Proper-T Permit Services on behalf of JOHN REARDON requests a Wetland Permit to reconstruct 200' of storm-damaged bulkhead using vinyl sheathing, increasing height by 1 '+/- with stairs to grade on seaward side; replace 184' of storm-damaged concrete retaining wall, with stairs from upland grade and 5' returns at each end, with 200' of retaining wall, using vinyl sheathing, with stairs from upland grade and 8' returns at each end; construct new deck 10'X 20' between bulkhead and retaining wall; and fill area between bulkhead and retaining wall with clean sandy soil from upland location, approx. 350 cy. Located: 920 Cedar Point Drive East, Southold. SCTM#90-2-19 The proposed action (increasing height by t'+/- with stairs to grade on seaward side; replace t84' of storm-damaged concrete retaining wall, with stairs from upland grade and 5' returns at each end, with 200' of retaining wall, using vinyl sheathing, with stairs from upland grade and 8' returns at each end); has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the replacements of bulkheads is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP Note: The construction of a proposed 200 square foot deck is not a permissible action pursuant to 275-11 Construction and operation standards, A (6) and is INCONSISTENT with LWRP Policy 6.3 (below) and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their - jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. 275-11 Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (6) Decks and platforms. No decks or platforms shall be permitted on or near bluffs. Platforms associated with stairs may not be larger than 32 square feet. [Amended 10-11-2005 by L.L. No. 17-2005] Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its wdtten determination regarding the consistency of the proposed action. NYSDEC, NYSDOS, USACE February 1, 2012 APPLICANT: JOHN REARDON SCTM #: 1000-90-2-19 LWRP CONSISTENCY ASSESSMENT FORM Policy 1 Foster a pattern of development in the Town of Southold that enhances com- munity character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes ndverse effects of development. [] [] NOT APPLICABLE The reconstruction of an existing bulkhead and an existing retaining wail is not inconsistent with the character of the waterfront community, and because of the relatively smail footprint of the exisfmg structures and their existence on the down- slope of a shoreline bluff, it is felt that there is no adverse impact on the desired preservation of open space. Infrastructure use is not a factor since the project is ac- cessory to and accessed from private property. The maintenance of the erosion control purpose of the structures is certainly a beneficiai use of the coastal location, and there is no incremental increase in development in the area since the structures already exist in the same forms as they will have after completion of the project. Policy 2 [] YES Preserve historic resources of the Town of Southold. ~O [] NOT APPLICABLE There is no evidence to indicate that the immediate area of the project includes his- toric features, and it is to be expected that the mainly intertidai nature of the project area is unlikely to have been the site of recoverable artifacts of past civilizations. Policy 3 Enhance visual quality and protect scenic resources throughout the Town of Southoid. [] [] NOT APPLICABLE The reconstruction will be done in such a manner that upon completion of the pro- ject the will be no apparent change in the project site. The existing stxucmres, which will retain their present forms, are compatible with other existing shoreline slructures in the area, and will not adversely affect dynamic landscape elements (tidal fluctuations, seasonal vegetation changes; seasonal/diurnal changes in ambi- ent ligh0 which might contribute to ephemeral visual qualities. Policy 4 Minimize loss of life, structures, and natural resources from flooding and ero- sion. [] YES ~NO [] NOT APPLICABLE It is intuitively obvious that the likelihood of the proposed activities contributing to increased hazards which could result in the loss of life from flooding or erosion is probably non-existent. The proposed reconstruction will have a significant posi- tive effect on the protection of structures and natural resources from flooding and erosion in that the existing structures, which have provided those features, have been seriously storm-damaged and their reconstruction is required in order that these protective features continue in effect. Policy 5 Protect and improve water quality and supply in the Town of Southold. [] NOT APPLICABLE Thc project presumably will extend the useful life of the existing structures and hence delay the time when they must be replaced, and therefore delay the time at which either of those eventualities will generate some degree of impact upon the Town's ecosystem. In the meantime, the project of itself will have no direct effect upon the Town's ecosystem, however that may be defined. The project will have no adverse effect upon existing tidal patterns and there will be no degradation of water quality. All statutory and regulatory requirements, at all levels of government, will be strictly complied with. No dredging, excavating, or filling in wetlands is included in the project. Policy 7 Protect and improve air quality in the Town of Southold.
