THIS INDENTURE,made the day of Ockober' ,nineteen hundred and ninety-eight BETWEEN ROY IVAR MARTIN, residing at 18 Denison Drive, Saddle River New Jersey 07458 party of the fust part, and ROY WAR MARTIN,as to an undivided fifty(50%)percent interest, residing at 18 Denison Drive, Saddle River, New Jersey 07458 and ELIZABETH PURDY MARTIN, as to an undivided fifty (50%)percent interest, residing at 18 Denison Drive, Saddle River,New Jersey 07458 as Tenants in Common. Shinkle in a northerly direction North 10 degrees 56 minutes 40 seconds West a distance of 588.59 feet to the average high water line of Long Island Sound; THENCE running in a general easterly direction along the average high water line of Long Island Sound North 89 degrees 54 minutes 30 seconds East a distance of 100 feet; 'THENCE running in a general southerly direction along other lands now or formerly of Gladys W. Shinkle, South 11 degrees 04 minutes 40 seconds East a distance of 560 feet to the northerly side of Sound View Avenue; THENCE running in a general westerly direction along the northerly side of the said Sound View Avenue South 73 degrees 27 minutes 30 seconds West a distance of 100 feet to the point or place of BEGINNING. BEING and intended to be the same premises conveyed to the party of the first part by deed dated December 15, 1967 and recorded in Liber 6277 Page 120 of the Suffolk County Clerk's Office on December 21, 1967. No building will be constructed by the party of the second part, or by his heirs or assigns that will cost less than$3,500.00. Together with all the right,title and interest of the party of the first part ofy in and to the beach and land under water of the Long Island Sound in front of and adjacent to the said premises. Together with all of the right, title and interest of the party of the first part of, in and to Sound View Avenue lying in front of and adjacent to the said premises. SUBJECT TO: 1. Covenants and restrictions contained in instrument recorded in Liber 2397 of Conveyances, Page 579. 2. Any state of facts that an accurate survey may show. 3. Any encroachments by the waters of Long Island Sound. 4. The right of the government of the United States to change the Harbor line adjacent to the premises herein or to establish a bulkhead line different from said Harbor line; together with the appurtenances and all the estate and rights of the party of the first part in and to said premises. TOGETHER with all the right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof, TOGETHER with the appurtenances and all the estate and rights of the party of the first part and to said premises;TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered ;anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement ;and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
