Referee duly appointed in the action hereinafter mentioned, as Grantor, and CAPITAL ASSET
RETIREMENT FUND LLC, a domestic Limited Liability Company having offices at 2885

WITNESSETH that Grantor, the Referee appointed in an action in partition instituted in the
Supreme Court of the State of New York, County of Suffolk, bearing index number 11-35833
between Capital Asset Retirement Fund LLC, Plaintiffs, and Ronald Diachun, Theodore
Diachun, Delmar International, Inc., Eric H. Alexander d/b/a Reginald H. Tuthill Funeral Home,
Commissioner of Taxation and Finance, United States of America,, Defendants, in accordance
with a judgment dated July 10, 2012 entered in the Office of the Suffolk County on August 27,
2012, and in consideration of $150,000.00 paid by Grantee, being the highest sum bid at the sale
conducted pursuant to said judgment, does hereby grant and convey unto grantee
ALL that certain plot, piece or parcel of land, with the buildings thereon erected, situate, lying
and being at Laurel, Town of Southold, County of Suffolk and State of New York, bounded and
described as follows:
BEGINNING at a monument on the northerly line of Peconic Bay Boulevard at the southwesterly
comer of land now or formerly of Robinson and the southeasterly comer of the land herein
described;
RUNNING THENCE along the said northerly line of Peconic Bay Boulevard South 51 degrees
30 minutes 00 seconds west, 110.61 feet to a monument and the land now or formerly of Oakes;
THENCE along said lands of Oakes, being also along the westerly line of a 50 foot right of way,
North 26 degrees 09 minutes 30 seconds west, 200 feet to a monument;
THENCE continuing along said land of Oakes, South 51 degrees 30 minutes west, 90 feet;
THENCE along the lands now or formerly of Harry Young the following two (2) courses and
distances:

THENCE along said land of Wilcenski and along lands now or formerly of Robinson, South 20
degrees 14 minutes 40 seconds cast, 1356 feet more or less to the point or place of BEGINNING.
