SCTM#1000-122-9-6.2 En-Consultants on behalf of STRONG'S MARINE, INC. requests a Wetland Permit to construct approximately 294 linear feet of low-sill vinyl bulkhead (including +/-34' and +/-15' returns) along shoreline of eroding embankment; dredge approximately 600 cubic yards of sand/silt spoil from existing +/-5,620 square foot basin area, including area of Phragmites at head of basin, to a maximum depth of-4'MLW (-3'MSL); place approximately 91 cubic yards of spoil in un-vegetated area behind proposed low-sill bulkheading for planting with Spartina alterniflora (12" o.c.) to create approximately 2,195 square feet of intertidal marsh; and place remaining spoil, approximately 509 cubic yards, in spoil disposal area in existing pervious parking area to east of basin. At head of basin, construct +/-59 linear feet of high-sill bulkhead, including a +/-33' primary section that will front and support a proposed 20'x26' concrete boat launch (with 4'x12' steel pad) and +/-14' and +/-12' seaward sections on each side of basin that will tie into +/-7' sloped sections of wall to connect and transition the high-sill bulkhead into the proposed low-sill bulkheading; and construct two (2) 12' angled landward returns off ends of +/-33' primary section. Along seaward side of low-sill bulkheading, install 5' wide service staging floats with a total length of 242 linear feet; two (2) irregularly shaped landing floats, each approximately F to 6' wide and 13' to 14' long; and two (2) 3'x15' ramps. (These floats will not allow for the expansion of the marina use because they will not provide any permanent docking space for customer boats but only for temporary staging activities associated with the preparation and servicing of customer boats prior to launch and delivery to the customer for use). To facilitate installation of the proposed boat launch, relocated existing 10'x17' shed a minimum distance of 75' from wetlands and relocate an approximately 10' wide section of existing boat racks from west end of boat racks to east end of boat racks. SCTM# 122-9-6.2 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that the Board considers the following: In the event that the action is approved the following BMP is required pursuant to: § 275-11. Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (2) Erosion control. Installation of an erosion control structure is necessary during any building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s) shall be determined by the Trustees or their designee. All intertidal construction and excavation requires the installation of a silt boom that will retain all suspended sediments within the immediate proiect area Require the installation of a silt boom in areas where practicable Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus each answer must be explained in detail, listing both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. The purpose of the proposed project is to stabilize the eroding shorelines forming the basin and to establish a service staging area therein for preparation and servicing of customer boats prior to launch and delivery to customers. Establishment of this area will create the significant environmental benefit of creating more than 2,000 square feet of vegetated intertidal marsh in an eroding area now devoid of wetland vegetation while increasing both safety and efficiencies of marina operations by relocating the existing fork lift travel route away from the customer parking area and shortening its travel distances by two to three hundred feet, thus reducing fuel consumption and ambient noise associated with forklift use in boat launching and servicing activities. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III - Policies Pages 8 through 16 for evaluation criteria ®Yes ❑ No ❑ Not Applicable Currently,the shorelines of the subject basin,which has been present since prior to 1960,are eroding chronically and severely,resulting in the loss of bank vegetation,including mature trees,and the sedimentation and shoaling of the basin and perimeter of the adjacent navigational channel. Therefore,the construction of the proposed low-sill bulkheading will stem this chronic erosion of the shoreline and loss of vegetation by physically stabilizing the toe of the embankment and establishing 2,195 square feet of vegetated intertidal marsh behind it via placement of fill(adjacent dredged spoil)and plantings of intertidal marsh grass,Spartina altemiflora. The project is thus consistent with Policy 4 in that by using a low-sill bulkhead and marsh plantings,it limits to the minimum scale necessary the hard structural erosion protection component and employs a vegetative non-structural component as well. The use of the adjacent dredged spoil as fill to enhance or in this case create a presently lacking natural protective feature, i.e,the intertidal marsh,is further consistent with the methods of erosion control recommended by Policy 4. See LWRP Section III - Policies Pages 16 through 21 for evaluation criteria ®Yes ❑ No ❑ Not Applicable The proposed project is consistent with Policy 5 to the extent that the created marsh will serve as a sink and filter for contaminants potentially entering the waterway from the surrounding upland,thus providing a potential benefit to the quality of surface water. The dredging of the basin will have only temporary impacts on the adjacent waterway through increased turbidity,which will be controlled by employing a silt curtain during dredging and the proposed staging floats will be constructed with untreated decking as required by code. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable The project will be consistent with the goal of restoring the quality and function of Town wetlands,most specifically the policy goal of protecting and restoring tidal wetlands,through the creation of 2,195 square feet of vegetated intertidal marsh via placement of fill (adjacent dredged spoil)and plantings of intertidal marsh grass,Spartina alterniflora. This intertidal marsh will be established where none presently exists,thus creating a net increase to Town wetlands. A much smaller area of Phmgmites will be removed to allow for installation of the proposed boat launch,but compared to the area of marsh to be created,this removal of invasive vegetation is warranted ecologically,as intertidal marsh has the highest primary productivity of any category of tidal wetlands and would introduce presently lacking wetlands functions and values in that area,including providing habitat and a source of organic nutrients for the surrounding marine community. The created marsh would also serve as a sink and filter for contaminants potentially entering the waterway from the surrounding upland as described above. In fact,the project has the potential to indirectly improve the use of the adjacent public navigational channel by stemming the loss of material from the eroding shorelines forming the basin,which is entering the adjacent channel and contributing to the shoaling thereof. Currently, without the proposed staging area,the marina fork lifts must travel from the boat racks an average distance of 350 to 400 feet through the existing customer parking and other areas regularly walked and accessed by customers and their families to launch boats for service. The proposed staging area and new launching pad would obviate the need for the forklift to travel across the customer parking area and reduce the forklift travel distance by approximately 250 feet or roughly 65%to 100 to 150 feet,thus increasing safety within the marina and reducing fuel consumption and ambient noise associated with boat launching and servicing activities. The proposed staging floats will not allow for the expansion of the existing marina use,however,because they will not provide any permanent or transient docking space for customer boats but only for temporary staging activities associated with the preparation and servicing of customer boats prior to launch and delivery to the customer.
