RESERVING UNTO GRANTOR and its heirs, successors and assigns, an unobstructed right
of way for vehicular access from Old Main Road a/k/a Sound Avenue to other property of
Grantor known as Lot 2 of the Map Entitled "Lot Line Modification Map of Property situate
Mattituck" dated February 2, 2010 and last revised January 14, 2011 prepared by Nathan Taft
Corwin IH Land Surveyor more particularly described as Exhibit A ("Theater Parcel").
Subject to a temporary subsurface easement to maintain the existing sanitary system which
encroaches on property of Grantor benefitting tile Parcel described as Exhibit A "Theater
Parcel". This temporary easement shah terminate in the event that the sanitary system shah
fail and upon termination, Grantee shah abandon such sanitary system in accordance with the
rules and regulations of the Suffolk County Department of Health.
The Southold Town Planning Board approved this lot line modification by reso. lution on

This deed is a Confirmation Deed.
TOGETHER with all right, title and interest, if any, of the party of the ~st part of, in and to any streets and roads abutting the
above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and fights of the
party of the first pan in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the
second pan, the heirs or sucCesSors and assigns of the party of the second pan forever.
AND the party ol; the lb'st part covenants that the party of the first pan has not done or suffered anything whereby the said
premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the fkst pan, in compliance with Section 13 of the Lien Law, covenants that the party of the first pan will
receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied
Fa-st for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the
tmprovernent before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
