THIS INDENTURE made this 4-F4 day of �p0(4,n &,- r' nineteen hundred
and ninety eight BETWEEN WILLIAM M. BOGER, residing at
1425 Bayshore Drive
Englewood, Florida 34223
party of the first part and GERTRUDE E. BOGER, residing
at 1425 Bayshore Dr.
Englewood, Florida 34223
party of the second part,
WITNESSETH, that the party of the first part, in consideration
of One Dollar, lawful money of the United States, paid
by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors
and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings
and improvements thereon erected, situate, lying and being in the
Town of Southold, Suffolk County, Long Island, New York, bounded
and described as follows :
Beginning at a monument at the northerly corner of land conveyed
by WILLIAM B. BOGER to the party of the first part by deed
dated 28 December 1956 and recorded in Liber 4391 page 594 on the
southeasterly line of a certain 16 . 5 foot right of way as described
in said deed; said point of beginning being at the easterly corner
of land of Palmer and the westerly corner of land of Bunce; from
said point of beginning running along said land of Bunce, S. 18°30 '
E.-108 . 0 feet; thence along land conveyed to ROBERT B. BOGER,
2 courses. as follows :
(1) S .58°00 'W.-47 . 0 feet; thence
(2) S. 23000 'W.-110 feet, more or less, to ordinary high water mark
of Corey Creek; thence northwesterly along said high water mark,
140 feet, more or less, to said land of Palmer; thence along said
land of Palmer, N.46°38 ' 50"E.-150 feet, more or less, to the point
of beginning.
Together with a right of way 16 .5 feet wide beginning at a point
16 . 5 feet southwesterly from the point of beginning of the premises
and running in a general northeasterly direction to Bayview Road,
said right of way being described in said deed Zebroski executed
to WILLIAM B. BOGER and recorded in Liber 2548 page 255 Suffolk
County, Long Island, New York.
Subject to a right of way 10 feet wide described as follows :
beginning at the point of beginning of the premises and running along
said land of Palmer, S . 46°38 ' 50"W.-16 . 5 feet; thence across the
premises 3 courses, as follows
(1) S29° 12 ' 20"W.-48 .76 feet; thence
(2) S.3°30 'E.-54 . 99 feet; thence
(3) S .37030 'E.-36 .72 feet to said land conveyed to ROBERT BOGER;
thence along said and,N. 230001E.-11 . 49 feet. thence across the
premises 4 courses, as follows :
(1) N.37030 'W.-28 . 0 feet; thence
(2) N. 3030 'W.-49 . 0 feet; thence
(3) N.29°12120"E.-44 . 30 feet; thence
(4) N. 46038150"E.-10 .33 feet to said land of Bunce; thence along
said land N. 18°30 'W.-11 .02 feet to the point of beginning.
Being part of the same premises conveyed to said WILLIAM B. BOGER
and CLARA M. BOGER, his wife, by deed executed and delivered by
JULIUS ZEBROSKI dated April 6, 1946 and recorded in the Office of
the Clerk of Suffolk County, New York, on April 8, 1946 in liber
2548 of conveyances, page 255 .
TOGETHER with all rights, title and interest, if any, of the party
of the first part in and to any streets and roads abutting the
above described premises to the center line thereof.
TOGETHER with the appurtenances and all the estate and rights of
the party of the first part in and to said premises .
TO HAVE AND TO HOLD the premises herein granted unto the party of
the second part, the heirs or successors and assigns of the party
of the second part forever.
AND the party of the first part, in compliance with Section 13 of
the Lien Law, covenants that the party of the first part will re-
ceive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first
for the purpose of paying the cost of the improvement and will apply
the same first to the paymnent of the cost of the improvement before
using any part of the total of the same for any other purpose.
