PO Box 2124 Greenport, NY 11944 RE: ERIN 8~ MATTHEW CUNNINGHAM 2980 OLE JULE LANE, MATTITUCK SCTM# 122-4-17 Dear Ms. Costello: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wednesday, August 21, 2013: RESOLVED, that the Southold Town Board of Trustees APPROVE the Administrative Amendment to Wetland Permit #7941 to reduce the length of the dock structure by constructing a 4'x16' fixed catwalk with a 4'x20' fixed "T" section at the offshore end; and as depicted on the revised site plan prepared by Costello Marine Contracting Corp., last dated June 28, 2013 and stamped approved on August 21, 2013. Any other activity within 100' of the wetland boundary requires a permit from this office. This is not a determination from any other agency. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause umeasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. PO Box 2124 Greenport, NY 11944 RE: ERIN & MATTHEW CUNNINGHAM 2980 OLE JULE LANE, MATTITUCK SCTM# 122-4-17 Dear Ms. Costello: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, October 17, 2012 regarding the above matter: WHEREAS, Costello Marine Contracting Corp. on behalf of ERIN & MATTHEW CUNNINGHAM applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated August 22, 2012, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application to remove +/-34' of existing bulkhead and retaining wall and construct +/-34' of new bulkhead in-place; top of bulkhead to be level with existing adjacent bulkhead; construct 25' of core stone rock retainer; reconstruct a 4'x 8' wood deck; provide 10' wide non-turf buffer landward of the new bulkhead and core stone rock retainer be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the LWRP Coordinator recommended that the proposed application to construct a 4'x12' fixed catwalk; provide water and electric service to offshore end; install 1,850 Ib. boat davit; install a 32"x16' seasonal ramp onto a 6'x20' seasonal float secured by two 8" diameter anchor pilings be found Inconsistent with the LWRP, and, 2 WHEREAS, the Board of Trustees has furthered the Local Waterfront Revitalization Program policies 6, 6.3, 9 to the greatest extent possible through the imposition of the following Best Management Practice requirements: Navigation will not impeded since this is not the main channel; to relocate catwalk approximately 4' north in area disturbed; and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on August 22, 2012, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVES the application of ERIN 8~ MATTHEW CUNNINGHAM to remove +/-34' of existing bulkhead and retaining wall and construct +/-34' of new bulkhead in-place; top of bulkhead to be level with existing adjacent bulkhead; construct 25' of core stone rock retainer; construct a 4'x8' wood deck; provide a 10' wide non-turf buffer landward of the new bulkhead and core stone rock retainer; construct a 4'x12' fixed catwalk; provide water and electric service to offshore end; install 1,850 Ib. boat davit; install a 32"x16' seasonal ramp onto a 6'x20' seasonal float secured by two 8"diameter anchor pilings; and as depicted on the site plan prepared Costello Marine Contracting Corp., last dated October 18, 2012, and stamped approved on October 22, 2012. 3 • • Permit to construct and complete project will expire two years from the date the permit is signed. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction The applicant fails to prove that the action meets the following requirements § 275-11 Construction and operation standards of the Southold Town Code: 1. No dock shall be erected or extended if, in the opinion of the Trustees, such structure would adversely affect navigation, fisheries, shell fisheries, scenic quality, habitats or wetland areas. See below response. 2. Within creeks and other narrow waterways, no dock length shall exceed 1/3 the total width of the water body. Determination of the length of the dock must include the dimensions of the vessel. The dock structure has the ability to impede navigation of the channel. A sandbar occurs to the west of the dock making the navigable channel narrow The placement of a vessel at the dock terminus would further impede navigability The dimensions of a vessel have not been shown. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. The dock structure will extend into public water and result in a net decrease in public access to/on public underwater lands. It is recommended that alternative vessel mooring option is considered to accommodate a vessel.
