WlTNESSETH, that the party of the first part, in consideration of ten ($10.00) and other Valuable consideration paid by
the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors
and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and
being at Peconic, Town of Southold, Suffolk County, New York, bounded and described as follows:
BEGINNING at a point on the easterly side of Wells Road at the southwesterly corner of premises now or formerly of
Condit;
RUNNING THENCE along said easterly side of Wells Road, North 5 degrees 03 minutes 10 seconds West 312.37 feet
to a point marked by a monument;
RUNNING THENCE still along the westerly side of Wells Road, North 17 degrees 37 minutes 00 seconds West a
distance of 287.44 feet;
RUNNING THENCE along other land of the Estate of George H. Wells in an easterly direction, South 84 degrees 44
minutes 30 seconds East a distance of 160 feet, more or less as shown on a sketch plan made for Herbert W. Wells,
revised July 31, 1979, made by Roderick Van Tuyl, P.C.;
RUNNING THENCE in a southerly, southeasterly and southwesterly direction along ordinary high water mark of
Richmond Creek as it winds and turns to the northeasterJy corner of land now or formerly of Condit;
RUNNING THENCE along said land of Condit, South 84 degrees 56 minutes 50 seconds West a distance of 194 feet,
more or less, to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated September 20,
2007, and recorded in the Suffolk County Clerk's Office on October 1, 2007, in Liber 12524 at Page 536.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the
above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights
of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever, except as aforesaid.
AN D the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will
receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be
applied first for the purpose of paying the cost of the improvement and wilt apply the same first to the payment of the
cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be
construed as if it read "parties" when ever the sense of this indenture so requires.
