Proper-T Permit Services on behalf of EDWARDS AVENUE CORORATION requests a Wetland Permit
to construct wood frame stairs 4' wide down the bluff; a 4'x8' landing at the top of bluff; steps rise +/-13'
and run +/-22'5", with grade level wood walkway 4'x15' at bottom, adjacent to existing bathhouse.
Located: 750 Paradise Point Road, Southold. SCTM#81-3-26.1
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
Policy 1 Foster a pattern of development in the Town of Southold that enhances com-
munity character,preserves open space, makes efficient use of infrastructure,
makes beneficial use of a coastal location, and minimizes adverse effects of
development.

The construction of stairs to grade on the seaward side of an existing bluff is con-
sistent with the character of the waterfront community. Because of the low profile
and unobtrusive appearance of the proposed structure it is felt that there is no ad-
verse impact on the desired preservation of open space. Infrastructure use is not a
factor since the project is for the further appropriate development of an existing
private location. The project is certainly a beneficial use of the coastal location,
and there will not be even an incremental increase in development in the area.
Policy 2 Preserve historic resources of the Town of Southold.

There is no evidence to indicate that the immediate area of the project includes his-
toric features, and it is to be expected that because of the topography of the project
area it is unlikely to have been to site of activities of past civilizations.
Policy 3 Enhance visual quality and protect scenic resources throughout the Town of
Southold.

The proposed structure will be inconspicuous in its proposed location, and the ex-
isting mature vegetation in the area contributes to its suitability in this location.
The addition of stairs to access the near shore area will not be visually intrusive. It
is compatible with other existing shoreline structures in the area,and will not ad-
versely affect the dynamic landscape elements (tidal fluctuations, seasonal vegeta-
tion changes)which might contribute to ephemeral visual qualities.
Policy 4 Minimize loss of life,structures,and natural resources from flooding and ero-
sion.

It is unlikely that the proposed stairs would contribute to increased hazards which
could result in the losses listed.Natural protective features will not be adversely af-
fected.
Policy 5 Protect and improve water quality and supply in the Town of Southold.

The proposed addition of stairs to access the near shore area will not have any ef-
fect upon water quality and supply. During construction liquid or solid wastes will
not be discharged into the water or wetlands. Disturbance of the shoreline during
construction will be minimal.
Policy 6 Protect and restore the quality and fuuction of the Town of Southold's ecosys-
tem.

The project is located in or immediately adjacent to the Orient Harbor Significant
Coastal Fish and Wildlife Habitat. However,the entire shoreline in the area of the
proposed project(650' northwest and 550' southeast)is hardened either by bulk-
heading or by a single rock revetment(-300' northwest), and the entire northeast-
ern shore of Orient Harbor is developed. The main thrust of the NYSDOS narrative
appears to be the protection of water quality in the area, and the proposed project
will not have any lasting adverse impact on water quality in Orient Harbor.
All statutory and regulatory requirements, at all levels of government, will be
strictly complied with. The minimal amount of construction required at the low
end will be conducted in such a way, with the advice and consent of the Southold
Trustees, as to minimize any transitory impact upon the waters of Shelter Island
Sound.
Policy 7 Protect and improve air quality in the Town of Southold.

The construction or future use of the project as proposed will not result in signifi-
cant amounts of new air pollution.
Policy 8 Minimize environmental degradation in the Town of Southold from solid
waste and hazardous substances and wastes.

The project as proposed will not result in the generation of any additional solid
waste. The handling and storage of petroleum products during construction will be
accomplished through the use of approved containers and facilities, and methods of
handling and storage in compliance with all applicable local, state and federal
regulations will be followed.

lands, and public resources of the Town of Southold.
