Located: 1325 Gull Pond Lane, Greenport. SCTM#1000-35-4-10 The proposed action; construct a second-story addition and separate lantern addition atop the existing single-family dwelling; reconstruct the existing outdoor shower; abandon the existing septic system; install a new updated sanitary system, reconstruct and raise the existing bulkhead, stairway, hinged ramp; has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the actions are EXEMPT from LWRP review pursuant to § 268-3. Definitions. Minor Exempt Actions items: I1. Additions to an existing building or rebuilt residential structure which results in no net increase in ground area coverage, except where the parcel is located in a coastal erosion hazard area; Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site (inplace), including upgrading buildings to meet building or fire codes, except for structures in areas designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be replaced, rehabilitated or reconstructed without a permit and shoreline erosion control structures (including, but not limited to, groins, jetties, bulkheads, filled piers) located within Great Peconic Bay, Cutchogue Harbor, Little Peconic Bay, Hog Neck Bay, Noyack Bay, Southold Bay, Shelter Island Sound, Pipes Cove, Orient Harbor, Gardiners Bay, Long Island Sound, Fishers Island Sound and Block Island Sound (excluding all creeks); The proposals to abandon the existing septic system; install a new updated sanitary system, reconstruct and raise the existing bulkhead, stairway are CONSISTENT. It is recommended that the filled area landward of the bulkhead be stabilized with indigenous, vegetation. In addition, all intertidal construction and excavation requires the installation of a silt boom that will retain all suspended sediments within the immediate project area. Chapter 236 Stormwater, Grading and Drainage Control Law of the Southold Town Code (Amended 2012) requires that the action receive Stormwater Management Control Approval pursuant to: Site preparation within 1 O0 fozt of wetlands, beach, bluff or coastal erosion hazard area. A stormwater management control plan must be submitted to the Building Department. The proposed re-construction of the existing floating dock to (180 sq ft ) is not a permissible action pursuant to 275-11 Construction and operation standards, A (6) and is INCONSISTENT with LWRP Policy 6.3 (below) and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. 275-11 Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (c) Regulations for the placement and configuration of docking facilities. [1] Residential docks. [Amended 10-11-2005 by L.L. "Development that does not reinforce the traditional land use pattern of the Town of Southold would result in a loss of the community and landscape character of Southold.", this proiect is a proposal tn construct a 2nd-story Addition to an existinq dwelling within subiect I]rol~erty, a I~rooertv situated within a neiahborhood consistinq primarily of similarly-sized single-family dwellings within similarly-sized properties. The I]ro~osal, as desioned, will not result in adverse effects to the surroundinq environment in that the project will not expand upon the "footprint" of the existing dwelling, and will not encroach any further towards the surface waters of Gull Pond to the east. In addition, the surroundinq neighborhood is comprised of older residential dwellings which have existed harmoniously within this area for years and have not resulted in any form of adverse effects to the surrounding environment. Accordingly, we believe that this proiect is consistent with this policy. With resl~ect to the I~rooosed reconstruction of the prooosed bulkhead and dockin~ assembly: Subiect I~rooosal is consistent with the policy in that the siting/utilization of the reconstructed dock assembly and siting/utilization of the proposed reconstructed/reconfigured bulkhead will maintain the character of the surrounding neighborhood, which currently consists of many similarly-improved residential lots with similar accessory structures (i.e. dock assemblies and bulkheading along Gull Pond). In addition, subject prooosal will be in harmony with the "...beneficial use of a coastal location..." in that the legally created residential waterfront (i.e. coastal) lot will be enhanced by the reconstructed dock assembly in order to maintain access to the contiguous surface waters and the maintenance of existing erosion control structure/i.e, bulkheading). With respect to the proposed reconstruction of the proposed bulkhead and dockina assembly: Subject proposal will not adversely impact the visual quality of the surroundinc] area in that the surroundin(] area is currently comprised of properties improved with similar appurtenances li.e. dock assemblies and bulkheads) of equal, if not greater, size and scope. Scenic resources, assumedlv views of Gull Pond. are not at risk due to the reconstructed dock assembly and bulkheading being typical of the character of this section of waterfront. Minimize loss of life, structures, and natural resources from flooding and erosion. With respect to the proposed reconstruction of the proposed bulkhead and docking assembly: Subject proposal will fully comply with Policy 4 in that the reconstructed bulkheading & dock assembly is designed to be comparable in design and scope as that of the surroundincl bulkheadinq and dock assemblies, which have not resulted in loss of life. structures, and natural resources within this area. The proposed Reconstructed Bulkhead will consist of Vinyl-Sheathing (C-LOC or similar) secured by a landward Timber Clamp (6" x 6") and two (~2) tiers of Timber Walers (6" x 6") along the seaward face, further secured by Helical Screws (10' - 15' L) and Timber Pilings (10" qb) located on 8.0' o/c. A Timber Top-Cap (18" W) will be secured on top. Additionally, the Reconstructed Bulkhead will be increased in height by ~2.$' + in order to match the existing bulkhead to the immediate north, and {0 cubic yards of Clean Fill will be backfilled landward of the Reconstructed Bulkhead. The existing Stairway along the face of the bank will be reconstructed/repaired where required as a result of the Bulkhead Reconstruction and new elevation landward of same.
