a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall fie kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.
APPLICATION IS HEREBY MADE to the Building Department for the issuance of a Building Permit pursuant to the
Building Zone Ordinance of the Town of Southold, Suffolk County, New York, and other applicable Laws, Ordinances or
Regulations, for the construction of buildings, additions, or alterations or for removal or demolition as herein described. The
applicant agrees to comply with all applicable laws, ordinances, building code, housing code, and regulations, and to admit
authorized inspectors on premises and in building for necessary inspections.

FINDINGS OF FACT
PROPERTY FACTS/DESCRIPTION; Applicant's property is located along the north side of the
Ma n Rbad (a/k/a~Stete Route 25) in Southold The lot co~1~ists of 7500 sq ff. with 60 ft. frontage
along the Main,Road and a.dapth of 125 feet. The property i~ improved with a one-story trailer and
accessory freme, garege as shown on the survey map prepared by Anthony W. Lewandowski. L.S.
dated October 2, 2000.
BASIS OF APPEAL Building.Inspector's Notice of Disapp~va~ dated March 5, 2001 denying an
application dated. January 2, 2001 for a permit for lot creafi~pn with existing structures, under the
current regulations, A,..ticle XV, Section 100-151 for the re~son the lot does not meet the size
requirement of the current zoning ordinance of 80,000 sq. fi. in the R-80 Zone, and A~cta XX1V,
Section 100-244B for the reason the side yard setback of e~itsfing structures are ~ess than ten (10)
feet
AREA VARIANCE RELIEF REQUESTED: Applicant reques~ts area variances for a lot created in
~1~158, whiCh' sizeis less than 12,500 sq. fi. and,lot width of 11~0 feet, the minimum provided in Bulk
SChedule AA for the time period between April 9, 1957 and D~:ember 1,197t~ Also requested are
sethack variances fora'dwelling structure (trailer) which doe~ net meet the current code setbacks
for a principal dwelling at 10 feet minimum on one side, and Ifor an accessory garage at less than
three (3) feet from the property line for propel~ies containing 1/'500 sq. ff.
INFORMATION AND EVIDENCE:
Tt3e Zonin~l Board held a public hearing on April 5. 2001 on this matter, at which time
written and.0ra! ;t~stimony~was presented. Based upon allltasflmony, documentation and other
evide~ca, the Board finds the following findings of facts to boi true and relevant:
A. The lot and trailer on it have existed since 1958 with ~o apparent harm or detriment to the
community. No testimony was presented during the Rublic hearing to suggest that the size
of the lot has had an adverse impact on the neighbdrhood or altered the character of the
neighborhood during the 44 year~ of its existence.
B. The lot was created by deed dated April 23 1958, wr~ich was recorded in the Office of the
Suffolk C6~nt~ C ark on April 28, 1958 at L~ar 4453 I~age 73,

REASO,N~S~, FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personatlnSpect~or~ the Board makes the following findings:
1. Grant 'of an area variance will not prods_me an undesirable change in the character of the

deterioreted~ and the tot:could not be improved.
3. The requested area vadance is substantial
4. Grarit of the variances will not have an adverse effect or impact on the physical or environmental
conditidns in the Oeighborhood or district. No. evidence was presented to suggest that the physical
or environm~ntat;conditions in the neighborhood would be adversely impacted.
In considering this application, the Board deems this action to be the minimum necessary and
adequate to enable applicar)t to enjoy the benefit of a new dwelling, replacing the existing
nonconforming trailer; while at the same time preserving and protecting the character of the
neighborhood, a~d the health, safety, welfare of the Community.
BOARD RESOLUTION: Now, therefore, on motion by Chairman Goehdnger, seconded by Member
DiniziO,,,it' was
RESOLVED, to APPROVE the application as applied for, SUBJECT TO THE FOLLOWING
CONDITIONS:
1. The applicant shall remove, the trailer from the property within three years of the date of
this decision;
2. The applicant agrees to maintain the trailer in good condition so that it does not become
