sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

AUTHORIZATION
Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
September 19, 2007, and in consideration of application fee in the sum of $250.00 paid by Roy & Linda Argent
and subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees
authorizes and pe~qnits the following:
Wetland Permit to remove and raise the roof, replace windows, repair or
replace all rotten wood, repair or replace foundation if needed, and for the existing
bulkhead, with the condition of a 10 foot of non-turf buffer along the bulkhead, no
treated lumber is to be used on bulkhead when repaired/replaced, gutters and drywells
installed to contain roof runoff, a line of staked hay bales to be installed prior to
construction, and as depicted on the site plans prepared by Roy Argent, received on
August 6, 2007.

The proposed additions and alterations to this existing single family dwelling, on a non-conforming
6615 square foot lot in the Residential R-40 District is not permitted pursuant to to Article XXIII
Section 280-122, which states;
"Nothing in this article shall be deemed to prevent the remodeling, reconstruction or
enlargement of a non-conforming building containing a conforming use, provided that such
action does not create any new non-conformance or increase the degree of non-conformance
with regard to the regulations pertaining to such buildings."
The existing single family dwelling notes a rear yard setback of 30.6 feet, a single side yard setback of
5.6 feet and a total side yard setback of 12 feet. The proposed additions and alterations will maintain
those setbacks. Pursuant to the ZBA's interpretation in Walz (#5309), such additions and alterations
will thus constitute an increase in the degree of non-conformance.
Persuant to Article XXIII Section 200-124, non-conforming lots, measuring less than 20,000 square
feet in total size, require a minimum rear yard setback of 35 feet, a single side yard setback of 10 feet
and a total side yard setback of 25 feet.
In addition, the proposed construction is not permitted pursuant to Article XXII Section 280-116 B,
which states;
"All buildings located on lots upon which a bulkhead, concrete wall, riprap or similar structure
exists and which are adjacent to tidal water bodies other than sounds shall be set back not less
than seventy-five (75) feet from the bulkhead."

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II category of
the State's List of Actions, without further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the
Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of
Planning issued its reply dated October 31, 2007 stating that this application is considered a matter
for local determination as there appears to be no significant county-wide or inter-community impact.
LWRP DETERMINATION: A Letter confirming inconsistency was submitted to the Board of Appeals
under Chapter 95, Waterfront Consistency Review of the Town of Southold Code and Local Waterfront
Revitalization Program (LWRP) standards. A report from the Suffolk County Soil and Water District
Technician Polly Weigand dated November 14, 2007 noted that the bulkhead is in structurally sound
condition, but regular inspections and repairs should be made to maintain stability. The LWRP
Report dated November 1, 2007 notes the house as being located in Flood Zone AE8. Grant of relief as
applied for in this variance application can be mitigated by following the recommendations of the
Suffolk County Soil and Water Conservation District and the Town LWRP Coordinator which include:
the installation of drywells at the terminus of the gutters and leaders on the dwelling, the installation
of hay bales/silt fencing during construction to prevent sediment loading into Richmond Creek, and
the planting of a non-turf, native vegetation buffer landward of the bulkhead to protect Richmond
Creek or as an alternative, maintaining turf grass but limiting the use of irrigation and fertilizer to
prevent damage to the bulkhead and pollution of the creek.
PROPERTY FACTS/DESCRIPTION: The applicant's 12 June 2006 survey prepared by Stanley J.
Isaksen Jr. shows 6,615 square feet of land area, 50 feet wide by 136.64 feet deep along the westerly
lot line, and an existing single-story residence with attached garage situated 30.6 feet from the
bulkhead adjacent to Richmond Creek, 5.6 feet from the easterly property line, and 6.3 feet from the
westerly lot, at its closest points. The applicant also owns County Tax Map (CTM) Lot 23 in Block 6,
upon which exists an accessory building, also shown on the applicant's 12 June 2006 survey.

BASIS OF APPLICATION: Request for Variances under Sections 280-122 and 280-116B, based on
the Building Inspector's September 10, 2007 Notice of Disapproval concerning a proposed new
dwelling, after substantial demolition of the existing building. In the event the applicant further
deterioration of the portion of the foundation that he plans to retain, the applicant also requests
demolition of this remaining portion, for total reconstruction of the dwelling in kind, in place,
proposed by applicant without a reduction of the same nonconforming setbacks that exists for the
current dwelling footprint.
AREA VARIANCE RELIEF REQUESTED: The applicant is requesting relief concerning new
construction which will be within the same nonconforming footprint and less than the code-required
minimum of 35 feet from the rear lot line, less than 75 feet from the bulkhead, less than 10 feet on a
single side yard, and less than 25 feet total side yard setbacks.
ADDITIONAL INFORMATION: The applicant's 6,615 square foot non-conforming lot in the R40
District is very narrow and deep at 50' x 136.64' which is typical of lots in this area that were
improved in the 1940's with summer cottages. The applicant's waterfront lot is reached from Indian
Neck Road though an earth-base driveway adjacent to the westerly property line that passes two
other lots, all previously owned by the applicant. The street-side property (CTM lot 23) contains an
accessory garage that is used by the applicant (granted with conditions under ZBA #4987). The middle
parcel (CTM 22) was sold and is improved with a single-family dwelling. The applicant has an existing
asphalt driveway on his property with an existing cesspool to the west. The existing dwelling is 30.6
feet for a rear yard setback where the code requires a minimum rear yard of 35 feet, a single side
yard setback of 5.6' where the code requires 10', and a total side yard setback of 12' where the code
requires 25'. The setback from the bulkhead also is 30.6' at the closest point where the code requires
75 feet.
The applicant proposes to demolish the existing dwelling on the subject premises which is structurally
unsound, in general disrepair and contaminated with excessive mold, and replace it in kind with a
new dwelling, with modifications to roof pitches at a proposed 27' 0" height. The current attached
garage will be converted to living space in the new dwelling. The applicant states that he wishes to
maintain the footprint of the existing foundation, which is currently a partial full basement and partly
a crawl space. To bring the foundation to code, repairs will be made to the existing block foundation of
the old cellar as needed, and the crawlspace portion will be excavated an additional 3' deeper to create
basement storage at full height. The entire foundation will be raised an additional 8" above grade
from 10.9' to 11' which will place the new first floor at or above the minimum FEMA requirements for
a flood plain. A new covered open porch entrance with railing is proposed on the front elevation, in
line with the existing elevation, in the location of the setback of the existing attached garage. These
details are shown on an undated set of plans drawn and submitted by the applicant Roy Argent
(formerly owner-contractor of Argent Homes and now retired).
It is further noted, however, that in the event replacement of the only remaining portion of the
foundation that applicant is trying to maintain is necessary, that in-place reconstruction is authorized
using the same building footprint which now exists.

REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Town Law §267-b(3)(b)(3)(1). Grant of the variance will not produce an undesirable change in the
character of the neighborhood or a detriment to nearby properties. The current modest one-story
dwelling has been on the property since the 1940's and is in disrepair. It will be replaced with a new
single-family home on the same footprint, with only minor modifications that will improve the
property and the neighborhood. There were no objections from neighbors received in writing or
expressed at the public hearing.
2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method,
feasible for the applicant to pursue, other than an area variance, since all current setbacks are pre-
existing non-conforming, and the lot is too narrow to permit the construction of a modest home
without non-conforming side yard setbacks being maintained. The current house and foundation were
sited (prior to 1957) at an angle to the side yard property lines and parallel to the creek. The neighbor
to the west is located at considerable distance from the shared property line, and there are no
obstructions to accessing the Creek. Removing the existing foundation and building a new one that is
parallel to the property line could increase the applicant's westerly side yard setback to 8' which
would permit access by emergency equipment on the applicant's property. However, the house would
then be at an unnatural angle to the Creek, and filling in and excavating a new foundation would
cause substantially greater land disturbance near the bulkhead and disrupt the existing sewer line to
the dwelling, both at considerably greater expense to the applicant. Moving the proposed new dwelling
landward of its current footprint to create a more conforming setback to the bulkhead would require
building over the existing cesspool and the neighbor's well.
3. Town Law §267-b(3)(b)(3). The variances granted herein are substantial but reasonable given all
the other circumstances described herein.
4. Town Law §267-b(3)(b)(5). The difficulty has not been self-created, but it the result of the original
location of the house, wells and cesspool as described herein.
5. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this
residential community will have an adverse impact on the physical or environmental conditions in the
neighborhood. Should the applicant's bulkhead require maintenance and repairs, Roy Argent, the
representative for the applicant, testified at public hearing that equipment could be brought in by
barge on Richmond Creek, thus providing access without adverse impact on the land between the
house and bulkhead, or the westerly neighbor's property.
6. Grant of the relief as applied for is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of a new replacement dwelling while preserving and protecting the
character of the neighborhood and the health, safety and welfare of the community.

RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member
Goehringer, and duly carried, to
GRANT the variance as applied for and shown on the set of plans and elevations drawn and
submitted by Roy Argent, contractor (retired) of Argent Homes, undated, and the site survey by
Stanley J. Isaksen Jr., Licensed Land Surveyor, dated 12 June 2006, updated 04 Sept 2007, and
notes by the applicant clarifying possible rebuild/demolish areas, subject to the following
Conditions:
1. Gutters and leaders must be installed on the dwelling.
2. Drywells must be installed to contain roof and groundwater runoff away the bulkhead.
3. Hay bales/silt fencing must be installed during construction to prevent sediment loading into
Richmond Creek.
4. A non-turf, native vegetation buffer landward of the bulkhead must be planted to protect
Richmond Creek,
or as an alternative, turf grass is acceptable if the use of irrigation and fertilizer is limited to
prevent damage to the bulkhead and pollution of the creek.
5. Applicant agrees to inspect and repair the bulkhead as necessary according to the
recommendations outlined in the Report from Soil Technician Polly Weigand dated
November 14, 2007.
The above conditions shall be written into the Building Inspector's Certificate of Occupancy, when
issued.
Any deviation from the variance given such as extensions, or demolitions which are not shown on the
applicant's diagrams or survey site maps, are not authorized under this application when involving
nonconformities under the zoning code. This action does not authorize or condone any current or future use,
setback or other feature of the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that
does not increase the degree of nonconformity.
