Longo SCTM#1000-67-1-8 Request for Variances from Article XXIII Section 280-124 and the Building Inspector's December 29, 2011 Notice of Disapproval based on an application for building permit for "as built" demolition and re- construction of a new single family dwelling at: 1) less than the code-required minimum side yard setback of 15 feet; 2) less than the code required combined side yard setbacks of 35 feet; 3) more than the code required maximum lot coverage of 20%, located at: 220 Sound Avenue (adj. to Long Island Sound), Peconic, NY. SCTM#1000-67-1-8 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consister~cy Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed action is INCONSISTENT with the below listed LWRP polices and therefore INCONSISTENT with the LWRP: Policy 1. "Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. ' Policy 4. 1 "Minimize losses of human fife and structures from flooding and erosion hazards.' The following management measures to minimize losses of human life and structures from flooding and erosion hazards are recommended: specifically A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 3. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for: a. structures which functionally require a location on the coast or in coastal waters. d. sites where relocation of an existing structure is not practical The "as built" residential structure does not functionally ~equire a location on the coast and is not water dependent. Although due to lot size, configuration 'and area of unbuildable lands located on the lot the relocation of the structure is not feasible. The expansion of an existing structure 33% greater than permitted 20% lot coverage by code is inconsistent with the above policy - the area is subject to potential storm surge and/or flooding. In the event that the action is approved to further Policies 5 and 6 the following is recommended: Require that the action fully complies with Chapter 236 ""Stormwater, Grading and Drainage Control Law." Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Name of Owner: Barbara & Robert Longo ZBA File # REASONS FOR APPEAL (additional sheets maF be used with preparer's signature): AREA VARIANCE REASONS: (1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: Map of Peconic Shores is a developed summer community with narrow lots on both sides of Sound View Avenue. The waterfront lots extend 400 feet to the Long Island Sound. A building permit was issued for additions and alterations with the existing roof to be replaced, new windows, siding and footings, as needed The existing roof structure was pieced together over the years, additions and alterations were added without replacing the roof. The new roof would require new framing and structural supports to unify the structure. The pitch of the new roof is 12/7 and the top of the pitch is 20' 6". The house remained a one story dwelling with a new roof pitch and renovations. The original structural footings were both cement block and posts. The footings were exposed to determine whether they are poured concrete and whether they will need to be replaced. Most of the footings were found to be structurally conforming. After the building permit was issued the wall framing and flooring was exposed. The builder and Nancy Dwyer stopped the work, called the building department, and requested their review of the work. Before the repair work under the building permit was started the building department determined that more reconstruction was going to be required to the walls then what had been anticipated and the building department, at this point, considered the amount of reconstruction to be labeled a "demolition" and requiring a variance. All the repairs and alterations are within the existing structure. The existing setbacks of the house will not change. The lot coverage remained the same before and after the work. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The structures and the property are non-conforming. The owners are strict followers of Feng Shui and carefully planned the house restoration to maintain the feel and dimensions of the original structure. The existing house needed repairs and as part of the renovation, the existing roof must be replaced with a new pitch. The roof pitch of the original roof was 12/4, the new pitch provides for an attic space for the utilities and extends across the house under one structure. The existing house also required structural improvements to the existing foundation (posts). Ali the work proposed will make the house safer and structurally sound. The work to the house was being performed from the inside, new windows and sheathing are required, but the volumes of the house and decks remain. (3) The amount of relief requested is not substantial because: While the variances are significant, the property is nonconforming and neighboring properties are similarly developed in this community. The roof pitch and height are changed, but the height of the roof remains a one story house, at a height of 20-6 from grade. The outside asbestos shingles were removed and the interior was exposed to inspect the condition of the existing structure. The work to the existing house is "in kind and in place", with those changes to the structure required under the N.Y. State Building Code. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The house is more than 300 feet from the Long Island Sound. The existing house will be made more confirming to the NYS Fire Prevention and Building Code. The deck was replaced in 2004 (with ZBA approval) and the work done to the house preserved the character of the neighborhood. The repairs and alterations to the existing dwelling will conform to the bungalow style in this subdivision. The front and rear decks are expected to remain and the work will have no impact on the physical or environmental conditions in the neighborhood. Landward of the existing deck, in the rear of the house, a 2 foot "nook" on the east side is being cut back to its original design in line with the west side of the rear wall, complying with feng shui principles and making the honse smaller by approximately 20 square feet. (5) Has the alleged difficulty been self-created? ( )Yes, or ( X)No the existing house was pre-existing nonconforming as to set backs. The lot is only 50 feet in width, the existing foundation (posts and blocks on footings are substantially conforming) The floor joists and struts need repairs and replacements in the oldest part of the house. Once the structure was exposed, it appears that the house was constructed using lumber scraps. The heights and sizes of the floor joists and framing are inconsistent and randomly placed resulting in uneven floors throughout the house. The house is retained in its historic location, it is not expanded, it is restored. The lot is very deep but the Coastal Erosion Hazard Line reduces the "buiidable area" to 4,350 square feet on this lot. The Map of Peconic Shores, filed August 5, 1924 as map number 117, and the survey contains 21,023 sq.ft, lot size.
