Lark & Folts, Esqs. on behalf of ELLEN F. EMERY requests a Wetland Permit to construct a 32 sf.
observation platform in conjunction with the existing stairway system. Located: 5925 Nassau Point Rd.,
Cutchogue. SCTM#111-13-6
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
CONSISTENT with the denoted following Policy Standards and therefore is CONSISTENT with the
LWRP provided the following:
1. It is recommended that a more detailed restoration plan (species, spacing and survivability) be
submitted for the "cut area" show on the third sheet titled "Site Plan of Stairs and Proposed Platform"
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

When the size of the existing platform on the premises is reduced to 32 square feet, there
will bg a tremendous loss of the panoramic view of Peconic Bay and its shoreline. The
additional lower deck of 32 square feet will basically restore the present observation
view and make beneficial use of this Bay-front property.
