Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111 ) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 100' landward from the top of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground sudace or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. Any material dredged in the conduct of the work herein permitted shall be removed evenly, without leaving large refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause damage to navigable channels or to the banks of a waterway. 5. There shall be no unreasonable interference with navigation by the work herein authorized. If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. Such representative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when requested by the Department. Section 323.1.3.3 in the 2007 Residential Code of New York State requires a freeboard of two feet above the design flood elevation, which would bring the required elevation to 13 feet. 4. The petitioner has proposed to construct the dwelling at an elevation of 11.5 feet, which would be .5 feet above the FEMA design flood elevation. The petitioner states that raising the dwelling to the required 13 Petition No. 2009-0185 Page 2 feet, inclusive of the two-foot freeboard, would put the first story approximately 6.5 feet above the existing grade, necessitating that additional fill be brought in to cover the lot. In doing so, more of the existing vegetation would be destroyed, which the petitioner is trying to avoid. 5. Th petitioner wishes to maintain as much of the existing vegetation on the vacant parcel as possible, with the exception of some stumps and brush. Th petitioner states that all limbs from the clearing will be chipped on site, all trees to be removed for the construction of the building will be used for firewood, and a number of trees will be transplanted on the lot. 6. The dwelling is located in an established neighborhood where the first floor of most homes are set at, or well below, the required 11-foot design flood elevation, let alone the 13 feet with the additional two-foot freeboard. The petitioner has stated that raising the dwelling to the required 13-foot design elevation would put the house much higher than the adjoining homes, breaking the continuity of the neighborhood. 7. FEMA is in the process of upgrading the flood maps, which is expected to take place by the end of this year. The preliminary maps, which have been made available for this area, have lowered the design flood elevation to eight feet. However, at this time, these maps are not official. 8. At only eight feet, with the required two-foot freeboard, this dwelling could be constructed at ten feet, which is one foot lower than the current design flood elevation, and three feet lower than the currently required 13 feet. 9. The petitioner has stated that the plans for the proposed dwelling have been going on for some time, and the petitioner does not want to wait until the end of this year to proceed with this project. 10. The petitioner has stated that he would be able to get flood insurance with the dwelling elevated to ten feet without the two-foot freeboard, or to the 11.5 feet he is requesting in this variance. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would entail a change so slight as to produce a negligible additional benefit consonant with the purposes of the Code. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 19 NYCRR Part 1220, Section R323.1.3.3, be and is hereby GRANTED. Furthermore, it should be noted that the decision of this Board is limited to the specific building and application before it, as contained within the petition, and should not be interpreted to give implied approval of any general plans or specifications presented in support of this application. During a recent storm event, there was a problem with moderate flooding in there rear yard. According to this Homeowner, when storm conditions were severe enough, storm water would flow from east to west through various back yards and end up in a freshwater wetland that is located on the Bosworth property. Apparently, the building of this new residence required "Fill" to accommodate the new construction and subsequent regarding of the property may have inadvertently cut off or dammed up a natural watercourse in this area. I have reviewed the Permit File for the above referenced project with respect to the requirements of Chapter 236 - Storm Water Management. According to the Storm Water Assessment Form that had been submitted by the applicant, they have acknowledged that this site is within the Trustees jurisdiction and that there may be a Natural Water Course traversing the site. Upon review of the Survey submitted by the applicant, there appears to be a natural Iow lying area that could direct excess storm water flow in a northwesterly direction. This natural water course appears to traverse several properties and ultimately ends up in the wetland. At your convenience, I would like to schedule a field inspection of the site to inspect this matter first hand. I would like to investigate whether the New Fill and/or regarding of the site has caused storm water runoff to back up in the adjacent properties. If we can determine this to be the case I would recommend that the Building Department require additional grading to open the natural flow of storm water to the wetland area. NCFI 11-016 APPLICATION INFORMATION EQUIPMENT AND COMPONENT RATIOS: It is preferred that this system be processed with Graco Polyurethane Spray Equipment. NCFI 11-016R is connected to the resin pumps with NCFI 11-016A being connected to the isocyanate pumps. The proportioning pump ratio is 1 to 1. Graco preheater and hose temperature should be set at 130°F to give a good pattern. For high-pressure equipment, temperature settings may be slightly higher. STORAGE AND USE OF CHEMICALS: Keep temperature of chemicals above 70°F for several days before use. Cold chemicals can cause poor mixing, pump cavitations or other process problems due to higher viscosity at lower temperatures. Storage temperature should not exceed 90°F. Do not store in direct sunlight. Keep drums tightly closed when not in use and under nitrogen pressure of 2-3 psi after they have been opened. The shelf life of NCFI 11-016 is six months. SAFE HANDLING OF LIQUID COMPONENTS: Use caution in removing bungs from the container. Loosen the small bung first and let any built up gas escape before completely removing. R component will froth at elevated temperatures. Avoid prolonged breathing of vapors. In case of chemical contact with eyes, flush with water for at least 15 minutes and get medical attention. For further information refer to "MDI-Based Polyurethane Foam Systems: Guidelines for Safe Handling and Disposal" publication AX-119 published by Alliance For The Polyurethanes Industry 1300 Wilson Blvd, Suite 800, Arlington, VA 22209. PREPARATION OF SURFACE TO BE SPRAYED: 11-016 is suitable for application to most construction materials including wood, masonry, concrete, and metal. All surfaces to be sprayed should be clean, dry, and free of dew or frost. All metal to which foam is to be applied must be free of oil, grease, etc. The maximum thickness of each layer or pass of foam should be 1%". Multiple layers can be applied to reach the desired R value. OPTIMUM ADHESION TEMPERATURE OF SURFACE TO BE SPRAYED: On general work where the surface to be sprayed will remain at ambient temperature or cooler, the surface should be between 50°F and 120°F. In this range the warmer the surface the better the adhesion. When surfaces to be sprayed are cooler than 60°F a flash coat should be applied with the second coat following as soon as the odginal coat is no longer tacky to the touch. For service temperature in the range of 120-180°F, the surface to be sprayed should be 120°F or above at time of spraying. WEATHER PROTECTION OF FINISHED FOAM: The finished surface of sprayed polyurethane foam should be protected from adverse effects of ultraviolet rays of direct sunlight, which can cause dusting and discoloration. Protective coatings designed for use with polyurethane foam are available. VAPOR BARRIER PROTECTION ON COLD STORAGE APPLICATIONS: When NCFI sprayed polyurethane foam insulates structures subject to continuous cold temperatures, such as coolers and freezers, a Class I moisture vapor barrier ( 0.1 perm or less) is normally required on the "werm" side of the foam insulation.
