WITNESSETH, that the party of the first part, in consideration of TEN and no/100ths ($10.00) dollars paid by
the party of the second part, does hereby grant and release unto the pady of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALL that cedain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being north of the Village of Southold, in the Town of Southold, County of Suffolk and State of New
York, and as more particularly bounded and described as follows:
BEGINNING at the southwesterly corner thereof at a monument set at the point of intersection of the easterly
southerly side of Mill Creek Drive, a Town Highway, with the northerly line of tands heretofore conveyed by
Henry J. Smith and described in deed by him to Francis X. Redmond and Elizabeth Redmond, his wife, dated
September 30, 1949 and recorded in the Suffolk County Clerk's Office on August 12, 1954 in Liber 3470 of
deeds at page 171.
RUNNING THENCE North 1 degree 20 East along the easterly side of Mill Creek Drive 26.77 feet to a point;
THENCE continuing northerly along the easterly side of said Drive on the arc of a circle bearing to the left
having a radius of 75 feet, the distance of 37.71 feet to a monument set on the southwesterly corner of land
heretofore conveyed by said Henry J. Smith and described in deed by him to Joseph D. Zaiser and Ethel B.
Zaiser, his wife, dated September 3, 1949 and recorded in said Clerk's Office on September 6, 1949 in Liber
2989 of deeds at page 50.
RUNNING THENCE North 64 degrees 00 minutes 00 seconds East along the southerly line of land last
mentioned 148 feet, more or less, to the ordinary high water mark of Arshamomoque Pond;
RUNNING THENCE in a generally southerly direction along said high water mark to the northerly line of
aforesaid land of Francis X. Redmond and Elizabeth Redmond, his wife, the distance of said last mentioned
boundary as measured along a tie-line running South 9 degrees 07 minutes 00 seconds East, being 111.84
feet;
RUNNING THENCE South 83 degrees 00 minutes 00 seconds West along the nodherly line of the aforesaid
lands of Redmond 144 feet, more or less, to the monument at the point or place of BEGINNING.
TOGETHER WITH all the right, title and interest, if any, in and to Mill Creek Drive lying in front of and adjacent '
to said premises to the center line thereof.
TOGETHER WITH all the right, title and interest, if any, in and to the lands under the waters of
Arshamomoque Pond lying in front of and adjacent to said premises and on the southerly end thereof.
BEING AND INTENDED TO BE the same premises conveyed to the parties of the first part by deed made by
CAROL FORESTIERI, VIRGINIA MEMOLI, PAUL J. FORESTIERI and JOHN FORESTIERI dated May 24,
2012 and recorded in the Suffolk Cou,nty Clerk's Office on May 24, 2012 in Liber 12694 Page 281.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part' has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first pad, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
