En-Consultants on behalf of WILLIAM EDWARDS & AMEI WALLACH requests a Wetland Permit to
resheath the landward side of approx. 94 If. of existing timber bulkhead with vinyl sheet pilings and
backfill with approx. 40 cy. clean sand to be trucked in from an upland source; and construct an 8'X 20'
deck with steps in place of existing 8.5'X 20' deck with steps. Located: 1600 Park Ave., Mattituck.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this -
department, as well as the records available to me, it is my recommendation that the actions:

CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP
Note: The construction of a proposed 160 square foot deck is not a permissible action pursuant
to 275-11 Construction and operation standards, A (6) and is INCONSISTENT with LWRP Policy 6.3
(below) and therefore, INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction

275-11 Construction and operation standards.
A. General. The following standards are required for all operations within the jurisdiction of the
Trustees:

Decks and platforms. No decks or platforms shall be permitted on or near
bluffs. Platfo~ns associated with stairs may not be larger than 32 square
feet. [Amended 10-11-2005 by L.L. No. 17-2005]

written determination regarding the consistency of the proposed action.

The existing site has been improved with and supported and protected from flooding and erosion by a bulkhead at the toe of the
embankment since prior to 1977, and the project seeks to maintain this existing condition through the ordinary and routine
repair/reinforcement &the bulkhead via resheathing and backfilling its landward side. There is no viable non-structural alternative
means of maintaining and protecting the vegetated embankment and existing upland portion of the parcel in its current location.
Therefore, the project is consistent with Policy 4 to the extent this policy can be applied to the repair of an existing bulkhead.
