BETWEEN JOHN M. McINTYRE and KATHERINE M. McINTYRE, his wife,
both residing at 2 Hazel Road, Port Washington, NY 11050
party of the first part, and KENNETH L. KALEITA and LINDA D. KALEITA, his
wife, both residing at . 38 Arrowhead Lane, East Setauket, NY 11733
party of the second part,
WITNESSETH,that the party of the first part,in consideration of Ten Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the Town of Southold, County of Suffolk and State of
New York, known and designated as Lot 34 , as shown on a certain
Map entitled, "Map of Harbor Lights Estates , Section One, Bayview,
Town of Southold, Suffolk County, New York" , made by Otto W.
Van Tuyl fi Son, Licensed Land Surveyors, Greenport , New York,
and filed in the Office of the Clerk of the County of Suffolk
on June 8, 1965 as Map No. 4362 , said Lot being bounded and
described as follows :
BEGINNING at a point on the easterly side of Brigantine Drive;
said point being South 25 degrees 54 minutes 50 seconds West ,
455 . 00 feet as measured along the easterly side of Brigantine
Drive from the intersection formed by the northerly side of
Harbor Lights Drive with the easterly side of Brigantine Drive;
RUNNING THENCE South 64 degrees .05 minutes 10 seconds East ,
168 . 74 feet to a point on the westerly side of Paradise Shore Road;
THENCE South 19 degrees 13 minutes 20 seconds West along said
road, 120 . 82 feet to a point;
THENCE North 64 degrees 05 minutes 10 seconds West 182 . 82 feet
to a point on the easterly side of Brigantine Drive;
THENCE North 25 degrees 54 minutes 50 seconds East along said
Drive, 120 . 00 feet to the point or place of BEGINNING.
Grantors herein are the same persons as the grantees in deed
recorded 11/6/72 in Liber 7276 page 343.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The ttrord "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
