Appeal Application No. 3982 - Faucon
It is recommended that the $150.00 filing fee be refunded
concerning the variance filed on October 15, 1990 by Mr. and
Mrs. Faucon. At the time of the filing the variance
application, Mr. and Mrs. Faucon were not able to verify the
setback of their adjoining house, which is the only house within
300 feet. Our office immediately contacted the builder, who
would be representing the Faucons in the variance application.
Our secretary asked Mr. Dohrman, the builder, to bring in the
measurements for established setbacks of house(s] within 300
feet (as per Section 100-230), and on October 31, 1990,
Mr. Dohrman and our secretary both met with the Building
Inspectors to ascertain whether a variance was needed since the
adjoining house was also the same front yard setback as that
proposed in the permit application. The Building Department
agreed to accept Mr. Dohrman's Affidavit with sketch as to the
established setback of existing house(s) within 300 feet
(Section 100-230), and the Notice of Disapproval was withdrawn.
It is our recommendation that the applicants be refunded their
$150.00 filing fee since if the above information was made
available prior to the issuance of the Notice of Disapproval,
no variance would have been necessary.

grounds of an assumed need for Zoning Board of Appeals approval.
October 15 - I filed a completed application with the Appeals
Board, delivering it and our personal check for $150.00 to the Town
Clerk, as instructed.
November ?, 1990 - Our Building Permit was issued, following
actual meassurement of and review of existing relationship to our
property line and adjacent property.
Because no Appeals Board hearing procedure was utilized, I have been
instructed to forward this written requemt to you for refund of the
$150.00 fee submitted on October 15, 1990~

2. The hordship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because the existing houSe
is smaller than most in the area and is occupied by the owners.
3. The /oriance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACJkR OF THE DISTRICT because other houses and businesses in the
immediate neighborhood are much closer to the roa~ than the house
in question will be after the addition

{IDAL WETLANDS:
(1) All lands generally covered or intermittently cov-
ered with, or which border on, tidal waters, or lands
lying beneath tidal waters, which at mean low tide
are covered by tidal waters to a maximum depth of
five (5) feet, including but not limited to banks,
bogs, salt marsh, swamps, meadows, fiats or other
low lying lands subject to tidal action;
(2)
All banks, bogs, meadows, fiats and tidal marsh
subject to such tides and upon which grows or may
grow some or any of the following:, salt hay, black
grass, saltworts, sea lavender, tall cordgrass, high
bush. cattails, groundsel, marshmallow and low
march cordgrass; and/or
(3)
All land immediately adjacent to a tidal wetland as
defined in Subsection A(2) and lying within seven-
ty-five (75) feet landward of the most landward
edge of such a tidal wetland.
