WITNESSETH, that the party of the first part, in consideration of one dollar and other
good and valuable consideration, lawful money of the United States, paid by the party of the
second part, does hereby graat and release unto the party of the second par~, the heirs or
successors and assigns forever,
All that certain plot, piece or parcel of [and, with the buildings and improvements
thereon, erected, situate, lying and being in the Village of Greenport, Town of Southold, Suffolk
County, State of New York, bounded and described as follows:
BEGINNING at a point on the southerly side of Bay Avenue, distant 219.36 feet Easterly from
the comer formed by the intersection of the southerly side of Bay Avenue and the Easterly side of
Carpenter Street, being the northeasterly corner of the premises now or formerly of Heaney;
RUNNING THENCE along the southerly side of Bay Avenue, North 74 degrees 15 minutes 50
seconds East, 77.80 feet to land now or formerly of Mitchell;
THENCE South 14 degrees 44 minutes 40 seconds East along the last mentioned land 196.70 feet
to land now or formerly of Barstow;
THENCE South 82 degrees 29 minutes 00 seconds West along the last mentioned land 76.76 feet
to land now or formerly of Heaney;
THENCE North 15 degrees 15 minutes 50 seconds West along the last mentioned land 185.70
feet to the southerly side of Bay Avenue and the point or place of BEGINNING.
BEING the same premises described in the deed to the parties of the first part herein by deed
dated 11-14-2003 recorded 12-09-2003 in Liber D00012288 page 817.
TOGETHER with all the right, title and interest, if any, of the party of the first part in and to any
streets and roads abusing the above described premises to the center lines thereofi TOGETHER
with the appurtenances and all the estate rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the parties herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first pa/t has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first of the payment of the cost of the improvement
before using ay part of the total of the same for any other purpose. The word "party" shall be
construed as if it read "parties" whenever the sense of th is indenture so requires.
