BEING AND INTENDED TO BE the same premises conveyed to grantor by deed dated
July 25, 2008 recorded in the Suffolk County Clerk's Office on September 10, 2008 in Liber
12564 at Page 469, as corrected by deed recorded in Liber 12694 at page 374.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party &the first part
in and to said premises,
TO HA VE AND TO HOLD the premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party &the second part forever.
AND the party &the first part, covenants that the party &the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever, except
as aforesaid.
AND the party of the first pan, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost oflhe
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as ifil read "parties" whenever the sense of this indenture so
requires.

ALL that certain plot, piece or parcel of land, situate, lying and being at Bay View, near
Southold, in the Town of Southold, County of Suffolk and State of New York, being
known and designated as Lots 53, 54 and 55 on a certain Map entitled "Map of Goose
Neck, situate at B. ayview, Town of Southold, Suffolk County, NY, owned by G.W. Smith
8,: Sons", made by Otto W. Van Tuyl, Licensed Surveyor, Greenport, NY, and filed in the
Suffolk County Clerk's Office on November 22, 1948, as and by File No. 1663.
PARCELII:
ALL that certain plot, piece or parcel of land adjacent and contiguous to the premises
above described, being bounded northwesterly by the premises above described,
northeasterly by other land of the party of the first part; southerly by the existing canal;
and westerly by other land of the party of the first part, being and intended to be a portion
of the premises heretofore conveyed by Mary L. Dayton to George W. Smith and Sons,
Inc. by deed dated October 5, 1951 and recorded in the Suffolk County Clerk's Office on
October 9, 1951 in Liber 3274 of Deeds at page 532;
The aforesaid Parcels I and I1 being adjacent and contiguous and taken together being
more particularly bounded and described as follows:
BEGINNING at a stake set on the southeasterly line of Smith Drive South at the
northwesterly comer of Lot 55 as shown on Map entitled, "Map of Goose Neck situate at
Bayview, Town of Southold, Suffolk County, NY", filed in the Suffolk County Clerk's
Office as Map Number 1663; from said point of beginning running thence along said
southeasterly line of Smith Drive South two courses, as follows:
North 39 degrees 00 minutes East, a distance of 156.31 feet;
North 80 degrees 30 minutes East, a distance of 8.99 feet to a stake;
RUNNING THENCE along the southwesterly line of Lot 52 shown on said Map and
other land, South 39 degrees 42 minutes East, a distance of 305.65 feet to a dredged
canal;
RUNNING THENCE along said dredged canal, South 58 degrees 30 minutes 10 seconds
West, a distance of 109.47 feet;
RUNNING THENCE along other land and along the northeasterly line of said Lot 56,
