Harbor City Boulevard, Apt. 215 Melbourne, FL 32935 Re: Appeal No. 3355 - Paul and Marietta Canalizo (Variance) Dear Mr. Hines: This letter will confirm that the members of the Board of Appeals reviewedyour recent correspondence to Supervisor Murphy of February 19, 1987., with map enclosure. In further researching the st'atus of this project with the agencies, it appears that: (1) By letter dated February 3, 1987, the application before the Southold Town Trustees for Permit (#271) was withdrawn due to inaction; (2) By letter dated August 15, 1985, the application before the N.Y.S. Department of Environmental Conservation was suspended (a Draft Environmental Impact Statement was not submitted for reviews by their agency). (3) By our letter dated May 21, 1985, we requested the elevations above mean sea level of the lowest floor ~ince this property is located in an "A-8" Flood Zone. The first floor elevations were provided by Mr. Canalizo at 12 feet. If you wish, you may submit a copy of the construction plans which would show the construction below the first floor. Crawl-space type of construction below the first floor wb~ld appear to meet the minimum eight-ft, elevation above mean sea level (if it does not exceed a height of four feet). Harbor City Blvd. Melbourne, FA 32935 #215 Dear Mr. Hines; In my letter of February 2, 1987, I informed you that the Board of Appeals had requested a copy of the foundation plan showing the lowest floor elevation at the lowest corner of the house and a survey indicating the setback of the leading edge of wetland grasses from the proposed house. This information was requested by the Board of Appeals because the Building Department denied a building permit. The Building Dmpartment cannot issue a permit unless a variance is approved by the Board of Appeals. I have forwarded the map you sent to my office to the Board of Appeals. The Building Department's file shows a denied building application on the grounds of insufficient setback. An application was submited by Paul Canalizo to the Board of Appeals (with a notarized letter from you, granting permission for Mr. Canalizo to proceed with the appeal). The files from the Board of Appeals show that a request ~was made by the board, to Mr. Canalizo, requesting a copy of the foundation plan and a map showing the lowest floor elevation at the lowest corner of the house. A survey was also requested indicating the setback of the leading edge of wetland grasses from the proposed house, as of February 2, 1987, neither have been submitted. The application cannot be addressed until this information has been received. I hope this information helps you to understand the Town's position regarding this propoerty.
