Dear Mr. Trezza:
The Southold Town Planning Board, at a meeting held on Monday, April 7, 2014,
adopted the following resolutions:
WHEREAS, this proposal is for a Standard Subdivision of a 5.9 acre parcel into two lots
where Lot 1 equals 1.5 acres and Lot 2 equals 4.4 acres, located in the R-40 Zoning
District; and
WHEREAS, on April 8, 2013, the Southold Town Planning Board granted Sketch Plan
Approval upon the map prepared by Peconic Surveyors, P.C., entitled "Sketch Plan for
Andrew T. Fohrkolb", dated August 29, 2012; and
WHEREAS, on July 22, 2013, the agent submitted the Preliminary Plat Application with
six copies of the Preliminary Plat; and
WHEREAS, on August 10, 2013, the Planning Board reviewed the above-referenced
application at their Work Session and found the Preliminary Plat Application complete;
and
WHEREAS, on August 22, 2013, referrals were sent to all applicable agencies; and
WHEREAS, the Planning Board performed a coordinated review of this Unlisted Action
pursuant-to 6 NYCRR Part 617, Section 617.7 of the State Environmental Quality
Review Act (SEQRA); and

WHEREAS, on August 22, 2013, the Planning Board declared Lead Agency status for
the SEQRA review of this unlisted action; and
WHEREAS, on September 10, 2013, the Planning Board set the Preliminary Public
Hearing; and
WHEREAS, on September 24, 2013, the Suffolk County Planning Commission
responded to the SEQRA coordination and referral request stating the Commission has
no objection to the Town of Southold assuming Lead Agency status and that the
Commission reserves the right to comment on this proposed action; and
WHEREAS, on September 25, 2013, the Office of the Town Engineer responded to the
referral request with comments; and
WHEREAS, on September 26, 2013, the Suffolk County Department of Health Services
responded to the SEQRA coordination and referral request stating that the agency does
not have interest in assuming lead agency and responded with comments to the referral
request; and
WHEREAS, on October 8, 2013, the Preliminary Public Hearing was tabled upon the
request of the applicant due to the pending change in the proposed lot sizes; and
WHEREAS, on October 24, 2013, the agent submitted revised surveys that depicted
revised lot sizes; and
WHEREAS, on November 4, 2013, the Planning Board, at their Work Session, reviewed
the application and agreed to the requested lot size amendments. The amendments are
as follows: proposed Lot 1 will increase from 0.93 acres to 1.5 acres and proposed Lot 2
will decrease from 3.54 acres to 2.83 acres; and
WHEREAS, on November 4, 2013, the Planning Board set the Preliminary Hearing at
their public meeting for December 16, 2013; and
WHEREAS, on November 6, 2013, the Town of Southold Local Waterfront
Revitalization Program (LWRP) Coordinator reviewed this application and has
recommended the proposed project be found consistent with the policies of the
Southold Town LWRP; and
WHEREAS, on December 16, 2013, the Planning Board held and closed the
Preliminary Public Hearing; and
WHEREAS, on February 10, 2014, at their Work Session, the Planning Board found
that all requirements of Preliminary Plat review pursuant to §240-17 have been met, be
it therefore

RESOLVED, that the Southold Town Planning Board, pursuant to SEQRA, hereby
makes a determination of non-significance for the proposed action and grants a
Negative Declaration; and be it further
RESOLVED, that the Southold Town Planning Board has determined that this proposed
action is consistent with the policies of the Town of Southold LWRP; and be it further
RESOLVED, that the Southold Town Planning Board hereby grants Conditional
Preliminary Plat Approval upon the map prepared by Peconic Surveyors, P.C.,
entitled "Standard Subdivision for Fohrkolb Acres", dated September 27, 2013 with the
following conditions:
1. Submission of a Final Plat Application meeting all the requirements of Section
240-20 of the Southold Town Code.
2. The following amendments to the Final Plat shall be required:
a. Title the plat "Final Plat for the Standard Subdivision of Fohrklob Acres...";
b. Show and label the 100' wide non-disturbance buffer (natural vegetated
buffer) from the wetland line landward;
c. Evidence of the Eastern Box Turtle, a species of Special Concern in New
York State was found on site. New York State Department of
Environmental Conservation guidance is to design the required clearing
limits to form contiguous woodland habitat. Therefore, the Planning Board
is requiring that the clearing limits pursuant to §240-49 Clearing for Lots 1
(35% can be cleared) and 2 (25% can be cleared) be designed to achieve
contiguous woodland habitat to the east of the parcel. The clearing limits
are exclusive of the 1 00' wide non-disturbance buffer.
3. The future lot design and clearing limits may be revised based on the results of
any required cultural resources survey of potential archeological resources.
4. Submission of Draft Covenants and Restrictions (a template will be provided by
the Planning Department).
5. Submission of a letter of water availability from the Suffolk County Water
Authority.
The next step to continue towards Final Plat Approval is the submission of a Final
Plat Application and Fee.

Preliminary Plat Approval shall expire six months from the date the Planning
Board adopted its resolution of approval, unless extended by further resolution of
the Planning Board, such extension not to exceed a total of 180 days. In the event
that the applicant shall fail to apply for approval of a Final Subdivision Plat prior
to expiration of the Preliminary Approval, all documents required by this section
shall be re-submitted and a second Preliminary Filing Fee shall be paid before
any application for Final Plat Approval shall be accepted or processed. Upon
endorsement of the Final Plat by the Chairman, the mylars and paper prints must
be picked up at this office and the Final Plat filed with the Suffolk County Clerk by
the applicant within 62 days of the date of Final Plat Approval or such approval
shall expire. Final Plat Approval shall be determined in accordance with §276 of
the New York State Town Law.

This notice is issued pursuant to Part 617 of the implementing regulations pertaining to Article 8 (State
Environmental Quality Review Act) of the Environmental Law.
The Southold Town Planning Board, as lead agency, has determined that the proposed action described
below will not have a significant effect on the environment and a Draft Environmental Impact Statement will
not be prepared.

Description of Action: This proposal is for a Standard Subdivision of a 5.9 acre parcel into two lots where
Lot 1 equals 1.5 acres and Lot 2 equals 4.4 acres, located in the R-40 Zoning District.
Reasons Supporting This Determination:
An Environmental Assessment Form has been submitted and reviewed and it was determined that no
significant adverse effects to the environment were likely to occur should the project be implemented as
planned.
The determination was based upon the following:
1. It is estimated that the proposed 2 residential lots will use approximately 600 gallons of water per
day. Sanitary disposal within the proposed subdivision will be managed by on-site underground
sewage leaching systems. In 1978, the Long Island Regional Planning Board published the Long
Island Comprehensive Waste Treatment Management Plan (208 Study). The 208 Study identified
eight (8) hydrogeologic zones in Nassau and Suffolk Counties. These zones were distinguished
based upon differences in underlying groundwater flow patterns a,id water quality. The subject site
is located within SCDHS Groundwater Management Zone IV, which according to Article VI of the
Suffolk County Sanitary Code, has an allowable flow of 600 gallons per day (gpd) per acre in areas
served by public water. The sanitary design flow is computed using SCDHS manual Standards for
Approval of Pians and Construction for Sewage Disposal posal Systems for Other er Than Single Family
Residences. The manual establishes the design flow as follows for the action:

Therefore, the proposed application will conform to Article VI of the Suffolk County Sanitary Code
and will not be expected to adversely affect groundwater quality provided properly functioning
systems are designed and installed.
2. Soils on site are comprised of:

Parcel soils indicate that slopes occur closer to Long Creek where d bluff occurs adjacent to the tidal
marsh soils. LIDAR mapping confirms the area of slopes (Figure 2).

The capability class of the Carver and Plymouth soil types indicate that they are excessively drained
(very rapid permeability) and highly erosive. The Planning Board is requiring the establishment of a
100' non-disturbance buffer from the wetland line landward to prevent disturbance of the soils on the
severe slopes. Clearing limits will also be required on each lot to further prevent disturbance to slopes,
3. No substantial adverse change in existing air quality is expected to occur as a result of the proposed
action.
4, No substantial adverse change in ground or surface water quality or quantity is expected to occur. The
Planning Board is requiring the following mitigation practices to minimize impacts water quality of the
a uifer and coastal waters. The practices will be filed within a covenant and restriction:
1. Require the use of native, drought-tolerant plants in landscaping.
2. Prohibit the residential application and use of synthetic fertilizers and pesticides capable
of entering the potable water supply.
a. Require only the use of organic fertilizers where the water-soluble nitrogen is no
more than 20% of the total nitrogen in the mixture.
b. Require a maximum of 1 Ib. of nitrogen per 1000 square feet in any one application,
with a cumulative application of no more than 2 lbs. per 1,000 square feet per year.
c. Apply fertilizer products only during the growing season (typically mid-April through
mid-October).
3. Prohibit the use of underground storage tanks, (except those with spill, overfill, and
corrosion protection requirements in place).
4. Require that pervious driveways serve each lot.

As indicated above, the f-ianning Board is also requiring the estao..shment of a 100' non-disturbance
buffer from the wetland line landward. The buffer will include existing trees (Quercus spp.) on lot 2 and
the bluff, a protected natural feature.
5. No substantial adverse change to traffic or noise levels and no substantial increase in solid waste
production will result from the proposed action.
6. The parcel is located adjacent to marine waters and wetlands of Long Creek, a branch of Mattituck
Creek. A bluff occurs along the south of the lot 2 property line. The bluff is vegetated and soils are
stable with no apparent active erosion therefore no substantial erosion is expected to occur as a result
of this action.
7. The parcel is located in the FEMA Flood Zone AE and an unassigned area. Due to parcel elevations
above sea level, the threat of flooding of the parcel is low. The AE Flood Zone coincides with the limits
of the marine surface water and wetlands at lower elevations.
Test hole data (7/18/12) indicates that water is greater than 17' below grade, therefore, no substantial
leaching or drainage problems will occur as a result of this action.

8. No significant removal or destruction of large quantities of vegetation or fauna. Evidence (droppings) of
white tailed deer (Odocoileus virginianus) was observed on site. This parcel and the surrounding area
offer cover and food for the species. Although woodland habitat will be cleared as a result of this
action, no significant removal of vegetation will occur.
9. No other significant adverse impacts to natural resources will occur.
As indicated above, the Planning Board is requiring that a 100' wide non-disturbance buffer be
established landward form the wetlands on Lot 2. Both Lots 1 and 2 are also subject to regulatory
clearing limits further protecting existing vegetation on site.
No substantial interference with the movement of any resident or migratory fish or wildlife species is
expected a result of the proposed action.

No ��impacts on a significant habitat area and no substantial adverse impacts on a threatened
or endangered species of animal or plant or the habitat of such a species is expected to occur as a
result of this action. Note however, that an Eastern Box Turtle Terra ene Carolina Carolina shell was
observed durina site insvection. The Eastern Box Turtle is a species of special concern as defined in
Section 182.2(1) of 6NYCRR Part 182. Species of special concern warrant attention and consideration.
Due to the time of year, no live animals were observed.
10. The proposed action is not in a material conflict with a community's current plans or goals as officially
approved or adopted. The proposed residential use conforms to the parcel zoning district Residential
40 (R-40). The purpose of the low residential district is stated as:
The purpose of the Low-Density Residential R-40 District is to provide areas for residential development
where existing neighborhood characteristics, water supply and environmental conditions permit full
development densities of approximately one dwelling per acre and where open space and agricultural
preservation are not predominate objectives.
11. This proposal furthers the goals of the community by reducing the allowable yield (density) of the parcel
by 2 lots, preserving the water quality and natural features and preserving existing vegetation to the
greatest extent practicable.
12. The proposed action will not significantly impair the character or quality of important historical,
architectural, or aesthetic resources or of existing community or neighborhood character. The
neighborhood character is consistent with the proposal for residential use on the parcel.
13. The parcel is not within the archeological sensitive areas as depicted on the New York State
Department of Parks and Historic Preservation Circle or Squares Map. Additionally, no known
archaeological resources have been identified on site.
14. No major change in the use of either the quantity or type of energy will occur. The two residential lots
being created are not expected to have a significant impact on energy usage or resources.
15. No creation of a hazard to human health will occur as a result of this proposed action.
16. The proposed action will not cause a substantial change in the use, or intensity of use, of land including
agricultural, open space or recreational resources, or in its capacity to support existing uses.
17. Based upon such, no significant adverse impacts to the environment are expected to occur should the
project be implemented as planned.

The Historic Preservation Review Process in New York State
In order to insure that historic preservation is carefully considered in publicly-funded or permitted
undertakings*, there are laws at each level of government that require projects to be reviewed for
their potential impact/effect on historic properties. At the federal level, Section 106 of the National
Historic Preservation Act of 1966 (NHPA) directs the review of federally funded, licensed or permitted
projects. At the state level, Section 14.09 of the Newyork State Parks, Recreation and Historic
Preservation Law of 1980 performs a comparable function. Local environmental review for

The Southold Town Planning Board reviewed the above-referenced application at their
February 10, 2014 Work Session and have agreed to the following:
1. The application is ready for a Conditional Preliminary Plat determination at the March
10, 2014 Public Meeting.
2. After a determination has been made on the Preliminary Plat Application, you will have
six months to submit the Final Plat Application. Please note that the following will be
required during the Final Plat Application review:
a. Submission of Draft Covenants and Restrictions (a template will be provided by
the Planning Department) with the following clauses (please note that not all
clauses that will be required are outlined below):
i. "A land area of a certain length and width where existing vegetation occurs
prior to the commencement of any grading or clearing activity. To achieve
the percentage of ground cover, indigenous, drought tolerant vegetation
shall be planted. Survival of planted vegetation shall be for a period of three
years. Maintenance activities within the buffer are limited to removing
vegetation which is hazardous to life and property, trimming tree limbs to a
height of 15 feet to maintain viewshed, replanting of vegetation and
establishing a four-foot-wide access path constructed of pervious material
for access to public waters."

vii. No fertilizers containing the primary macronutrients (nitrogen (N),

viii. A maximum of 1 pound of nitrogen per 1000 square feet in any one
application, with a cumulative application of no more than 2 pounds per
1,000 sq. ft. per year is permitted.
ix. The use of phosphorous containing lawn fertilizer comprised of more than
0.67% phosphate is prohibited unless establishing a new lawn or soil test
shows that the lawn does not have enough phosphorus. Fertilizer labels
have three bold numbers. The first number is the amount of nitrogen (N), the
second number is the amount of phosphorus oxide (P206) and the third
number is the amount of potassium oxide (K20). A bag of 10.5-10 fertilizer
contains 10 percent nitrogen, 6 percent phosphorus oxide and 10 percent
potassium oxide. The law limits the amount of P205 to less than 0.67%.
Therefore the phosphorus (middle number) should be less than 0.67 for the
product to meet the phosphorus lawn fertilizer restriction.
x. The use of underground storage tanks, (except those with spill, overfill, and
corrosion protection requirements in place) is prohibited.
A. Pervious driveways must serve each lot.
b. Submission of a letter of water availability from the Suffolk County Water Authority.

o Suffolk County De artment of Health Services SCDHS
1. SCDHS has not received an application for the referenced project as
required by Article VI of the Suffolk County Sanitary Code. The project

sponsor should submit an application to our agency's Office of Wastewater
at the earliest possible dated so that a complete technical assessment of this
proposal can be undertaken.
2. The SCDHS maintains jurisdiction over the final location of sewage disposal
and water supply systems. The applicant, therefore, should not undertake
the construction of either system without Health Department approval,
Design and flow specifications, subsurface soil conditions and complete site
plan details are essential to the review of this project.
o Suffolk County Planning Commission (SCPC):
1. The Planning Commission has no objection to the Town of Southold
assuming Lead Agency status.
2. The Planning Commission considers this to be a matter for local
determination.
o Local Waterfront Revitalization Program LWRP
Consistent with the LWRP provided that the below recommendations are
required in the subdivision approval.
1. It is recommended that the following best management practices be
required to protect water quality of the aquifer and coastal waters:
a. Require the use of native, drought-tolerant plants in landscaping.
b. Prohibit the residential application and use of synthetic fertilizers
and pesticides capable of entering the potable water supply.
i. No fertilizers containing the primary macronutrients ( nitrogen (N),
phosphorus (P), or potassium K)) shall be applied between the
moths of December 1 and April 1.

2. It is recommended that the Board require 100' natural vegetated buffer
from the wetland line landward. Language for the buffer follows:
NATURAL VEGETATED BUFFER: A land area of a certain length and
width where existing vegetation occurs prior to the commencement of
any grading or clearing activity. Vegetation shall be maintained to
achieve a minimum percentage of ground cover of 95%. To achieve
the percentage of ground cover, indigenous, drought tolerant
vegetation shall be planted. Survival of planted vegetation shall be
90% for a period of three years. Maintenance activities within the
buffer are limited to removing vegetation which is hazardous to life and
property, trimming tree limbs to a height of 15 feet to maintain
viewshed, replanting of vegetation and establishing a four-foot-wide
access path constructed of pervious material for access to public
waters.
o Off ice of the Town Engineer'.
1. Road work within the Town Right of Way Greton Court must meet the
minimum requirements of the Town Highway Specifications.
2. Stormwater Management Control Plans will be required during building
permit reviews for each individual lot.
3. Maple Avenue, located on the westerly side of lot #2, is private and
very narrow. This private driveway should not be used for access to
the second lot. It is recommended that the C&Rs should be developed
to prohibit access from this location.
4. The adjacent wetland, known as Long Creek, is an impaired TMDL
water body. It is recommended that this water body be protected by
establishing a one hundred (100) foot wide Non-Disturbance Buffer.
This Buffer should begin at the Flagged wetland limit line and extended
landward up the slope. This buffer is approximately the same setback
already established by development of properties located on each side
of the subdivision.
5. Any consideration by the Planning Board to allow for access walking
trails though this buffer should be coordinated with the Town Trustees
and it should be constricted in a manner that would be protected from
erosion.
o Mattituck Fire De artrnent:
• Public Hearing Comments:
o "While we have no problem with the applicant creating two lots where one
formerly existed, we have concerns that the consequence of building two
houses will be a significant reduction in the number of trees remaining after
construction and landscaping of two residences.

We have already watched construction of a large house, then later illegal
clearing for open lawns and landscaping, and finally clearing for a pool across
the creek from our property, We fear this new property development will
negatively affect the water quality of the creek and its wetland habitat, as well
as scenic values, we would ask as a condition of your approval, that the
applicants landscape plan be submitted, and monitored during and after
construction."
VI: Staff Recommendations
1. Accept all referral responses from the SCDHS, SCPC, LWRP, the Office of the
Town Engineer and the Mattituck Fire Department.
2. Require a 100' wide non-disturbance buffer (natural vegetated buffer) from the
wetland line landward as recommended by the LWRP coordinator and the Office of
the Town Engineer.
3. Require that clearing limits pursuant to §240-49 Clearing be followed. Maximum
percentage of site permitted to be cleared (each lot): Lot 1=35% Lot 2= 25%. This
and the previous requirement above for a 100' buffer address the public hearing
testimony expressing concerns over the removal of trees and the possible effects
that might have on water quality in the creek.
4. The following must be added as clauses to the C&Rs:
a. "A land area of a certain length and width where existing vegetation occurs prior
to the commencement of any grading or clearing activity. Vegetation shall be
maintained to achieve a minimum percentage of ground cover of 95%. To achieve
the percentage of ground cover, indigenous, drought tolerant vegetation shall be
planted. Survival of planted vegetation shall be 90% for a period of three years.
Maintenance activities within the buffer are limited to removing vegetation which is

6. All requirements of section 240-17 of the Southold Town Code have been met
recommend a Preliminary Plat determination at the March 17, 2014 public meeting.

While we have no problem with the applicants creating two lots where
one formerly existed, we have concerns that the consequence of
building two houses will be a significant reduction in the the number of
trees remaining after construction and landscaping of two residences.
We have already watched construction of a large house, then later
illegal clearing for open lawns and landscaping, and finally clearing for a
pool across the creek from our property. We fear this new property
development will negatively affect the water quality of the creek and-its
wetland habitat, as well as scenic values, so we would ask as a
condition of your approval, that the applicants landscape plalsbe
submitted, and monitored during and after construction.
We appreciate your diligence in protecting Southold's open spaces.

This proposal is for a Standard Subdivision of a 5.9 acre parcel into two lots where Lot 1 equals
1.5 acres and Lot 2 equals 4.4 acres, located in the R-40 Zoning District.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, the proposed action is CONSISTENT with the LWRP, provided
that the below recommendations are required in the subdivision approval.

The New York Department of State GIS- Public Access map was referenced for occurrence of
archeo-sensitive areas on site. The area is excluded from the archeo-sensitive areas.
To further Policy 5.4. Limit the potential for adverse impacts of watershed development on water
quality and quantity.
A. Protect water quality by ensuring that proposed expansion or intensification of existing
watershed development results in:
1. protection of areas that provide important water quality benefits.
It is recommended that the following best management practices be required to protect
water Quali!y of the aquifer and coastal waters:
1. Require the use of native, drought-tolerant plants in landscaping.
2. Prohibit the residential application and use of synthetic fertilizers and
pesticides capable of entering the potable water supply.
a. No fertilizers containing the primary macronutrients (nitrogen (N), phosphorus
(P), or potassium (K)) shall be applied between the months of December 1 and
April 1.
b. A maximum of 1 pound of nitrogen per 1000 square feet in any one application,
with a cumulative application of no more than 2 pounds per 1,000 square feet per
year is permitted.
c. The use of phosphorous containing law fertilizer comprised of more than 0.67%
phosphate is prohibited unless establishing a new lawn or soil test shows that the
lawn does not have enough phosphorus. Fertilizer labels have three bold
numbers. The first number is the amount of nitrogen (N), the second number is
the amount of phosphorus oxide (P2O5) and the third number is the amount of
potassium oxide (K2O). A bag of 10-5-10 fertilizer contains 10 percent nitrogen, 5
percent phosphorus oxide and 10 percent potassium oxide. The law limits the
amount of P2O5 to less than 0.67%. Therefore the phosphorus (middle number)
should be less than 0.67 for the product to meet the phosphorus lawn fertilizer
restriction.
3. Prohibit the use of underground storage tanks, (except those with spill,
overfill, and corrosion protection requirements in place).
4. Require that pervious driveways serve each lot.
To further Policy 6.3. Protect and restore tidal and freshwater wetlands.
D. Provide adequate buffers between wetlands and adjacent or nearby uses and activities
in order to ensure protection of the wetland's character, quality, values, and functions.
1. It is recommended that the Board require a 100' natural vegetated buffer from
the wetland line landward. Language for the buffer follows:
NATURAL VEGETATED BUFFER - A land area of a certain length and width where
existing vegetation occurs prior to the commencement of any grading or clearing
activity. Vegetation shall be maintained to achieve a minimum percentage of
ground cover of 95%. To achieve the percentage of ground cover, indigenous,
drought-tolerant vegetation shall be planted. Survival of planted vegetation shall
be 90% for a period of three years. Maintenance activities within the buffer are
limited to removing vegetation which is hazardous to life and property, trimming
tree limbs up to a height of 15 feet to maintain viewsheds, replanting of vegetation
and establishing a four-foot-wide access path constructed of pervious material for
access to public waters.

As per a request from your office, I have reviewed the Preliminary Plat for the Standard
Subdivision of Andrew Fohrkolb. This is a two lot subdivision with access from Greton Court has
been prepared by the office of John T. Metzger and has been dated 07/03/09.
Please consider the following:
1. Road work within the Town Right of Way of Greton Court must meet the minimum
requirements of the Town Highway Specifications.
2. Stormwater Management Control Plans will be required during building permit reviews for
each individual lot.
3. Maple Avenue, located on the westerly side of lot # 2, is private and very narrow. This
private driveway should not be used for access to the second lot. It is recommended that
C & R's should be developed to prohibit access from this locatirn.
4. The adjacent wetland, know as Long Creek, is an impaired TMDL waterbody. It is
recommended that this waterbody be protected from development by establishing a one
hundred (100")foot wide Non-Disturbance Buffer. This Buffer should begin at the Flagged
wetland limit line and extend landward up the slope. This buffer is approximately the same
setback already established by development of properties located on each side of the
subdivision.
5. Any consideration by the Planning Board to allow for access walking trails through this buffer
should be coordinated with the Town Trustees and it should be constructed in a mannerthat
would be protected from erosion.

Whenever the Code calls for a public hearing this section shall apply. Upon determining that an
application or petition is complete, the board or commission reviewing the same shall fix a time
and place for a public hearing thereon. Notice relating to a public hearing on an application or
petition shall be provided as follows:
A. Town responsibility for publication of notice. The reviewing board or commission shall cause
a notice giving the time, date,place and nature of the hearing to be published in the official
newspaper within the period prescribed by law.
B. Applicant or petitioner responsibility for posting and mailing notice. An application or
petition, initiated,proposed or requested by an applicant or petitioner, other than a Town
board or commission, shall also be subject to additional notice requirements set forth below:

The Southold Town Planning Board reviewed the above-referenced application
at their August 19, 2013 Work Session and found that all requested items
pursuant to §240-16 of the Southold Town Code have been met and that the
Preliminary Plat Application is complete. The application will now be referred
out for comments from the necessary agencies, and a review under SEQRA
begun for this unlisted action.
The Preliminary Plat Application states that a Letter of Water Availability has
been received from the Suffolk County Water Authority. A copy of the letter
must be submitted to the Planning Department for review.
Please be advised that the following will be required before a Final Plat
determination is issued:
1. During the Sketch Plan step, the Planning Board agreed to waive the
yield plat requirement subject to a covenant and restriction to be
placed on the property that will prohibit further subdivision of the
parcels. Please be aware that after the Planning Board receives and
reviews referral comments, the Board will require covenants and
restrictions to be placed on the property with a clause that will that will
prohibit further subdivision of the parcel.

where Lot 1 is 40,600 square feet and is proposed to be accessed via direct frontage on Greton Court,
and Lot 2 is 3.4 acres and will be accessed via a flag strip off Greton Court. Pursuant to the Yield Map
submitted with this application, the subject property can yield a total of four (4) lots and therefore this
proposal will result in a reduction in density by two (2) lots. Sketch approval was granted by the

The Southold Town Planning Board, at a meeting held on Monday, April 8, 2013,
adopted the following resolution:
WHEREAS, this proposal is for a Standard Subdivision of a 5.89 acre parcel into two
lots where Lot 1 equals 0.93 acres and Lot 2 equals 4.96 acres, located in the R-40
Zoning District; and
WHEREAS, on November 20, 2012, the agent submitted the required Sketch Plan
Application and Sketch Plans; and
WHEREAS, on December 17, 2012, the Planning Board at their Work Session agreed
to the following:
1. Accepted the Sketch Plan and ERSAP;
2. Found the application incomplete with a condition that the agent must submit proof
that the parcel meets lot recognition pursuant to §280-9 of the Southold Town
Code;
3. Agreed to waive the Yield Plat requirement subject to a covenant and restriction to
be placed on the property that will prohibit further subdivision of the parcels; and
WHEREAS, on February 19, 2013, the agent submitted proof that the parcel meets lot

Andrew T. Fohrkolb", dated August 29, 2012.
Sketch Plan Approval is valid for six months unless an extension of time is requested
and granted by the Planning Board. The next step in the subdivision process is the

This is a reduced yield standard subdivision. Lot 1, which fronts Greton Court and the
Town of Southold recharge basin, meets the minimum zoning requirements of the R-40
zone, with the property totaling 40,600 square feet. Lot 2 is a flag lot that fronts Long
Creek to the South and has 3.4 acres of buildable land.
V: Staff Recommendations
1. All material required to be submitted pursuant to §240-10 have been met except for
the following;
a. Proof the parcel meets the Lot Recognition requirement in Town Code.
b. Sketch Plat is missing the Key Map and the Zoning information.
c. The area of unbuildable lands must be delineated on the Sketch and Yield
Plat, and the size of the unbuildable land area stated on the plans.
d. The top of bluff must be marked on the plat and the yield plan corrected to
include the area seaward of the top of bluff as unbuildable land. Pursuant to §
275-2 a Bluff is defined as any bank or cliff with a precipitous or steeply sloped
face adjoining a beach or body of water. It is recommended that this bluff line
be delineated on the plat and included in the unbuildable land calculation. If the
applicant wishes to covenant that there will be no further subdivision of the
property in perpetuity, then there is no need to delineate the top of bluff and
the yield plan can be withdrawn, and the requirement for a yield plan waived by
the Planning Board.

The subject property is 5.89 acres, is zoned R-40 and is located at the terminus of Greton Court at the
north property,boundary and the terminus of Maple Avenue at the west property boundary. The site is
currently vacant. 'This proposal is for a voluntary reduced density two (2) lot standard subdivision plan
where Lot 1 is 40,600 square feet and is proposed to be accessed via direct frontage on Greton Court,
and Lot 2 is 3.4 acres and will be accessed via a flag strip off Greton Court. Pursuant to the Yield Map
submitted with this application, the subject property can yield a total of four (4) lots and therefore this
proposal will result in a reduction in density by two (2) lots.
In designing the configuration of the proposed lots, it was determined that locating Lot 1 adjacent to the
Town of Southold recharge basin would have the least impact on neighboring properties as well as the
on-site wetlands, which are over 500' from said lot. With respect to Lot 2, said lot is oversized and
therefore contains more than sufficient area within the lot to meet all applicable wetlands setbacks and to
site a residence away from the steeper slopes on the southern portion of the property as required by the
Town Code.

Given the limited scope of this project, which will result in the creation of only (1) additional lot, it is
respectfully requested the Planning Board approve the plans as submitted, particularly the ERSAP,
which contains more than sufficient information to assess the configuration of the lots. Any minor
changes to any of the plans can be made conditions of sketch approval and therefore reflected on the
preliminary and final plats. The most environmentally sensitive areas of the property are identified and
protected and any future development of these lots will be outside of the flood zone.
It is respectfully requested this application be scheduled for the next available Planning Board work
session in order to discuss the application with the Board and to address any concerns they may have.
