Main Rd. &Youngs Ave.) T Southold, NY 11971 G Q Telephone: 631 765-1938 '41 Fax:631 765-3136 Z-2�COUNry,N� LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Jim King, President Town of Southold Board of Trustees From: Mark Terry, Principal Planner LWRP Coordinator Date: July 18, 2012 Re: Proposed Wetland Permit for WILLIAM MURPHY& KIMBERLY REECE SCTM#1000-118-1-4.1 En-Consultants on behalf of WILLIAM MURPHY & KIMBERLY REECE requests a Wetland Permit to remove and replace (within footprint and approx. 1' higher) existing one-story portion and two-story dwelling in place); install a drainage system of roof drywells, leaders and gutters; construct a 14'X 24' screened porch in place of and within footprint of existing deck and a 15' X 26' on-grade masonry terrace in place of existing 10'X 22' brick terrace; construct various on-grade stone/masonry walkways in place of and/or in addition to existing walkways; replace existing timber steps to dock path and construct new timber steps; construct new stoop in place of existing stoop; remove existing driveway and install new pervious gravel driveway; construct 18'X 38' swimming pool, TX 7' spa and 480 sf. on- grade masonry pool patio; install pool fencing, pool equipment, pool drywell, and plantings to screen pool; maintain approx. 9,448 sf. area of natural vegetation adjacent to wetlands as non-disturbance buffer; and establish approx. 3,440 sf. area adjacent to non-disturbance buffer as variable width non- turf buffer. It is recommended that the limits of non-disturbance buffers and non-turf buffers be clearly marked on the plans (the legend does not differentiate between the two) and in the field. 2. Require the use of native, drought tolerant plants for pool screening. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. Since the area of the renovated dwelling will not be increased,roof runoff will thus be decreased. And by reducing lawn areas and increasing the setback of lawn areas from wetlands by establishing buffers that serve both as a sink and filter for stormwater runoff and contaminants,the quantity of runoff reaching the adjacent tidal waters will be decreased and the quality of the runoff will be improved through a reduced concentration of potential fertilizers,pesticides,and insecticides. Therefore,water quality and supply will be both protected and improved. Attach additional sheets if necessary Policy 6. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable Although the subject property is constrained by wetlands on three sides,the swimming pool is proposed in a location that exceeds the 50-foot wetlands setback for swimming pools required by Chapter 275 by roughly 50 percent and also conforms to Chapter 280 zoning requirements. As a result of placement of the proposed swimming pool,the pervious driveway will be moved closer to wetlands to the south but farther from wetlands to the north. With respect to the partial dwelling reconstruction and alterations,the proposed reconstruction of the one-story portion of the existing dwelling will occur entirely within the same footprint as the existing dwelling,thus maintaining the area and wetlands setbacks of the existing dwelling,the balance of which will remain in place. The proposed screened porch will be constructed within the same footprint as the existing deck,thus also maintaining the same area and wetlands setbacks as the existing deck. The proposed 15'x 26'on-grade masonry terrace will be constructed in place of an existing 10'x 22'on-grade brick terrace and maintained lawn area. As mitigation for the increase of roughly 800 square feet or 2 percent of Town-defined lot coverage,the project proposes to permanently maintain an approximately 9,448 sf area of natural vegetation adjacent to wetlands as a nondisturbance buffer and to additionally establish approximately 3,440 square feet of presently cleared area adjacent to the nondisturbance buffer as a variable width nonturf buffer. Additional plantings will also be established outside these buffer areas between the pool and wetlands to screen the pool. A drainage system of drywells,leaders,and gutters will be installed to collect roof runoff from the existing dwelling,and a pool drywell will be installed to capture pool backwash. A project limiting fence and staked haybales will be set in place to control and contain site disturbance during construction. Therefore,these mitigative measures and benefits together with those described in Policy 5 will protect and restore the quality and function of the adjacent wetland ecosystem by maintaining and/or enhancing the presently developed areas located adjacent thereto.
