Section 280-15(F) and Article XXII 280-105A, and the Building Inspector's December 20, 2011,
amended January 19, 2012 Notice of Disapproval based on an application for building permit to build a
tennis court with fence surround on a vacant lot, at: 1 ) use of a tennis court is not permitted on a vacant
lot (without a principal dwelling), 2) accessory structures at less than the code required principal
setback of 50 feet, 3) tennis court fence at more than the code required maximum height of 4 feet in a
front yard, located at: 9105 Skunk Lane (adj. to Little Creek, dredged canal) Cutchogue, NY.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my determination that the proposed action is
CONSISTENT with the LWRP review provided that the following best management practice is required
to further Policy 6.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem
6.3 Protect and restore tidal and freshwater wetlands.
Maintain bufferS to ensure that adverse effects of adjacent or nearby development are
avoided:
Maintain buffers to achieve a high filtration efficiency of surface runoff.
Avoid permanent or unnecessary disturbance within buffer areas.
Maintain existing indigenous vegetation within buffer areas.
If the action is approved, it is recommended that a perpetual NATURAL VEGETATED BUFFER be
established to include all remaining vegetation from the wetland line landward. An example definition is
provided for your use:
NATURAL VEGETATED BUFFER - A land area of a certain length and width where existing
vegetation occurs prior to the commencement of any grading or clearing activity. Vegetation shall be
maintained to achieve a minimum percentage of ground cover of 95%. To achieve the percentage of
ground cover, indigenous, drought-tolerant vegetation shall be planted. Survival of planted vegetation
shall be 90% for a period of three years. Maintenance activities within the buffer are limited to removing
vegetation which is hazardous to life and property, trimming tree limbs up to a height of 15 feet to
maintain viewsheds, replanting of vegetation and establishing a four-foot-wide access path constructed
~)f pervious material for access to the water-body. [Added 12-15-2009 by L.L. No. 15-2009]
Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

(1) Au uodesirable change will not be produced itt the CIIARACTER of tile neighborhood or a
detriment to nearby properties if granted, because:
The property is vacant and has many trees so the tennis court will not be visible from the road.
None of the neighboring properties will be impacted by the tennis court the distance between
property lines insures that.
(2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the
applicant to pursue, other than all area variance, because:
The applicant owns the developed property to the south and there is not enough space for the tennis court without placing it
close to the water side of the property which would have a negative impact on the shoreline. Additionally due to estate planning
the applicant would like to retain the vacant lot and be able to use it for recreational purposes. The applicant is willing to place
covenant & resthctions on the property and tennis court as noted in ZBA decision #6359, Mandelbaum.
(3) The amount of relief requested is not substantial because:
The relief requested is substantial however the applicant is wiling to place covenants and
restrictions on the tennis court as the Board sees appropriate to mitigate and neighbor concerns
or future possible conflicts.
(4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions
in tile neighbochood or district because:
The proposed tennis court is shown at 195 feet from the wetlands and 70 feet off the road, It will
be well screened and the fence will be black chain link no higher than 6.5 feet, No lighting is
proposed and the tennis court will be used seasonally and only during day light hours.

land is vacant, fiat with wetlands in the rear area of the property. A tennis court is not permitted on vacant land without a principal
dwelling, but due to the location of the dwelling on the adjoining property a tennis court would have a negative impact on the
water side and this is the only area large enough to accommodate a tennis court.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations &each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
