Re: Proposed Wetland Permit for HESS LIFETIME QTIP TRUST SCTM#1000-128-2-4 En-Consultants, Inc. on behalf of HESS LIFETIME QTIP TRUST requests a Wetland Permit to remove and replace in-kind, in-place and 8" higher approx. 89 If. of timber retaining wall; backfill with approx. 15 cy. of sandy fill; and replant with native vegetation approx. 15' wide embankment to be maintained as a 15' wide non-turf buffer. Located: 6242 Peconic Bay Blvd., Laurel. SCTM#128-2-4 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of SoutholdTown Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is EXEMPT from LWRP review pursuant to: § 268-3. Definitions. MINOR ACTIONS item "B" which states: B. Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site (inplace), including upgrading buildings to meet building or fire codes, except for structures in areas designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be replaced, rehabilitated or reconstructed without a permit and shoreline erosion control structures (including, but not limited to, groins, jetties, bulkheads, filled piers) located within Great Peconic Bay, Cutchogue Harbor, Little Peconic Bay, Hog Neck Bay, Noyack Bay, Southold Bay, Shelter Island Sound, Pipes Cove, Orient Harbor, Gardiners Bay, Long Island Sound, Fishers Island Sound and Block Island Sound (excluding all creeks); Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. See LWRP Section Ill - Policies Pages 8 through 16 for evaluation criteria XYes[ No V1 N ca.e The project entails the ordinary and routine replacement of an existing retaining wall located landward of a primary bulkhead, which retains and supports the naturally vegetated embankment behind it and between the upland lawn area and primary bulkhead. The wall is located between a functional retaining wall on the adjacent property to the west and also a functional section of retaining wall to the east on the subject property. Without replacement of this section of wall, the embankment would be allowed to slough and in turn compromise the vegetated slopes located behind these adjacent functional walls. As part of the project, the slope behind the new wall will be revegetated and maintained as an approximately 15' wide nonturfbuffer upon project completion. Therefore, it is necessary to replace the wall, and doing so will be consistent with Policy 4. Attach additional sheets if necessary Policy 5.
