Dear Gentlemen,
Since the contract of sale on my Greenport building has been
voided, I am herein requesting the withdrawal of my board of appeals
application for a change of use (as idicated to Linda Kowalski on
June 9, 1989) and the return of my check payable to Southold Town
Clerk dated May 11, 1989 in the amount of $150.
I am sorry for this incovenience and sincerely hope that another
purchaser will be found for this building. It should be noted that
the previous contract vendee has experienced some personal problems
whic-h prevented him from moving ahead which in no way reflected a
change of attitude or displeasure with making the building 'a fine
beauty salon.

Gentlemen:
I represent Robert A. Celic who has contract,d to
buy some property near the village of Greenport from a woman
whose name is Gladys Csajko. I am enclosing a photocopy of the
description in the contract.
This proposed sale is contingent upon my client obtaining
municipal approval to use the subject premises as a real estate
office. This approval must be obtained no later than the last day
of next month February 28th. I should like to have you advise me
if the zoning ordinance of the town of Southold will permit the
use of the premises for the designated purpose of a real estate
office.
Mr. Celic presently operates a real estate office in
Mattituck but he wishes to open another office near Greenport.
If the zoning ordinance presently permits the requested
use and it might be obtained by filinq a petition to the Gown
pleasc forward whatever forms may be required for that purpose
and we will file a petition to have the real estate office use
granted. Also please advise me what is required to bring this
about.
I shall appreciate hearing from you at your earliest
convenience.

1. STRICT APPLICATION OF THE ORDINANCE would produce praCtical difficulties or'unneces-
sary HARDSHIP because property would not be sold due to l a~k.of prope~r
zoning under the current Master Plan and owner
to limited uses despite CO #Zl1464 issued by the Southold Building
Department and dated February 7, 1983 which appears to indicate
otherwi se.
Applicant herein indicates that this property has been actively
marketed as an "open listing" to numerous real estate brokers during
the last four months and current contract vendee is the only
customer sincerely interested in subject property with a use
acceptable to the aforementioned applicant. Substantial financial
hardship would be experienced by applicant should this "resonable"
nonconforming "revision" of use be denied.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because none of the properties in the
immediate or adjoining area are presently for sale.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the proposed beauty salon use would be
totally consistent with the current utilization of the premises as
a "personal service-oriented type" business (i.e. realty office)
and the structure, traffic volume and business hours would be
essentially the same, if not less. Contract vendee expects to leave
the building and grounds just as they exist.
