Land Use Ecological Services, inc. on behalf of LAWRENCE NIEBLING requests a Wetland Permit to
construct a 4'X 70' timber walkway over an existing deteriorating concrete walkway leading to a
proposed 6'X 10' open grate platform with 4'X 15' staim proposed for beach access; existing stairs with
the portion of the concrete walkway to be removed; install 100+/- If. of 18-24" stone (500-1000 lb.) on
filter fabdc along the eroded scarp at the toe of the existing bluff; 50+/- cy. of clean sand from an upland
source is proposed to cover the stones and restore the bluff slope and planted with beach grass on 12"
centers; and all bare areas on the bluff face to be planted with Beach Grass on 12" centers. Located:

centers); has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold
Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon
the information provided on the LWRP Consistency Assessment Form submitted to this department, as
well as the records available to me, it is my recommendation that the replacements of bulkheads is
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP
1. It is recommended that the Board require survival requirements for the planted vegetation.
The construction of a proposed 6'X 10' (60 sq. ft.) open grate platform is not a permissible
action pursuant to 275-11 Construction and operation standards, A (6) and is INCONSISTENT with
LWRP Policy 6.3 (below) and therefore, INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee
permit conditions.
275-11 Construction and operation standards..
A. General. The following standards are required for all operations within the jurisdiction of the
Trustees:

Decks and platforms. No decks or plafforms shall be permitted on or near
bluffs. Platforms associated with stairs may not be larger than 32 square
feet. [Amended 10-ff.2005 by L.L. No. 17-2005]
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's
website (southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all
local libraries and the Town Clerk's office.

Project Description:

The applicant is proposing staks for shoreline access, and bluff stabilization and
restoration for the eroding bluff. A 4' x 70' timber walkway is proposed over an existing
deteriorating concrete walkway leading to a proposed 6'x10' open grate platform with 4'x15'
stairs proposed for beach access. The existing stairs with the portion of the concrete walkway
leading to them will be removed. 100+/- linear feet of 18-24" stone (500-10001b) on filter fabric
is proposed along the eroded scarp at the toe of the existing bluff as depicted on the section view
(sheet 3 of 3 of project plan~). 50+/- cubic yards of clean sand f~om an upland source is
proposed to cover the stones and restore the bluffslope and planted with beach grass on 12"
centers. Any and all bare areas on the bluff face are also proposed to be planted with Beach
Grass on 12" centers.
