and being at Fishers Island, Town of Southold, County of Suffolk and State of New York, being more particularly
bounded and described as set forth on Schedule A hereto.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed made by James
V. Righter and Anne R Righter, dated February 1,2005 and recorded in the Office of the Suffolk County Clerk on
March 14, 2005 in Liber 12376 page 345.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the pady of the first part in and to said premises; TO HAVE AN B TO HOLD the premises herein
granted unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AN D the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose. The
word "party" shall be construed as if it read "padies" whenever the sense of this indenture so requires.

BEGINNING at a monument on the southwesterly line of Crescent Avenue, said
monument being located 5960.73 feet Nodh of a point which is 3667.96 feet West of a
monument marking the U.S. Coast and Geodetic Survey Triangulation Station "PROS";
and
RUNNING THENCE South 15 degrees 39 minutes 55 seconds East, about 694 feet to
the shore of Hay Harbor;
THENCE southeasterly, about 33 feet along the shore of Hay Harbor;
THENCE North 24 degrees 14 minutes 00 seconds East, about 485 feet to an iron pipe
on the southwesterly line of Crescent Avenue;
THENCE North 36 degrees I6 minutes 00 seconds West, 73.00 feet along said Avenue
line to a monument;
THENCE North 63 degrees 30 minutes 40 seconds West, 416.75 feet along said Avenue
line to the monument at the point of BEGINNING.
SUBJECT TO a right of way in favor of John S. Guest over a portion of the above
described tract, said right of way being triangular in shape and is described as follows:
