DRIVEWAY EASEMENT
THIS AGREEMENT, made the ['q"~' day of July, 2012, between CLAUDE
DAVlS and MARlE DAVIS, residing at Ote Jule Lane, Mattituck, New York, and JAMES
HARRINGTON and JANIS HARRINGTON, residing at 1780 Ole Jule Lane, Mattituck, New
York;
WHEREAS, the said CLAUDE DAVIS and MARIE DAVIS are the owners of a parcel
of land know asl'Tao Ole Jule Lane, Mattituck, in the Town of Southold, County of SuffoIk,
State of New York~ (sctm: 1000-122-4-4), herein attached as Schedule A and JAMES
HARRtNGTON and JANIS HARRINGTON are the owners of a parcel of land known as 1780
Ole Jule Lane, Mattituck, in the Town of Southold, County of Suffolk, State of New York,
(sctm: 1000-122-4-5), herein attached as Schedule B, and
WHEREAS each of the said properties is improved by a single family dwelling, are
adjoining parcels, with a common curb cut on Ole Jule Lane. Said common curb cut and
driveway provide for ingress and egress to both adjoining parcels on Ole Jule Lane and provides
the only means of access to the garage on 1780 Ole Jule Lane, Mattituck N.Y.;
WHEREAS JAMES HARRINGTON's and JANIS HARRINGTON's driveway runs
over and through the Southeast corner of the land of CLAUDE DAVIS and MARIE DAVIS and
is a continuation of the driveway to each parcel (see attached survey prepared by Peconic
Surveyors, P.C. dated January 27,2010) thereto and therefrom, Now, therefore,
WITNESSETH:
That, in consideration of the mutual promises herein contained, and one ($1.00) dollar
each to the other in hand paid, receipt whereof is hereby acknowledged, and other good and
valuable consideration, the said parties hereby agree as follows:
CLAUDE DAVIS and MARIE DAVIS, their respective distributees, devisees, personal
representatives, successors or assigns grants and conveys to JAMES HARRINGTON and JANIS
HARRINGTON, their respective distributees, devisees, personal representatives, successors or
assigns, an easement for the driveway improvements, ingress and egress, and all such reasonable
purposes, over the southerly portion of the land of CLAUDE DAVIS and MARIE DAVIS,

Each of the parties hereby covenants and agrees as follows:
(1) that the parties shall share in the proportionate share of the cost of maintenance and
repairs of said driveway, including but not limited to snow removal.
Schedule A
ALL that certain plot, piece or parcel of land, situate, lying and being at Mattituck, in the
Town of Southold, County of Suffolk and State of New York, bounded and described as
follows:
BEGINNING at an iron pipe on the westerly line of Ole Jule Lane at the southeasterly
comer of land of Janeczko; from said point of beginning running along said westerly line
of Ole Jule Lane two (2) courses as follows:
(1) South 40 degrees 56 minutes 40 seconds West, 12.39 feet; thence
(2) South 14 degrees 03 minutes 20 seconds East, 82.61 feet to an iron pipe;
THENCE through land of the party of the first part, North 84 degrees 56 minutes 20
seconds West, 222.36 feet to a point 10 feet westerly from the easterly edge of a proposed
dredged channel;
THENCE northerly on a line t 0 feet westerly from said easterly edge 85 feet more or
less to said land of Janeczko;
THENCE along said land of Janeczko and passing through an iron pipe South 87 degrees
24 minutes 50 seconds East, 210.18 feet to the point or place of BEGINNING.

in the Town of. Southotd, County of Suffolk and State of New York, bounded and
described as follows:
BEGINNING at a point on the westerly side df Ole Jule Lane, where the same is
intersected by the division line between the premises herein described and land
now or formerly of Davis. Said point afso being distant 1345 feet southerly as
measured along Ole Jute Lane from the corner formed by the intersection of the
easterly side of Ole Jule Lane with the southerly side of New Suffolk Avenue;
RUNNING THENCE South 14 degrees 03 minutes 20 seconds East along the
westerly side of Ofe Jule Lane 95 feet actual (90 feet per deed) to land now or
formerly of Haas;
THENCE North 83 degrees 43 minutes 50 seconds West along said last
mentioned land 223.95 feet more or less;
THENCE northerly thru dredged channel North 14 degrees 03 minutes 20
seconds West 90 feet more or less per survey (85 feet per deed) to land now or
formerly of Davis;
THENCE South 84 degrees 56 minutes 20 seconds East along said last
mentioned land, 222.25 feet to the easterly side of Ole Jule Lane, the point or
place of BEGINNING.

Together with all right, title and interest of, in and to any streets and roads abutting the above described premises,
to the center line thereof.
