Kleinfeld This letter will confirm that the following action was taken by the Board of Appeals at our Regular Meeting held last evening concerning the above matter: WHEREAS, on September 15, 1988, a Notice of Disapproval was issued in the proposed construction of an addition within 75 feet of an existing bulkhead at premises identified on the Suffolk County Tax Maps as District 1000, Section 37, Block 4, Lot 8; and WHEREAS, on September 19, 1988, an application for a variance was filed requesting relief under Article XI, Section 100-119.2B; and WHEREAS, upon conferring with the Z.B.A. Office Staff, the jurisdiction of the Board of Appeals was briefly outlined; and WHEREAS, the applicant has subsequently been able to obtain a building permit for an alternative plan, without a variance; NOW, THEREFORE, BE IT RESOLVED, that due to the above circumstances, a refund of the $150.00 fee be and hereby is recommended. Box 728, Southold, N.Y. 11071 Dear Sirs: I respectfully petltion the Board of Town Trustees for a waiver of Wetlands Permit and in support thereof state as follows: The addltion planned for the front or street side of the house faces on Cedar Lane. In no way does the addition lmpact or affect the bulkheaded area in the rear of the house. The same may be said for the proposed 8' by 20'foot deck on the front sid~ of the house. The proposed extension of the existing dec ~e or bulkheaded side of the house likewise in no way impacts or affects the waterfront. There are no wetlands as such on my lots which have been bulkheaded along with the abutting houses on Spring Pond since 1950. The proposed construction as described above in no way changes the character of the area, does not change or affect the lineage of the abutting houses, nor does it in any way affect the environment or the ambience of the neighborhood. In fact it enhances it. I inherited the house from my father who died in 1987. It was sadly neglected due to his old age and infirmity. What I am proposing will be welcomed by the house owners abutting the pro- perty and all those in Gardiner's Bay Estates because the house as it exists is sadly neglected (a mess) and it will be a welcome sight to all, not only myself and my family. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulti~~l~,:' sor¥ HARDSHIP because the subject house, built circa 1940 is unsightly, poorly maintained,lacks decent cooking facilities and has two bedrooms. I inherited the house from my surviving parent, father.My four daughters, spouses and four grandchildren would very much,and it is reciprocated, like to visit us from Florida, their residences.They cannot for lack of adequate accomodations.The proposed additions and dormer attic would provide two bedrooms and two baths by the addition of an 8' by 20' addition to the front(street side) of the house. Failing this improve- ment, we would be deprived,as well as my children and grandchildren, of the many pleasures that are available to us here. I have been coming andliving in this house since I was eight years old. I hate to leave it. If I am prevented from improving it I must sell it or demolish it.I would be loathe to consider either alternative.This has been our house for 48 years. 2. The hardshipcreatedis UNIQUEandisnotshared by all properties alike in the immediate vicinity of this property and in this use district because all of the houses on Spring Pond, Cedar Lane,have been enlarged or improved. This applies to all houses with bulkheaded frontage in Gardiner's Bay Estates. In all cases these houses were and are less than 75 feet from the bulkhead or water frontage when they were constructed or added to by construction. My house has not been improved since about 1945 when two bedrooms were built and an enclosed porch in 1950. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because The proposed addition adds an 8' wide by 20' long attachment to the front of the house, on Cedar Lane. Thus, [here is no encroachment on the back or bulkheaded side of the house which could in any way impact upon, vary from the lineage of the abutting homes nor be considered a nuisance by the abutting nor any other houses on the waterfront or in the vicinity. It is also significant that the New York Department pf Environ- mental Conversation after investigation of our petition concluded that a permit is not required from that agency to construct an ex- tension onto the existing deck on the bulkhead side of our property.
