Karen A. Hoeg, Esq. on behalf of EVAN & BARBARA BELL requests a Wetland Permit and Coastal
Erosion Permit for the removal of the existing gazebo which is not to be replaced; permit the existing
dwelling, existing deck, existing hot tub, existing timber bulkhead, existing timber stairs, existing 17'x9'
timber deck at the base of the stairs, and existing 8'2"x5'4"x5'6" timber deck at top of bluff; and permit
general maintenance of same. Located: 1055 $oundview Avenue, Mattituck. SCTM# 94-1-9
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the actions is
INCONSISTENT with LWRP Policy 6.3 (below) and therefore, INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee
permit conditions.
275-11 Construction and operation standards.
A. General. The following standards are required for all operations within the jurisdiction of the
Trustees:

Decks and platforms. No decks or platforms shall be permitted on or near
bluffs. Platforms associated with stairs may not be larger than 32 square
feet. [Amended f0-11-2005 by L.L. No. 17-2005]
The '153' square foot deck, the 45' square foot deck (square footage not indicated) and gazebo
are not permissible.
The structulres are located seaward of the Coastal Erosion Hazard Line.

A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including B~F~g Permits
