After reviewing this matter, it is the position of the board that once the following have been received, a date to reconvene the public hearing on the pending Special Excep- tion for the motel complexes could be scheduled and readvertised: 1. Receipt of copy of signed contract(s) between the property owner and the Village of Greenport for the sewage and water hook-ups; [requested at our 8/23/84 hearing] 2. Receipt'of a copy of an Amended Certificate or other updated review by the Building Inspector concerning applicant's amended site plans, for either the motel complexes or the garden-apartment complexes, which we understand has been submitted to the Planning Board~as of September 3, 1986; 3. Receipt of written preliminary approval or comments from the Planning Board on either of the amended site plans; 4. Receipt of a copy of waiver or action by the Suffolk County Department of Health under the rules of Article 6. Monsell Superintendent of Public Utilities cc: Mr. William Lieblein RESOLUTION ADOPTED AUGUST 22, 1985 BY VILLAGE OF GNEENPORT BOARD OF TRUSTF~ A motion was made by Trustee David Kapell and seconded by Trustee William Lleblein to adopt the following resolution: Resolution Whereas~ Whereas, Whereas, the water supply in the Town of Southold is known to be limited in quantity and in quality, and the Village of.Greenport Water System has the franchise to serve a major portion of the Town, and in recent months, requests for new water service from the system have increased at an unpreced~nted rate, and Whereas, the Village Board is concerned about the system's ability to meet the demand with its existing plant, Now Therefore Be it Resolved that the Village Board will conduct a study and evaluation of the existing system and the potential for In- creased supply and service within the franchise area. Said study and evaluation is to be conducted through the Greenport Utility Committee and Superintendent of Utilities with the assistance of the Village engineering firm. Assistance will also be sought from the Town of Southold and the Suffolk County Department of Health Services, and Be It Further Resolved that in order to allow proper eonduet of the study and evaluation, the Board will place a six month moratorium from the date hereof on any further contracts for water service to be located outside the Incorporated Village of Greenport, and that this morator um shall apply to all applicants which are currently pending, and that this moratorium is not intended to prohibit connection to the syste~by single residential units or minor subdivisions. Raynor, Jr., as Agent for Mr. Aliano concerning a determination as a result of the recessed hearing. In checking with the Planning Board, it appears that two different plans are before them, one for motel units and the other for 25-garden- apartment complexes. It was the Planning Board's concern that the garden-apartment proposal was.over-intensified (as to density), and [he'Planning Board and the applicant are continuing reviews on this newly received proposal. It is the position of this board that once the following have been received, We would be in a position to sch6dule the Special Exception for the motel complex, if this was the step desired by the applicant: 1. Per discussion with applicant at 8/23/84 ZBA meeting, await receipt of'signed contract between the applicant and the Village of Greenport concerning the sewage and water system hook-ups necessar~ to determine maximum-permitted density in this zoning district'and well as environmental reviews); 2. Just to claify our discussion on Nicholas A£iano's property in Greenport, it is now our understanding that the density permitted, which we discussed at a prior meeting with your board, it is the current feeling, of the, Doard that the intensity is not justified. With respect to the current thinking of the board that this is an over-intensification, we respectfully revert to our original proposal of a motel use on the property and would request the board to forward to us the current criteria necessary to activate this site plan. I have also informed Mr. Aliano that we will proceed with revising the major subdivision at Peconic, addressing building lines of not less that 160' south of Route 48. The Board feels that this proposal would not be in conformance with the surrounding area, however, a multiple-type use as existing to the east of the property would be more in conformance with the area. Goehringer, Chairman; Serge Doyen, Jr.; Charles Grigonis, Jr.; Robert J. Douglass and Joseph H. Sawicki. Also present were approximately 35 persons in the audience. The Chairman opened the meeting at approximately 7:37 p.m. and proceeded with the first recessed hearing, as follows: RECESSED PUBLIC HEARING: Appeal No. 3259: Upon application of NICHOLAS ALIANO, 3800 Duck Pond Road, Cutchogue, NY for a Special Exception to the Zoning Ordinance, Article VI, Section lO0-60(B)[1](b), Article V, Section 100-50(B)[4] for permission to establish and build four two-story motel buildings containing 10 motel units for transient use, and an office building of 2,500 sq. ft. in area on this 3.72J-acre parcel located at the South Side of Main Road, Greenport, NY. CHAIRMAN: This hearing was recessed from the last meeting and we'll ask Mr. Aliano if he has additional information he would like to tell us. MR. ALIANO: None, thank you. MR. CHAIRMAN: I'll ask anybody in the audience if they'd like to speak in behalf of this application. Anybody like to speak against this application? (No one) The Planning Board Chairman and myself did meet concerning your application, Mr. Aliano, and Southold Town Board of Appeals -2- (Appeal No. 3259 - NICHOLAS ALIANO, MR. CHAIRMAN (continued): August 23, 1984 Regular Meeting continued:) contract, I've got to get Twenty thousand dollars it's And the Planning-- the situation is like this. If we were to close the hearing, as we mentioned to you at the last meeting, any changes in the application would require a new application on your part. It has been the sugges- tion of counsel and the suggestion of the board that we continue your application in open recess until such time that you supply us with contracts from the Village of Greenport concerning sewage and water; and at that particular time, once you supply us with that, we'll, at the next Regular Meeting, we'll close the hearing and make a decision, in your behalf. I hope it's favorable. Whenever you supply us with that information. MR. ALIANO: Before I get a signed them "X" amount of dollars, thousands. costing us. And-- MR. CHAIRMAN: That's up front? MR. ALIANO: At the signing of the contract. · from what I understand, the Planning Board before they want to make any changes or whatever, they want to know from you whether it's feasible or whether you agree to this type fo a unit going in there before they go any further even with their-- I'm just getting bounced back and forth here. MR. CHAIRMAN: No, really you're not. As soon as you give us that, can't you make those contracts predicated on the zoning? MR. ALIANO: Let me ask you this. Can you just say subject to getting--you've got the letters there that they committed themselves to the water and sewage; isn't it possible for you to say, it'll be "all right with us subject to a contract," or something? MR. CHAIRMAN: I could do that before the letter came out in the newspaper two weeks ago. It was said that they are talking about a moratorium on this now. So that's all I can tell you at this point. This is what our counsel has suggested. MR. ALIANO: A moratorium. Yeah. But in speaking to Mr. Monsell, he said you just got in under the wire, and that would cover us, we're supposedly the last one to get in under the wire. Not subject to this moratorium. Don't take my word for it-- MR. CHAIRMAN: No, no-- I can appreciate that. MR. ALIANO: I've gone through two years of this and I don't think it's right that I got to keep getting bounced. I'll never get this thing underground. From the Planning Board's point of view, all they wanted is, is this feasible--do you agree to a motel, if you don't think a motel is feasible with 40 units there, say it or not say it. -So'uthold Town Board Appeals -3- August 23, 1984 Regular Meeting (Appeal No, 3259 - NIC~IOLAS ALIANO, continued:) MR. ALIANO (continued): that's all. You know. That's all they want to know. They want to go ahead. There's a lot more work to be done. MR. CHAIRMAN: You have to understand it. I can't speak for this board. I-- MR. ALIANO: Ok. I'm talking to the board when I'm talking. MR. CHAIRMAN: As an individual, ok, certainly in your hearing, the last hearings no one came down in opposition to your application, ok. And as you know, we have filled this room many, many times with motel and multiple dwelling applications,change of uses of zoning, etc. people are looking for in this town. So I would say that appears favorable, and I, you know, as an individual n~ specifically the chairman, I personally feel that, it's the area, based upon the Driftwood Cove area, and so on and so forth. That's all I can say. MR. ALIANO: If the board don't want to work with me on this thing, and work with me to accomplish this, then I'll just throw my hands out. MR, CHAIRMAN: No, I wouldn't throw up your hands. You can't sign these contracts predicated to the zoning for the proper applica- tion? MR, ALIANO: Well, without paying any money, I don't know. How are they going to take it. The contract is not a contract unless money changes hands. And I don't see, and I'm talking to the board now, I can't see why the board can't say, "if he doesn't get water and sewage, the contract is no deal." I don't see what the harm is. And MR. CHAIRMAN: Basically, our decisions go with the land. So it can't be an either-or decision. In other words, it can't be 18 units without or 40 units with. Ok? It's got to be a mandated decision by the courts; it's upheld by the courts, ok, or overturned by the courts, and it has got to be one specific thing. It's can't be an either-or situation. MR. ALIANO: If I can't put 40 units, I'm not going to build there. MR. CHA!RMAN: I understand that. ALIANO: Well anything cart be done. MR. CHAIRMAN: It was also brought to my mind, the Planning Board is going to re-review this at their September meeting. As I said, get us the contract. As soon as we see them, we'll put them on the agenda for the next hearings and we'll close the hearing and make a decision thereafter. MR. ALIANO: You can't make a decision without that? MR. CHAIRMAN: I can't make a decision because it's going to be an either-or decision, and I can't make an either-or decision. It's got to be a definite decision. MR. ALIANO: Ok. MR. CHAIRMAN: All right?
