SPECIAL CONDITIONS
1. During construction, concrete or leachate shall not escape or be discharged, nor shall washings from transit mix
trucks, mixers, or other devices enter tidal wetlands and/or protected buffer areas.
2. Any debris or excess material from construction of this project shall be completely removed from the adjacent area
and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands or protected buffer areas.
3. There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted
activities.
4. All areas of soil disturbance resulting from the approved project shall be stabilized with appropriate vegetation
(grasses, etc.) immediately following project completion or prior to permit expiration, whichever comes first. If the
project site remains inactive for more than 48 hours or planting is impractical due to the season, then the area shall be
stabilized with straw or hay mulch or jute matting until weather conditions favor germination.
5. The storage of construction equipment and materials shall be confined within the project work area and/or upland
areas greater than 75 linear feet from the tidal wetland boundary.
6. All disturbed areas where soil will be temporarily exposed or stockpiled for longer than 48 hours shall be contained
by a continuous line of staked haybales / silt curtains (or other NYSDEC approved devices) placed on the seaward side
between the fill and the wetland or protected buffer area. Tarps are authorized to supplement these approved methods.
7. Cover material used for the footpath is limited to natural wood/bark chips, stone, gravel or sand.
8. The use of wood treated with pentachlorophenol or other wood treatment not specifically approved bythe Department
for use in wetlands and/or marine waters, is strictly prohibited in the construction of structures that will be in contact with
tidal waters.
9. This permit does not authorize the installation of floats.
10. The authorized structure is provided for access to the waterway and is not intended for the mooring or launching
of vessels. Prop dredging, resulting from motorized vessels intentionally powering in shallow waters, is a regulated
activity and is not authorized by this permit.
11. To protect the values of the tidal wetlands, a permanent vegetated buffer zone shall be established. There shall be
no disturbance to the natural vegetation or topography within an area extending 50 linear feet landward of the tidal
wetland boundary.
12. A row of staked haybales or other approved erosion control devices shall be placed as per the NYSDEC approved
plan, prior to commencement of any regulated activities and remain in place and in good, functional condition until the
project is completed and all disturbed areas are stabilized with vegetation.
13. Roof runoff shall be directed into dry wells a minimum of 75 linear feet landward of the tidal wetland boundary for
immediate on-site recharge.
14. Dry wells for pool filter backwash shall be located a minimum of 75 linear feet landward of the tidal wetland
boundary.
15. There shall be no draining of swimming pool water directly or indirectly in tidal wetlands or protected buffer areas.
16. Driveways and parking areas shall be constructed of NYSDEC approved pervious materials.
17. Roads, driveways and parking areas shall be graded to direct runoff away from tidal wetlands and protected buffer
areas.
18. Sanitary systems (bottom of the tank and leaching pools) shall be located a minimum of 2' above seasonal high
groundwater.
19. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top
portion of the enclosed notification form certifying that they are fully aware of, and understand all terms and conditions
of, this permit. Within 30 days of completion of project, the bottom portion of the form must also be signed and returned,
along with photographs of the completed work.

If future operations by the State of New York require an alteration in the position of the structure or work herein
authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable
obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people
of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the
Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense to the
State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of
the watercourse hereby authorized shall not be completed, the owners, shall, without expense to the State, and to
such extent and in such time and manner as the Department of Environmental Conservation may require, remove
all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood
capacity of the watercourse. No claim shall be made against the State of New York on account of any such removal
or alteration.
The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized
which may be caused by or result from future operations undertaken by the State for the conservation or
improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such
damage,
Al! necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids,
sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally
deleterious materials associated with the project.
Any material dredged in the conduct of the work herein permitted shall be removed evenly, without leaving large
refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause
damage to navigable channels or to the banks of a waterway.
There shall be no unreasonable interference with navigation by the work herein authorized.
If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the
applicant shall, without expense to the State, and to such extent and in such time and manner as the Department
of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore
the site to its former condition. No claim shall be made against the State of New York on account of any such
removal or alteration.
If granted under 6NYCRR Part 608, the NYS Department of Environmental Conservation hereby certifies that the
subject project will not contravene effluent limitations or other limitations or standards under Sections 301,302, 303,
306 and 307 of the Clean Water Act of 1977 (PL 95-217) provided that all of the conditions listed herein are met.
At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top
portion of the enclosed notification form certifying that they are fully aware of and understand all terms and
conditions of this permit. Within 30 days of completion of project, the bottom portion of the form must also be
signed and returned, along with photographs of the completed work and, if required, a survey.
At1 activities authorized by this permit must be in strict conformance with the approved plans submitted by the
applicant or his agent as part of the permit application.

NOTIFICATION OF OTHER PERMITTEE OBLIGATIONS
Item A: Permittee Accepts Legal Responsibility and Agrees to Indemnification
The permittee, excepting state or federal agencies, expressly agrees to indemnify and hold harmless the Department
of Environmental Conservation of the State of New York, its representatives, employees, and agents ("DEC")for all claims,
suits, actions, and damages, to the extent attributable to the permittee's acts or omissions in connection with the permittee's
undertaking of activities in connection with, or operation and maintenance of, the facility or facilities authorized by the permit
whether in compliance or not in compliance with the terms and conditions of the permit. This indemnification does not
extend to any claims, suits, actions, or damages to the extent attributable to DEC's own negligent or intentional acts or
omissions, or to any claims, suits, or actions naming the DEC and arising under article 78 of the New York Civil Practice
Laws and Rules or any citizen suit or civil rights provision under federal or state laws.
Item B: Permittee's Contractom to Comply with Permit
The permittee is responsible for informing its independent contractors, employees, agents and assigns of their
responsibility to comply with this permit, including all special conditions while acting as the permittee's agent with respect
to the permitted activities, and such persons shall be subject to the same sanctions for violations of the Environmental
Conservation Law as those prescribed for the permittee.
Item C: Permittee Responsible for Obtaining Other Required Permits
The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-way that may
be required to carry out the activities that are authorized by this permit.
Item D: No Right to Trespass or Interfere with Riparian Rights
This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of
others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or
personal property held or vested in a person not a party to the permit.
GENERAL CONDITIONS
General Condition 1: Facility Inspection by the Department
The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by an
authorized representative of the Department of Environmental Conservation (the Department) to determine whether the
permittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant to ECL
71-0301 and SAPA 401(3).
The permittee shall provide a person to accompany the Department's representative during an inspection to the permit
area when requested by the Department.
A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection
by the Department at all times at the project site or facility. Failure to produce a copy of the permit upon request by a
Department representative is a violation of this permit.
General Condition 2: Relationship of this Permit to Other Department Orders and Determinations
Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any
order or determination previously issued by the Department or any of the terms, conditions or requirements contained in
such order or determination.
General Condition 3: Applications for Permit Renewals or Modifications
The permittee must submit a separate written application to the Department for renewal, modification or transfer of this
permit. Such application must include any forms or supplemental information the Department requires. Any renewal,
modification or transfer granted by the Department must be in writing.
The permittee must submit a renewal application at least:
a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDE$), Hazardous
Waste Management Facilities (HWMF), major Air Pollution Control (APC) and Solid Waste Management
Facilities (SWMF); and
b) 30 days before expiration of all other permit types.
Submission of applications for permit renewal or modification are to be submitted to:

General Condition 4: Permit Modifications, Suspensions and Revocations by the Department
The Department reserves the dght to modify, suspend or revoke this permit in accordance with 6 NYCRR Part 621. The grounds
for modification, suspension or revocation include:

b) failure by the permittee to comply with any terms or conditions of the permit;
c) exceeding the scope of the project as described in the permit application;

How do SMART VENTS provide so much coverage?
You may have heard that FEMA requires a vent with I ]1 square inch of opening per 1 square foot
of enclosed area', i, referring to vent dimensions in proportion to the space to be vented. This is
only partially correct. FEMA guidelines (as outlined in Technical Bulletin 1-08! do state that a non-
engineered flood vent solution must (among other requirements) provide 1 sq. in. of opening per 1
sq. ft. of space vented. This is only in reference to non-engineered openings, however, all of our
flood vent products are certified engineered openings. In accordance with the further guidelines of
TB 1-08, our vents have been tested, rated, and certified for their coverage of 200 square feet per
unit by the International Code Council.
What is the International Code Council (ICC)?
The International Code Council, a membership association dedicated to building safety and fire
prevention, develops the codes used to construct residential and commemial buildings, including
homes and schools. Most U.S. cities, counties and states that adopt codes choose the
Intsmational Codes developed by the Intamational Code Council, Out of all product evaluation
services available, 80% of Code Officials prefer ICC Evaluated Products,

Are the vents more expensive than other flood solutions & do you know of any other
company that makes a similar product?
Our vents are made from stainless stael, and are manufactured and assembled entirely in the
United States. Additionally (and perhaps more importantly), each of our vents is an engineered
flood opening certified for 200 square feet of flood protection. It is physically impossible for a non-
engineered opening of comparable dimensions to provide as much coverage within FEMA
guidelines; most air vents, in fact, provide less than 20% of that (overlooking that they do not fulfill
other requirements of the flood code). Where a house may require 30-35 air vents to provide
enough flood protection, about 8 of our vents would provide more than necessary. Our vents are

cost-competitive with anything else we have seen on the market.
Do you know of any other company that makes a similar product? NO. There are certainly other
companies that make foundation vents, and some that claim that their vents are usable as
foundation flood vents, but our vents are (the last time we checked) the only FEMA Accepted &
ICC-ES evaluated engineered opening for flood venting. In fact. many of the vents that claim to be
foundation flood vents do not comply with flood ventilation codes and FEMA guidelines, let alone
having a certification,
How do the models differ? Do they come in custom sizes? What sizes do you have?
We have two pdmary models: The dual function model (~MART VENT) p~ovides 51 square
inches of air ventilation opening in addition to 200 square feet of certified flood ventilation
coverage. These vents would be almost exclusively used in unconditioned crawlapaces, where air
ventilation is required in addition to any flood ventilation. The insulated flood~nly model (FLOOD
VENT) is appropriate for most other applications. It provides only flood protection for garages,
living spaces, basements (though rare in floodplains), conditioned crawispaces, etc.
Our vents are the size of a standard concrete masonry unit (CMU), 16[] wide x 8 E/tall. They can
be stacked as many high* (although two is typical) and arrayed as many side-by-side as needed.
For large industrial and municipal projects, we have been able to fabricate custom mountings to
contain various arrangements of vents in a single steel frame. We also make a Wood Wall
FLOOD VENT that is designed to fit between wood studs spaced on 16 ~ centers that measures
Do they come in different colors?
Yes. We have four standard colors, and can (for an additional fee, plus an approximately three
week lead time) match almost any color needed for your application. We use enamel powder
coatings designed for use in harsh environments. Our standard colors are: black, gray, wheat and
white. Your SMART VENT, inc. regional sales representative should have sample paint chips and
prices available for each standard color. White vents are available direct from our stock with no
delay.
Can I install the vent in an entry door?
Yes. For overhead (garage) doors, we have developed a specific product that installs easily and
contains a mechanism to prevent the vent from opening when the door is lifted overhead. For
standard personnel doors, we recommend using the standard foundationN~ood wall vents. Simply
drill four holes into the flange, and ddve screws through these holes, into the door. Please be
careful only to drill the exterior flange, or you risk voiding the warranty.
My grade changes (slopes/dips), or my house is built on a hill. How do I place my vents?
Regardless of changes in grade, vents must be placed on a minimum of two different walls, with
each vent no more than twelve inches (or less, depending on local code) of adjacent grade or
inside slab. The adjacent grade for each vent is the grade (essentiafly, ground) level closest to
that specific vent. Vents should, if possible, be arranged so that more are placed near the lowest

T,he floor of my basement/crawlspace is lower than the adjacent ground level; what do I
do?
What you do is pay extremely high flood insurance premiums. According to FEMA guidelines in
Technical Bulletin 1 ~)8. if all four sides of the structure are below grade by even one inch, the
structure has a basement. In a flood zone. having a basement almost guarantees yep/high flood
insurance rates. To lower your premium, you need to equalize the interior and extedor grade on at
least one side of the house. The easiest way to do this is to either add fill to the inside of the
basement until at least one wall is at or above exterior grade, or to dig-out the ground outside until
it is at or below the intedor grade (floor) level. ThL~ will turn your basement into a crawlspace,
which (if propedy vented) should have drastically lower flood insurance rates.
How do the vents attach?
One can attach the vents using any of several methods. The vents were designed to install with
four stainless steel straps, included in each package. These straps bend around the back of a
wall, and fasten into the vent frame. The extedor flange holds the vent against the front of the wall.
If an even more secure hold is desired, a concrete adhesive (Lexel, Liquid Nails, etc.) can be
applied to the inside surface of the flange. Be careful to avoid getting any of this adhesive onto
any part of the frame but the back surface of this flange; you do not wa nt to accidentally prevent
the vent door from opening in case of flood.
Can animals open the vents?
A bear might be able, but not most creatures smafl enough to fit into the vent opening. With the
floats at rest within the frame, a minimum of ten to fifteen pounds of pressure are required to open
the vent door. When they first arrive, the vents might seem looser or easier to open; there is a
small amount of oil that naturally gets on the floats during the manufacturing process. Simply wipe
both the floats and their grooves within the frame with a rag wet with isopropyl alcohol. This
should remove the oil responsible for any perceived looseness.

2.0 USES
The Smart Vent® units are automatic foundation flood vents
(AFFVs) employed to equalize hydrostatic pressure on
nonfire-resistance-rated foundation walls, rolling-type
overhead doors and building walls subject to rising or failing
flood waters. Certain models also allow natural ventilation in
accordance with Section 1203 of the IBC or Section 408.1 of
the IRC.
3.0 DESCRIPTION
3.1 General:
When subjected to pressure from rising water, the Smart
Vent® AFFVs disengage, then pivot open to allow flow in
either direction to equalize water level and hydrostatic
pressure from one side of the foundation to the other. The
AFFV pivoting door is normally held in the closed position by
a buoyant release device. When subjected to rising water, the
buoyant release device causes the unit to unlatch, allowing
the plate to rotate out of the way and allow flow. The water
level stabilizes, equalizing the lateral forces. Each unit is
fabricated from stainless steel, and each opening provides 76
square inches (49 032 mm2) of net free area for flood
mitigation in the open position. The SmartVENTTM Stacking
Model #1540-511 and FloodVENTTM Stacking Model #1540-
521 units each contain two vertically arranged openings per
unit, providing 152 square inches (98 064 mm2) of net free
area for flood mitigation in the open position.
3.2 Engineered Opening:
The AFFVs comply with the design principle noted in Section
2.6.2.2 of ASCE/SE124 for a maxim um rate of rise and fall of
5.6 feet per hour (0.423 mm/s). In order to comply with the
engineered opening requirement ofASCE/SE124, Smart Vent
AFFVs must be installed in accordance with Section 4.0.
3.3 Model Sizes:
The FloodVENTTM Model #1540-520, SmartVENTTM Model
#1540-510, FloodVENTTM Overhead Door Model #1540-524,
and SmartVENTTM Overhead Door Model #1540-514 units
measure 153/4 inches wide by 73/4 inches high (400 by 196.9
mm). The Wood Wall Flood Model #1540-570 and Wood
Wall Flood Overhead Door Model #1540-574 units measure
14 inches wide by 83/4 inches high (355.6 by 222.25 mm). The
SmartVENTTM Stacking Model #1540-511 and FloodVENTTM
Stacking Model #1540-521 units measure 16 inches wide by
16 inches high (406.4 by 406.4 mm).
3.4 Ventilation:
The SmartVENT® Model #1540-510 and SmartVENT®
Overhead Door Model #1540-514 both have screen covers
with ~/4-inch-byJ/4-inch (6.35 by 6.35 mm) openings, yielding
51 square inches (32 903 mm2) of net free area to supply
natural ventilation. The SmartVENTTM Stacking Model #1540-
511 consists of two Model #1540-510 units in one assembly,
and provides 102 square inches (65 806 mm2) of net free
area to supply natural ventilation. Other AFFVs recognized in
this report do not offer natural ventilation.
4.0 INSTALLATION
SmartVENT® and FIoodVENTTM are designed to be installed
into walls or overhead doors of existing or new construction
from the exterior side. Installation of the vents must be in
accordance with the manufacturer's instructions, the
applicable code and this report. The mounting straps allow
mounting in wood, masonry and concrete walls up to 12
inches (305 mm) thick. In order to comply with the engineered
opening design principle noted in Section 2.6.2.2 of
ASCE/SEI 24, the Smart Vent® AFFVs must be installed as
follows:
· With a minimum of two openings on different sides of
each enclosed area
· With a minimum of one AFFV for every 200 square feet
(18.6 m2) of enclosed area, except that the SmartVENTTM

Model #1540-521 must be installed with a minimum of
one AFFV for every 400 square feet (37.2 m2) of enclosed
area.

accordance with this report, the applicable code and the
manufacturer's installation instructions. In the event of
a conflict, the instructions in this report govern.

are permitted for use in conjunction with breakaway

applicant shall demonstrate that the effect of the pro-
posed buildings and structures on design flood eleva-
tions, including fill, when combined with all other
existing and anticipated flood hazard area encroach-
ments, will not increase the design flood elevation
more than 1 foot (305 mm) at any point within the juris-
diction.
11324.1.4 Lowest floor. The lowest floor shall be the floor
of the lowest enclosed area, including basement, but
excluding any unfinished flood-resistant enclosure that is
useable solely for vehicle parking, building access or lim-
ited storage provided that such enclosure is not built so as
to render the building or structure in violation of this sec-
tion.
R324.1.5 Protection of mechanical and electrical sys-
tems. Electrical systems, equipment and components, and
heating, ventilating, air conditioning and plumbing appli-
ances, plumbing fixtures, duct systems, and other service
equipment shall be located at or above the design flood
elevation plus freeboard as specified in Section
R323.1.3.3. If replaced as part of a substantial improve-
ment, electrical systems, equipment and components, and
heating, ventilating, air conditioning, and plumbing appli-
ances, plumbing fixtures, duct systems, and other service
equipment shall meet the requirements of this section.
Systems, fixtures, and equipment and components shall
not be mounted on or penetrate through walls intended to
break away under flood loads.
Exception: Electrical systems, equipment and compo-
nents, and heating, ventilating, air conditioning and
plumbing appliances, plumbing fixtures, duct systems,
and other service equipment are permitted to be located
below the design flood elevation provided that they are
designed and installed to prevent water from entering
or accumulating within the components and to resist
hydrostatic and hydrodynamic loads and stresses,
including the effects of buoyancy, during the occur-
mnce of flooding to the design flood elevation in com-
pliance with the flood-resistant construction
requirements of the Building Code of New York State.
Electrical wiring systems are permitted to be located
below the design flood elevation provided they con-
form to the provisions of the electrical part of this code
for wet locations.
R324.1.6 Protection of water supply and sanitary sew-
age systems. New and replacement water supply systems
shall be designed to minimize or eliminate infiltration of
flood waters into the systems in accordance with the
plumbing provisions of this code. New and replacement
sanitary sewage systems shall be designed to minimize or
eliminate infiltration of floodwaters into systems and dis-
charges from systems into floodwaters in accordance with
the plumbing provisions of this code.
R324.1.7 Flood-resistant materials. Building materials
used below the design flood elevation shall comply with
the following:
1. All wood, including floor sheathing, shall be pres-
sure-preservative-treated in accordance with AWPA
U1 for the species, product, preservative and end use
or be the decay-resistant heartwood of redwood,
black locust or cedars. Preservatives shall be listed
in Section 4 of AWPA U1.
2. Materials and installation methods used for flooring
and interior and exterior walls and wall coverings
shall conform to the provisions of FEMA/FIA-TB-2
R324.1.8 Manufactured housing. New or replacement
manufactured housing shall be elevated in accordance
with Section R324.2 and the anchor and lie-down require-
ments of Sections AE604 and AE605 of Appendix E shall
apply. The foundation and anchorage of manufactured
housing to be located in identified flood ways as estab-
lished in Table R301.2(1) shall be designed and con-
stmcted in accordance with the applicable provisions in
the Building Code of New York State.
R324.1.9 As-built elevation certffieations. A licensed
land surveyor or registered design professional shall cer-
tify that the building or structure is in compliance with the
elevation requirements of Section R323.2 or R323.3.
R324.2 Flood hazard areas (including A Zones). Areas that
have been determined to be prone to flooding but not subject
to high velocity wave action shall be designated as flood haz-
ard areas. All buildings and structures constructed in whole or

in part in flood hazard areas shall be designed and con- I
stmcted in accordance with Sections R324.2. t through
R324.2.3.
11324.2.1 Elevation requirements.
1. Buildings and structures shall have the lowest floors
elevated to or above the design flood elevation plus
freeboard as specified in Section R323.1.3.3.
2. In areas of shallow flooding (AO Zones), buildings
and structures shall have the lowest floor (including
basement) elevated at least as high above the highest
adjacent grade as the depth number specified in feet
(mm) on the FIRM, or at least 2 feet (610 nun) ifa
depth number is not specified.
3. Basement floors that are below grade on all sides
shall be elevated to or above the design flood eleva-
tion plus freeboard as specified in Section
R323.1.3.3.
Exception: Enclosed areas below the design flood
elevation, including basements whose floors are not
below grade on all sides, shall meet the requirements
of Section R324.2.2.
11324.2.2 Enelosod area below design flood elevation.
Enclosed areas, including crawl spaces, that are below the
design flood elevation shall:
1. Be used solely for parking of vehicles, building
access or storage.
2. Be provided with flood openings that meet the fol- I
lowing criteria:

different sides of each enclosed area; if a build-
ing has more than one enclosed area below the

design flood elevation, each area shall have
openings on exterior walls.
2.2. The total net area of all openings shall be at
least 1 square inch (645 mm2) for each square
foot (0.093 m2) of enclosed area, or the open-
ings shall be designed and the construction doc-
uments shall include a statement that the design
and installation will provide for equalization of
hydrostatic flood forces on exterior walls by
allowing for the automatic entry and exit of
floodwaters.
2.3. The bottom of each opening shall be I foot
(305 mm) or less above the adjacent ground
level.
2.4. Openings shall be at least 3 inches (76 mm) in
diameter.
2.5. Any louvers, screens or other opening covers
shall allow the automatic flow of floodwaters
into and out of the enclosed area.
2.6. Openings installed in doors and windows, that
meet requirements 2.1 through 2.5, are accept-
able; however, doors and windows without
installed openings do not meet the requirements
of this section.
R324~2.3 Foundation design and construction. Founda-
tion wails for all buildings and structures erected in flood
hazard areas shall meet the requirements of Chapter 4.
Exception: Unless designed in accordance with Sec-
tion R404:
1. The unsupported height of 6-inch (152 mm) plain
masonry walls shall be no more than 3 feet (914
2. The unsupported height of 8-inch (203 mm) plain
masonry walls shall be no more than 4 feet (1219
mm).
3. The unsupported height of 8-inch (203 mm) rein-
forced masonry walls shall be no more than 8 feet
(2438 mm).
For the purpose of this exception, unsupported
height is the distance from the finished grade of the
under-floor space and the top of the wall.
R324.3 Coastal high-hazard areas (including V Zones).
Areas that have been determined to be subject to wave
heights in excess of 3 feet (914 mm) or subject to high-veloc-
ity wave action or wave-induced erosion shall be designated
as coastal high-hazard areas. Buildings and structures in
coastal high-hazard areas shall be designed and constructed
in accordance with Sections R324.3.1 through R324.3.6.
R324.3.1 Location and site preparation.
1. Buildings and structures shall be located landward
of the reach of mean high tide.
2. For any alteration of sand dunes and mangrove
stands the building official shall require submission
of an engineering analysis which demonstrates that

the proposed alteration will not increase the poten-
tial for flood damage.
R324.3.2 Elevation requirements.
1. All buildings and structures erected within coastal
high hazard areas shall be elevated so that the lowest
portion of all structural members supporting the
lowest floor, with the exception of mat or raft foun-
dations, piling, pile caps, columns, grade beams and
bracing, is located at or above the design flood ele-
vation plus freeboard as specified in Section
R323.1.3.3.
2. Basement floors that are below grade on all sides are
prohibited.
3. The use of fill for structural support is prohibited.
4. The placement of fill beneath buildings and struc-
tures is prohibited.
Exception: Walls and partitions enclosing areas
below the design flood elevation shall meet the
requirements of Sections R324.3.4 and R324.3.5.
R324.3.3 Foundations. Buildings and structures erected
in coastal high-hazard areas shall be supported on pilings
or columns and shall be adequately anchored to those pil-
ings or columns. Pilings shall have adequate soil penetra-
tions to resist the combined wave and wind loads (lateral
and uplift). Water loading values used shall be those asso-
ciated with the design flood. Wind loading values shall be
those required by this code. Pile embedment shall include
consideration of decreased resistance capacity caused by
scour of soil strata surrounding the piling. Pile systems
design and installation shall be certified in accordance
with Section R324.3.6. Mat, raft or other foundations that
support columns shall not be permitted where soil investi-
gations that are required in accordance with Section
R401.4 indicate that soil material under the mat, raft or
other foundation is subject to scour or erosion from wave-
velocity flow conditions. Slabs, pools, pool decks and
walkways shall be located and constructed to be structur-
ally independent of buildings and structures and their
foundations to prevent transfer of flood loads to the build-
ings and structures during conditions of flooding, scour or
erosion from wave-velocity flow conditions, unless the
buildings and structures and their foundation are designed
to resist the additional flood load.
R324.3.4 Walls below design flood elevation. Walls and
partitions are permitted below the elevated floor, provided
that such walls and partitions are not part of the structural
support of the building or structure and:
1. Elech-ical, mechanical, and plumbing system com-
ponents are not to be mounted on or penetrate
through walls that are designed to break away under
flood loads; and
2. Are constructed with insect screening or open lat-
tice; or
3. Are designed to break away or collapse without
causing collapse, displacement or other structural
damage to the elevated portion of the building or
2010 RESIDENTIAL CODE OF NEW YORK STATE
DECLARATION OF COVENANTS AND RESTRICTIONS
This DECLARATION is made and dated the [c~' day of November, 2005 by Mark
Baxter and Jacqueline Baxeter,residing at 5805 Main Bayview Road, Sou&old, NY 11971.
Herein referred to as the DECLARANT.
WITNESSETH:
WHEREAS, the DECLARANT is the owner of a certain real property situate on the
northeasterly side of Main Bayview Road, Town of Sou&old, Suffolk County, New York,
more particularly bounded and described in Schedule "A" attached hereto (hereinafter
referred to as the Property); and
WHEREAS, the DECLARANT has made an application for and has received condi6onal
approval from the Planning Board of the Town of Southold to subdivide said property into
two (2) lots, as shown on the Subdivision Map of Mark Baxter prepared by Young & Young,
Land Surveyors last dated January 18, 2004 which map will be filed herewith in the Office
of the Suffolk County Clerk; and
WHEREAS, for and in consideration of the granting of said approval, the Planning Board
of the Town of Sou&old has deemed it to be in the best interests of the Town of Son&old
and the owners and prospective owners of said lots that the within Covenants and
Restrictions be imposed on said lots I and 2, arid as a condition of said approval said
Planning Board has required that the within Declaration be recorded in the Suffolk County
Clerk's Office; and
WHEREAS, the Declarant has considered the foregoing and has determined that the same
will be for the best interests of the DECLARANT ans subsequent owners of said parcel;

That the DECLARANT, for lite purpose of carrying out the intentions above expressed, does
hereby make kllown, admit, publish, covenant and agree that the sail lots within said
subdivision map shall hereafter be subject to the following covenants and restrictions as
herein cited, which shall nm with the land and shall be binding upon ail purchasers, lot
owners and holders of said Property, their heirs, executors, adrninislxators, legal
representatives, distributees, successors and assigns, to wit:

the Property only with the written consent of the Town granted by a majority plus one vote
of the Planning Board after a public hearing.

unconstitutional, the same shall not affect the validity of these covenants as a whole ox any

The aforementioned Res~ctive Covenants are intended for the benefit of and shail be
enforceable by the Town of Southold, State of New York, by injunctive relief or by any other

2. Measure wall thickness and bend (,more than 90) 4 straps at nearest slot to the measurement from pointec
5. Remove door from frame. (turn upside down rotate bottom of door outward and slide out of slots)
4. Insert two straps into two top sets of slots in frame from rear. After pushing teeth through rear set slots
ONLY PUSH STRAPS ONE CLICK INTO FRONT SLOTS. Strap_s should have bent legs pointing up.
5. Caulk may be applied behind front frame flanc, le. Tilt frame so top goes into wall opening first with strap le
going behind wall above opening. Push frame into opening so front flange is tight to face of wall.
6. Reach throuqh frame opening and install two bent straps through two b~tt~m sets of slots n fro_me, trQpp r
between front flange and bent strap. Squeeze all straps bght. Frame should be flush to wa face and secure
7. Check that frame is square and slots are clear of debrrs, mortar and caulk
8. Install door into frame by grasping bottom of door ('with plastic pins) and front ('with smaller sguares) facim
Slide door into frame such that metal pins on each side slide into slots on sdes of frame. Let the door slide
followinq the path of the slots, until they are at the bottom of the slots in the dimples.
9. Let [he bottom of the door go so that the door rotates down into the frame. Check that door is latched
