Request for Variances from Article XXIII Section 280-124 and Article XXII Section 280-116 and the
Building Inspector's January 6, 2012 Notice of Disapproval based on an application for building permit
for demolition and reconstruction, including first floor additions and new second story at: 1 ) less than
the code required minimum side yard setback of 10 feet; 2) less than the code required combined side
yard setbacks of 25 feet; 3) less than the code required minimum bulkhead setback of 75 feet, located

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my determination that the proposed actions is
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP.
Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

The proposed construction on this non-conforming 12,375 sq. fi. lot, is not permitted
pursuant to Article XXIII Section 280-124 which states;
"This section is intended to provide minimum standards for granting of a building
permit for the principal buildings of lots which are recognized by the town under
280-9, are nonconforming & have not merged pursuant to 280-10."
For lots less than 20,000 sq. ft., the required side yard setbacks are 10'min. &
25'combined. The proposed construction indicates a minimum side yard setback of 9.7'
and approx. 19.5'combined.
In addition, the proposed construction is not permitted pursuant to Article XXII Section
280-116 which states:
"All buildings or structures located on lots upon which a bulkhead .... and which
are adjacent to tidal water bodies other than sounds shall be set back not less than 75 feet
fi.om the bulkhead."
The proposed Ist & 2"d story decking is indicated at 68.7' from the bulkhead.

a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buddings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in pan for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

Based on the information you have submitted, the Department of Environmental Conservation has
determined that the property landward of the 10 foot elevation contour on a gradual, natural slope as
shown on the site plan prepared by Nathalie Niemann dated 12/12/11 last revised 12/21/11 is
beyond Tidal Wetlands Act (Article 25) jurisdiction. Therefore, in accordance with the current Tidal
Wedands Land Use Regulations (6NYCRR Part 661) no permit is required.
Be advised, no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary, as indicated above, without a permit. It is
your responsibility to ensure that all precautions are taken to prevent any sedimentation or other
alteration or disturbance to the ground surface or vegetation within Article 25 jurisdiction which may
result from your project. Such precautions may include maintaining adequate work area between the
tidal wetland jurisdictional boundary and your project (i.e. a 15' to 20' wide construction area) or
erecting a temporary fence, barrier, or hale bay berm.

proposed actions that am subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
