Five(5)copies of the revised cross section As discussed, the proposed minor modification is simply to construct a ramp on the existing walkway in order provide access to the new proposed dock. As you know, the original plans submitted did not accurately reflect the height of the existing walkway. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved,but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. Conformance With Plans All activities authorized by this permit must be in strict conformance with the approved plans submitted by the applicant or applicant's agent as part of the permit application. Such approved plans were prepared by KPC Planning dated 9/1/11. 5. Precautions Against Contamination of Waters All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants,epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. 6. Notice of Commencement At least 48 hours prior to commencement of theproject, the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion of project, the bottom portion of the form must also be signed and returned, along with photographs of the completed work. 7. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from construction of this project shall be completely removed from the adjacent area(upland) and renioved to anapproved upland area for disposal. No debris is permitted in wetlands and/or protected buffer areas. S. No Disturbance to Vegetated Tidal Wetlands There shall be no disturbance to vegetated tidal; wetlands or protected buffer areas as a result of the permitted activities. 9. StorageofEquipment,Materials The storage of construction equipment,and materials shall be confined to the upland area landward of the bulkhead or on a barge. 10. Dock, Catwalk Size Dock or catwalk shall not exceed 4 feet in width and shall be a minimum of 3.5 feet above grade (as measured from ground to bottom of dock/catwalk decking) over tidal wetland areas. 11. No Floats,Ramps in Vegetated Tidal Wetlands Floats and ramps may not rest on or be stored in any vegetated tidal wetland. 12. Float Installation The float shall be installed only at the approved location with a minimum water depth of 21/s feet,measured at apparent low tide. 13. Seasonal Ramp,Float The ramp and float may be removed and replaced seasonally at the permittee's discretion to prevent ice damage to the structure and damage to the tidal wetlands from ice and storm debris. The permittee will be responsible for restoring any tidal wetland areas'that are damaged by an�portion of the authorized structure that has not been removed for tho-winter season upon notification and written approval (permit, modification or amendment)from the Department. 14. No Prop Dredging Prop dredging, or the act of utilizing and/or directingthe propeller or propulsion system of a motorized vessel and/or the water-borne-forces created by said propeller or propulsion system, to excavate or displace existing bottom sediment and benthic habitat for the direct or indirect purpose of establishing or increasing water depth,is a regulated activity and is not authorized by this permit. Docks at Property Lines Docks/catwalks/floats must not: a. extend laterally beyond property lines, b. be placed so that docked boats extend laterally over adjacent property line, c. interfere with navigation, or d. interfere with other landowners riparian rights. 17. Pilings at Property Lines Pilings shall not: a. extend-laterally beyond property lines, b. beplaced so that docked boats extend laterally over property lines, c. Aterfere with navigation, or d. interfere with other landowners riparian rights. 18. No Structures on Pilings No structures,other than structures specifically authorized by this permit,shall be constructed on pilings without further authorization from the department(permit, modification or amendment). 19. Wood Preservatives A. Pressure treated wood used for construction of in-water structures must have been treated with a preservative and must have undergone a treatment process approved(stamped or otherwise marked as certified)by the American Wood Preservative Association. B. Wpod treated with Pentachlorophenol (PCP)must not be used in wetlands or surface waters. C. Thuse of creosote treated wood is prohibited both in the water and in the upland areas. D. Chromated-C*Wer Arsenate,�CCA pressure treated wood must be clean an&&ee ofCC-A surface deposits. Wood with surface desposits must be washed for at least five minutes under running water prior to use. (Note the following condition for the handling of wash water.) E. (My property also is known as 950 Broadwaters Drive.) I respectfully provide this letter to you in support in the above application by the owner of the adjacent property located at 1500 Mason Drive. The application is for the construction of a catwalk and dock. The property in question has been vacant for more than a decade. During that time,the property was allowed to deteriorate and become a neighborhood eyesore. Since its purchase by the new owner -- a family with significant ties to the Southold community --the entire property has been cleaned up and the house has been repainted and repaired inside and out. I have no doubt that it will continue to be improved over time. The dock that is proposed is modest in size and will serve as a convenient facility to keep a small boat. Improvements of this sort enhance not just the subject property but also the adjacent properties as well and certainly, in my view, it is only to the advantage of the Town to see significant upgrades to a property of this type. Moreover, the proposed dock is consistent with the other docks in the surrounding neighborhood. It will not impede navigation in any respect. The maximum size of the vessel is provided per the memorandum dated December 13, 2011 from LWRP Coordinator Mary Terry. 2. Seven(7) copies of the 2010 Aerial Photograph showing the length of the proposed dock, as well as the width of the waterway and navigation channel. With respect to the each of the issues raised by the LWRP Coordinator in the memorandum to the Trustees dated December 13, 2011,the following is offered for the Board's consideration: • The plan now references a vessel up to 40' in length. The length of the dock and vessel do not impede access through navigable waters. The total length is significantly less than the maximum size that is permitted pursuant to §275-11 of the Town Code, which limits the length of the dock to 1/3 of the total width of the water body. As illustrated on the 2010 Aerial Photograph, the proposed dock is not only significantly shorter than what may be permitted, it also significantly shorter than the dock to the west, which comes much closer to the navigable waters than the proposed dock. �A • To address the concern regarding the location of the property within a NYS Critical Environmental Area, it was recommended that a non-disturbance buffer be provided. As illustrated on the revised plan, the applicant is a proposing a 10'-wide buffer landward of the existing bulkhead that will be planted with American beachgrass. In addition, the plan also accounts for a substantial non-disturbance buffer of varying width that will be allowed to re-vegetate naturally. However, as previously discussed with the Board of Trustees, it is requested that the plan may be changed to a revised planting plan in connection with a future application for another permit on the property. • The proposed construction method will comply with all of the requirements pursuant to §275-11 of the Town Code. Further, a note has been added to the plan indicating that a silt boom will be installed that will retain sediments within the project area. • The proposed dock will not result in a net decrease in public access on public underwater lands. First, the subject property is privately owned and does not provide public access through the site to the water. Second, as illustrated on the 2010 Aerial Photograph, the proposed dock will not have any impacts to navigable waters. The dock length, including the vessel, is less than the maximum permitted pursuant to §275-11 of the Town Code as previously stated. Further, the proposed dock is much shorter than the existing dock to the west, which sits much closer to navigable waters than the subject dock. Accordingly, public access through this area of Haywater Cove will remain unobstructed as a result of the approval of this project. • The water depth within the dock terminus is 2.5'+ and therefore meets the minimum requirements of the NYSDEC, which has customarily been found adequate by the Town Trustees. • The applicant does not currently enjoy access to the public water body via an existing dock. First, the existing structure is a bulkhead, not a dock, and is not intended for the docking of a vessel. Second, the seaward most edge of the existing bulkhead does not reach an adequate water depth for the docking of a vessel that meets the minimum requirements of the NYSDEC. Given resolution of the clearing violation, as well as the submission of additional information herein that addresses the concerns raised by the Board of Trustees and the LW" Coordinator, it is respectfully requested this application be placed on the agenda for August 22, 2012, and that the Trustees approve the project as modified.
